Recommendation

Overview
In November of 2004, the applicant was granted an Interim Use Permit fox one portable
office until September 1, 2006. In order to meet the ever growing needs of their
congregation, the applicant is continuing the design process for a building expansion due to
a shortage of office space in their existing facility. They axe requesting an Interim Use
Permit to place two additional portable offices (12x60) on the north side of their existing
building. They are also requesting an extension to their existing Interim Use Permit (for the
same type of request fora 16 x 80 classroom) for the same time frame.
Analysis
The proposed location of the two portable offices is on the north side of the existing
building and will be on site until the summer of 2010, at which time the portable structure
would be removed. The location of the portable office would not affect either traffic
circulation ox parking.
The proposed location of the offices is screened by existing vegetation and with the
exception of the home directly across from the driveway they will not be visible from
neighboring residents.

Criteria for Issuance of an Interim Use Permit
In determining whether to authorize an interim use, the planning commission and city
council shall consider the following criteria:
1) The period of time for which the interim use permit is to be granted will terminate
before any adverse impacts are felt upon adjacent properties.
2) There is adequate assurance that the property will be left in suitable condition after
the use is terminated.
3) The use is similar to uses defined in the zoning district in which the property is
located.
4) The date or event that will terminate the use can be identified with certainty.
5) Authorizing the use will not impose additional costs on the public if it is necessary
for the public to take the property in the future.
6) The applicant and user agree to all conditions that the city council deems appropriate
for authorization of the interim use.
7) The applicant provides assurances deemed adequate by the city council that the use
will terminate as provided in the interim use permit. The city council may require the
applicant to deposit a cash amount with the city, or provide some other form of
security, to ensure compliance with this criteria.
The city council must determine that the authorization of the interim use will not result in
adverse effects on the public health, safety, or welfare.
Recommendation
Staff recommends that the Planning Commission recommend approval of the request with
the following conditions:
1. The portable office shall be removed by September 1, 2010.
2. If an extension to the September 1, 2010 date is required, the applicant shall
apply for an amendment to the Interim Use Permit.
3. The total square footage of all three portable offices shall not exceed 2,750
square feet.
4. If the location of the any of the portable offices is changed, the applicant shall
apply for an amendment to the Interim Use Permit.
5. All comments from the Fire Chief shall be addressed.
G. The three classrooms shall meet all building and fire codes.

The site plan review committee met on Tuesday, Apri154, 2006 and I would like to make the following
comments:
1. Request by Bill Matthews for a Conditional Use Permit for automobile sales, located at
13342 Highway 10 Case No. CU 06-11
The Fire Department requests that Bill Matthews meet with Fire Inspector Cliff Anderson to
discuss possible building improvements to ensure that they meet the intent of the International Fire
Code.
2. Request by Kevin/Kyleen Refiners for a Conditional Use Permit to allow additional horses.

3. Request by River of Life Church for an extension to an interim use permit for a Portable

Our `Jerusalem " is the Elk River Community.
River of Life is a growing church in Elk River, MN with a regular attendance of approximately 1,000
people per Sunday and a tremendous outreach program. Many of our groups are designed to help those
who are lost, hurting or experiencing one of life's setbacks. We also strive to offer safe, fun and healthy
alternatives for students to interact with one another.
The following is a sample of some of the many programs we offer:
1. Support Groups are open to those in the community who are dealing with issues related to the following:
• Depression
• Divorce
• Grief over the loss of someone special
• Chemical Addiction
• Post Abortion
• Blended Family
2. Red Cross Blood Drives -each year we host at least 2 blood drives supported by the Red Cross
3. Transitional Housing - We spearheaded a transitional housing program to provide a home for those
making the transition from homelessness to self-sufficiency
4. Coffee Break and Beth Moore -These are two separate Bible studies available to women. They gather
to study God's word and for fellowship and support
5. For Students:
• CrossRoads & Chasers meet on Wednesday nights. On average over 250 kids attend
• Club 45 is a fun, Bible-based program for kids in grades 4 & 5
• TeamKid is a scripture-based program for kids from preschool to grade 5
• DC4K -Divorce Care for Kids is a group that meets to help kids whose families have been
affected by separation and divorce
6. Small groups, Christmas Gatherings, Valentines Day "Sweetheart Banquet"
In order to meet the ever growing needs of our congregation and the community, we have begun the
planning and design stages of our next building phase. We now have 7 full time pastors and
administrative staff to assist them. At this time we have a severe shortage of classroom space and we
are requesting an Interim Use Permit to place two 12X60 portable classrooms. We intend to place
them on the north side of our present building. We also would like to request an extension on our
current Interim Use Permit for the Portable Office located on the south side of our building. We
anticipate that our next construction phase will be completed in the Spring/Summer of 2010 and we
would request to use this office and classroom space until that time.
