Background/Discussion
Waste water treatment is a conditional use in the I-1 zoning district, which is where the existing waste
water treatment plant is located. Any expansion would require a conditional use permit, including those
mandated by the state or federal government.
This puts the city is a position where it cannot react to residents' concerns raised during a public hearing,
as the waste water plant (including all trunks, lift stations, etc serving the plant) represents a significant
capital investment, and relocating it is not an option.) The ordinance, if approved, would allow a
municipally-owned plant as a permitted use.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING SECTIONS 30-1292
OF THE ELK RIVER CITY CODE RELATING TO THE LIGHT INDUSTRIAL ZONING
DISTRICT.
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 30 -1292 (b) of the Elk River City Code regulating permitted
uses in the I-1 Zoning District, shall be amended to read as follows:
(b) Permitted uses. Permitted uses in the I-1 district are as follows:
(1) Offices.
(2) Warehouses.
(3) Research/design facilities.
(4) Wholesale businesses.
(5) Medical, dental, and optical labs.
(6) Light manufacturing.
f7) W'ater/sewag_e treatment, municipality owned and operated
Section 2. That Section 30 -1292 (d) of the Elk River City Code regulating conditional
uses permitted uses in the I-1 Zoning District, shall be amended to read as follows:
(d) Conditional uses. Conditional uses in the I-1 district are as follows:

Section 3. That this ordinance shall take effect upon publication as provided by law.

SUBJECT: Waconia/Elk River Farm Supply
At the January 8, 2008 Planning Commission the Planning Commission recommended
approval of the CUP request for Waconia Farm Supply to offer Budget rental trucks. The
City Council reviewed this request at their January 22, 2008 meeting, at this meeting there
were several comments and questions raised by the public. At this meeting the Council
continued this item to the February 19, 2008 meeting. At the February 4, 2008 Council
meeting the Council remanded this item back to the Planning Commission for comments on
new information the applicant provided and to give the Planning Commission an
opportunity to comment on the public testimony heard at the Council meeting.
Based on public comments the Council gave the applicant direction to address the right-of-
way issue, explore the possibility of having fewer trucks, revise the parking storage area,
provide a survey and explore the possibility of storing the trucks on the east side of the
property.
At the meeting it was unclear as to where the right-of--way was located and if the trucks
would be parked on the applicant's property. The survey is attached and indicates the
property lines. The right-of--way of Highway 10 abuts the warehouse building. The storage
garage is only a few feet from the rear property line.
The applicant would still like to be able to have up to four trucks for storage on the lot, he
does not anticipate having all four on the lot at the same time. The applicant plans to
remove the fence on the north side of the garage to allow for more storage area and has
room to store one truck on the east side. He plans to park a small truck in front of the
garage, there appears to be enough room for one small truck.
The Planning Commission should review this proposal and make comments on the new
information. This meeting is not a public hearing.
