Staff is requesting the City Council approve the extension of the current Solid Waste Management Service
Agreement with Sherburne County.
BackgroundlDiscussion
The City of Elk River entered into a waste delivery contract with Sherburne County in 2000 to deliver all
of the acceptable waste fox its residential program to the RRT facility. Sherburne County is requesting an
extension to the contract which would expire on August 31, 2008. The extension will provide for
continued waste delivery to the facility while the Counties and RRT renegotiate a contract The extension
would be for one year and would then expire on August 31, 2009. All current terms and conditions
would remain the same throughout this extension period.

AMENDMENT TO SOLID WASTE MANAGEMENT
AGREEMENT FOR COMMERCIAL HAULERS
WHEREAS, Sherburne County is contractually obligated to RRT (formally NRG, Energy) to ensure
that 300 tons per week of mixed municipal solid waste (MSW) generated within the boundaries of Easi
Sherburne County is delivered for processing to RRT's Elk River Resource Recovery Facility (Facility); and,
WHEREAS, Sherburne County is obligated under this agreement until August 31, 2009; and,
WHEREAS, Sherburne County and City of Elk River entered into a Solid Waste Management
Agreement for Commercial Haulers (Agreement) for the market delivery of MSW from the area defined as
East Sherburne County to the Facility until August 19, 2008; and,
WHEREAS, The Agreement is mutually beneficial for both commercial hauler and Sherburne County
as it establishes the commercial haulers allocated share of East Sherburne County's 300 tons of MSW per
week obligation to the Facility; and,
WHEREAS, An extension to the existing Agreements with commercial haulers would allow for the
County to maintain its existing contractual obligation to the Facility; and,
WHEREAS, The Commercial Hauler is willing to extend the Agreement until August 31, 2009 with the
understanding that all current terms and conditions of the Agreement shall remain unchanged throughout the
extension period.
NOW, THEREFORE, the parties agree as follows:
1. To extend the Solid Waste ManagementAgreement for Commercial Haulers until August 31,
2009.
2. That all current terms and conditions within said Agreement shall apply until completion of
the extension period.

RE: Amendment to Solid Waste Management Agreement for Commercial
Haulers
Attached is an amendment that would extend your current Solid Waste Management
Service Agreement until August 31st, 2009. As referenced in this amendment, the
extension is necessary to allow the County to continue fulfilling its obligation for
delivery of MSW to RRT's Elk River Resource Recovery Facility. As also referenced
in this amendment, all current terms and conditions would remain the same
throughout this extension period. As such, your current delivery of market allocated
weekly tonnages would remain the same, as will the subsidized tipping fee of $45
per ton.
