The City must approve or deny the project by Apri127, 2007. Introduction The applicant is requesting a larger storage building than what was approved with the Conditional Use Permit (Case File CU 05-13) he received in October 2005. Location Existing Use Land Use Plan Designation Current Zoning Subject Property Commercial Commercial C3 North Commercial Commercial C3 South Commercial Commercial C3 East Commercial Commercial C3 West Residential Residential R1a Overview On August 15, 2005 the applicant received approval for a Conditional Use Permit for an outdoor patio and a 30' x 40' storage building. The 30' x 40' building was never built. It is now the desire of the applicant to construct a 40' x 56' (2,240 sq.ft.) storage building in the same location. The building will be used for general storage of equipment and restaurant supplies. The proposed location of the accessory building is in the northwest corner of the property, 10-feet off of both the north and west property lines. Staff would recommend that the building be located in a manner as to not remove any of the existing trees along the west property line. In doing this, the building will be screened from the adjacent residential uses to the west. On the residential property to the west, adjacent to the proposed building location, is a large accessory structure. The property to the north has a commercial use which has an asphalt area that will be adjacent to the proposed structure. Section 30-938 of the Ciry Ordinance states: In the C-1, C-2 and C-3 districts, the exterior building finish shall consist of at least tzvo of the exterior building finishes, per wall. The proposed building materials are prefinished metal panels with a masonry wainscoting along the south and east facades. Although these materials are approved, they are only being proposed on two sides. Given the fact that the west side of the building is going to be against a tree line, it is not critical to have the second material on the west elevation. The north side is highly visible from adjacent properties and staff would recommend that it have the same wainscoting treatment. Its size is not common to the rest of the operations on the site. Applicable Regulations Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 7. Will not endanger, injure or detrimentally affect the use and enjoyment of other propery in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral aa~elfare of the neighborhood or the city. 2. Dill be consistent avith the comprehensive plan. 3. i-Vill not impede the normal and orderly development and improvement of surrounding vacant property. 4. Will be served adequately by and urill not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, avater and server ystems, parks and schools; and will not, in particular, create tra~c congestion or interference urith tra~c on adjacent and neighboring public thoroughfares. 5. Till not involve uses, activities, processes, materials, equipment and conditions of operation that avill be detrimental to any persons or propery because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Dill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Dill fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for CUP as outlined, it appears that the request is consistent with all of these standards. Comprehensive Plan The comprehensive plan designates this area as Highway Business. Recommendation Staff recommends that the Planning Commission recommend approval of the request, as illustrated on drawings dated 2/26/2007, with the following conditions: 1. The 30' x 40' building shall meet all applicable building codes. 2. The 30' x 40' building shall be used for storage purposes only. 3.
