• A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION AUTHORIZING STAFF TO SUBMIT AN APPLICATION FOR A
MINNESOTA DNR REGIONAL TRAIL CONNECTIONS PROGRAM GRANT
WHEREAS, the City of Elk River recognizes the importance of providing high quality
recreational resources to the community; and
WHEREAS, the City of Elk River recognizes the need to partner with other governmental
agencies in order to improve natural areas in a cost effective manner; and
NOW, THEREFORE, BE IT RESOLVED that the City of Elk Rivcr act as legal sponsor fox
the project contained in the Minnesota DNR Regional TxaIl Grant Application to be submitted on
February 28, 2008 and that the Parks and Recreation Director is hereby authorized to apply to the
Department of Natural Resources far funding of this project on behalf of the City of Elk River.
BE IT FURTHER RESOLVED that the City of Elk River has the legal authority to apply for
financial assistance, and financial capability to meet the match requirement and ensure adequate
construction, operation, maintenance, and replacement of the proposed project fox its design life.
BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Elk
River may enter into an agreement with the State of Minnesota for the above-referenced project, and
• that the City of Elk River certifies that it will comply with all applicable laws and regulations as
stated in the giant agreement uicluding dedicating the park property fox outdoor recreation uses into
perpetuity.
NOW, THEREFORE BE IT RESOLVED the Parks and Recreation Director is hereby
authorized to execute such agreements as axe necessary to implement the project on behalf of the
applicant.
The above resolution was adopted by the City Council of Elk River this 19`h day of February 2008.
