Adopt resolution for a six month flag lot moratorium.
Background/Discussion
At the March 10, 2008 Council Workshop, staff presented information regarding flag lots which included
definitions and requested direction from the Council on an ordinance. Council directed staff to prepare
an ordinance for review prohibiting flag lots. At the same time, Council implemented a moratorium on
flag lots for six months.
A resolution formally establishing the moratorium is attached.

RESOLUTION 08-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELg RIVER
A RESOLUTION ESTABLISHING AN INTERIM ORDINANCE (MORATORIUM) ON THE
APPROVAL OF FLAG LOT SUBDIVISIONS FOR SIX MONTHS FROM THE DATE OF THIS
RESOLUTION.
WHEREAS, State Statutes, Section 462.355 Subd. 4 authorizes a City to enact an interim ordinance for
the purpose of considering the adoption or amendment of official controls as defined in
Chapter 462; and
WHEREAS, The Elk River City Council (City CouncIl) finds that flag lots are not adequately addressed by
the City's current official controls; and
WHEREAS, The City Council fords that there is the possibility of additional requests fox flag lots; and
WHEREAS, The City Council fords that the city's current official controls need to be updated to define
and adequately address flag lots and other new developments with respect lot requirements;
and
WHEREAS, The City Council desires to review and make necessary changes to the City's Official
Controls to ensure that the health, safety, and general welfare of the residents and visitors of
Elk River are preserved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. A Moratorium is hereby established, prohibiting the approval of flag lot subdivisions, defined as a lot
so shaped and designed that the main building area is setback from the street on which it fronts and
includes an access strip connection to the main building site with the frontage street.
2. The City Council directs the Community Development Department and the Planning Commission
to complete an analysis of issues associated with flag lots and develop an advisory recommendation
for the City Council to consider regarding potential City Ordinance amendments.
