Staff recommends approval of the Ordinance Amendment as presented in this report.
Background/Discussion
Earlier this May, the City Council directed staff to review the sign ordinance as it pertained to city
functions and signage on public property. This was a direct result of the Council's review of a request for
Art Soup signage on City right-of--way. The Planning Commission discussed this at the September
workshop asking additional policy questions. At the November 19, 2007 workshop the City Council
answered policy questions and directed staff to draft an ordinance amendment for adoption.

Based on the direction received thus far on this topic, staff recommends the following ordinance. New

Proposed ordinance amendments:
Section 30-866. District Regulations
(7)d. Signs must be located on the property of the business and the advertising message must only relate
to business conducted on that premises, except that nonprofit or charitable organizations as defined by
Internal Revenue Code section 501(C)(3)-may have off-premises signs for their fundraising activities,
provided they obtain permission from the property owner. Nonprofit organizations shall be limited to
three signs per event and the signs shall not exceed the number of days allowed in subsection (7)a of this
section. If event is advertised for more than 30 days it shall count toward that properties 90 day limit for
temporary sig_na~e.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 30-866 "DISTRICT REGULATIONS" OF THE CITY CODE OF
ORDINANCES

The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 30-866 titled "District Regulations of the City of Elk River Code of Ordinances
shall be amended by amending the following:
