Staff recommends that the Planning Commission recommend approval of the Conditional Use
Permit request, as illustrated on drawings dated 5-9-2007, with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
require permits.
2. The building shall meet all applicable building codes.
3. The building shall meet all applicable fire codes.
4. Prior to opening, the site shall be inspected by the City's Building Official.
5. Each sign shall require a permit.

Overview
The applicant would like to operate a fitness center out of an existing 14,425 square foot commercial
multi-tenant space.
The fitness center would be supported by a staff of 4-6 employees. The operation will be 24 hours a
day, seven days a week. Access to the building will be with security cards in which clients will utilize
the facility at times which is convenient to them.
Access to the site will be from Freeport Avenue. There is currently only one access point into the
property, but with future development, there will be a second access point to the property. The site
and building as a whole was approved for parking layout so there is amble space for parking for this
use.
They are proposing signage at two locations, one at the front door and one on the existing
monument sign. Each sign will need a sign permit.
Applicable Regulations
The use is being classified as a Commercial Recreation Facility, which requires a Conditional Use
Permit in the C-3 zoning district.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
7. Will not endanger, injure ar detrimentally a~ect the use and enjoyment of otherpropery in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the
city.
2. Will be consistent urith the comprehensive plan.
3. Will not impede the normal and orderly development and improvement of surrounding vacant property.
4. lY>ill be served adequately by and will not adversely a~ect essential public facilities and services including
streets, police and fire protection, drainage, refuse disposal, water and server systems, parks and schools; and
will not, in particular, create traffic congestion or interference with tra~c on adjacent and neighboring public
thoroughfares.
5. Weill not involve uses, activities, processes, materzals, equipment and conditions of operation that will be
detrimental to any persons orproperty because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. i-Vill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. IVill fully comply avith all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license orpermit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.
Comprehensive Plan
The Comprehensive Plan guides this property as Highway Business which allows this type of use.

Dear Mr. Barnhart:
Attached is a Conditional Use Permit Application to allow our business,
Sndp Fitness to open and operate in the Landmark Plaza which is owned and
managed by the Briggs Companies. The proposed address of the new space
for our business is 190~~ Freeport Street N~,1/lk liver, MN ~~~3t7.
We propose to open and operate a Snap Fitness franchise at this location.
Snap p'itness is a sectiuity card accessed faci}ity available to it's n~en~bers ~24
hours per day. Snap Fitness is a Chanhassen, Minnesota based corporation
with ~t?l~+ units currently in operation .
We propose to have approximately 4-6 part time employees.
We will need one standard size sign at the front door that is consistent with
the established and approved sign theme for Snap Fitti~ss and the building,
together with one strip sign for the larger entrance monument at the front of
the building indicating Snap Fitness as one ofthe tenants.
There are currently 50 existing parking spaces. Our parking requirements
vary throughout the day: W~ have no group classes - o€~r members come in at
a time convenient for them.
The Briggs Companies assures us that all building materials and construction
technic}ues i}ce:d in cc~ns~ction and custom~na the interior space within .the
Landmark Plaza will comply with existing city codes and regulations.
We have no need for outside storage facilities.
The reason for this application is that we have been informed by the Briggs
Companies that the City of Ells River has infor_n_~ed then,. that oi.~r appli~atinn
to lease and occupy this space requires a conditional use permit.
We believe that fitness is a vital part of a healthy community. By making
access to a fi~ess fa~iliiy convenient and affordable to area residents we
believe Snap Fitness will have a positive impact within the city.
