Staff supports a Planning Commission recommendation of approval of the Conditional Use Permit
request, as illustrated on drawings dated May 29, 2007, with the following conditions:
1. All comments of the Building Officials memo dated June 5, 2007 shall be addressed.
2. The development shall meet all applicable fire codes.

The applicant wishes conditional use permit approval to construct a 22 x 37 x 20 pole building being
attached to the existing plant building. The building would be used as a loading area for shipment of
product.

Overview
The subject property has been used as industrial property for a number of years, and has received
the appropriate Conditional Use Permit for concrete/ asphalt products and processing. Any
expansion to a conditional use, unless expressly approved in the original CUP, requires a new CUP.

Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
7. Will not endanger, injure or detrimentally a~ect the use and enjoyment of other propery in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the
city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding vacant property.
4. Will be served adequately by and will not adversely a~ect essential public facilities and services including
streets, police and fire p~ntection, drainage, refuse disposal, water and sewer systems, parks and schools; and

will not, in particular, create tra~zc congestion or interference avith tra~zc on adjacent and neighboring public
thoroughfares.

If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.
Analysis
It is anticipated that the proposed improvement, a relatively small building as part of a much larger
complex, will not negatively alter the transportation, noise, or other negative externalities of the
acceptable industrial use. The building addition will be consistent with the metal structures on the
property, anal will not be visible from the adjacent streets, or the property from the west.
Recommendation
Staff supports a recommendation of approval, subject to the conditions outlined above.

The site plan review committee met on Tuesday, June 5, 2007 and I would like to make the
following comments:
1. River Park-Site Plan Review changing product twe
The Fire Department has no concerns.
2. Waste Management -Conditional Use Permit for building addition
The Fire Department requests that Waste Management meet with Fire Marshal Cliff
Anderson on any International Fire Code related questions.
3. Aggregate Industries -Conditional Use Permit for building addition
The Fire Department requests that Aggregate Industries meet with Fire Marshal Cliff
Anderson on any International Fire Code related questions.
4. Elk River Utilities -Conditional Use Permit for accessory structure
The Fire Department has no concerns.
5. Conoco Station 169/Main -General Planning Permit for seasonal sales
The Fire Department has no concerns.
6. Snap Fitness -Conditional Use Permit
The Elk River Fire Department requests Snap Fitness representatives meet with Fire
Marshal Cliff Anderson to address any and all locking devices for this security card
accessed facility. Snap Fitness representatives shall also discuss additional fire
extinguisher locations as necessary and any other International Fire Code related
issues with the addition of Snap Fitness to the Landmark Plaza.
7. Variance -American National Bank sign height
The Fire Department has no concerns.

After reviewal of the submittal package for the Aggregate Industries -Conditional Use

General Information
This Conditional Use Permit (CUP) Application is for the construction of a 22' deep X 37' wide
X 20' high single slope pole building being added to the north side of the existing plant building
at the above listed address.
Intended Use -Addition
This 814 sf addition is intended to protect the pallets of block being picked up by forklift, that
were previously subject to the weather.
Employee/Traffic/Delivery Information
It is anticipated that there will be no change to traffic, as the number of employees to remain the
same, .along with the hours of operation

This addition is interior to the site as depicted on the attached aerial photo. We anticipate that

Na additional utilities will be added for the pole building.
