The applicant is requesting approval of a Lot Split to create two lots. The result will be a recorded plat.
Staff recommends that the City Council approve the Lot Split request, as illustrated on drawings dated
Received January 27, 2008, with the following conditions:
1. All comments of the Environmental Technician memo dated March 4, 2008 shall be
addressed.
2. Drainage and utility easements shall be added to the plat, l0 feet wide along Edison
Street and 154'" Avenue and 5 feet on the interior property line and rear property
lines.
3. Park dedication shall be provided in the following manner. In the form of cash for
one lot at the rate applicable at the time of Final Plat approval (2008 rate $3,465.00)
4. All required subdivision/park information shall be provided in an electronic format
(.dwg file) as required by the City Ordinance and Land Use Application prior to
recording of the plat.
5. Any item or condition found that indicates the site is likely to yield information
important to prehistory of history shall be reported to the City immediately. Further,
the City reserves the right to stop work authorized in its approval until the site is
appropriately investigated and work is authorized to continue by the City.
Background/Discussion
The applicant received a variance on June 18, 2007 to the lot size requirements in the R1a district for his
property located at 9927 - 154"' Avenue. In the Rla zoning district the minimum lot size is 2.5 acres; the
applicant received approval to create two lots, one lot at 2.5 acres and the other lot 2.19 acres. One
condition of the variance was to formally split the lot.

Overview/Analysis
The applicant is fulfilling the requirements of a variance granted fox their property at 9927 - 154'
Avenue with this request. The variance allows them to create two lots, with one lot under the 2.5
acre minimum lot size requirements.
Parcel A will be 108,906 square feet, 2.5 acres and parcel B will be 93,975 square feet, 2.15 acres.
The description shown on the plan will have to be changed to reflect the correct lot sizes. A plat is
also required for recording. Drainage and utility easements should be shown on the plat.
A new lot is being created therefore; park dedication fox one lot is to be collected at the time of final
plat recording. The 2008 fee is $3,465.00.

These findings ate necessary for the city council approval of the preliminary plat and the final plat:
(1) The proposed subdivision is consistent with the Zoning regulations (article VI of this chapter) and
canfornss in all respects wlth all requirements of this Code, including the toning regulations and thls article.
(2) The proposed subdivision is consistent with all applicable general and speeiadiZed city, county, and
regionalplans, including, but not limited to, the city's comprehensive developmentplan.

(3) The physical characteristics of the site, including but not limited to topography, soils, vegetation,
susceptibility to erosaon and siltation, susceptibility to flooding, and drainage are suitable for the type and
density of development and uses contemplated.
(4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage
transportation, erosion control and all other services, facilities and improvements otherwise required in this
anicde.
(S) The proposed subdivision will not cause substantial environmental damage.
(6) The proposed subdivision will not conflict with easements of record or with easements established by
judgment of a court.
(7) The proposed subdivision will not have an undue and adverse impact on the reasanab/e development of
neighboring land.
(8J The proposed subdivision is not premature. A subdivision is premature if any of the following exists:
a. Lack of adequate stormwater drainage.
b. heck of adequate roods.
c. Lack of adequate sanitary sewer ystems.
d. Deck of adequate off-site public improvements or support systems.
In the review of the standards for Final Plat as outlined, it appears that the request is consistent with
all of these standards.

SUBJECT: Concerns regarding the Site Plan Review for:
Lot Split -Kevin Anderson LS08-Ol
During review of the plans fox the item listed above (Lot split fox Kevin Anderson), one
item of concern was noted for the site. The following concern was identified:
• The City's Archaeological Model indicates a high potential fox an archaeological site
in both project areas. No known SHPO (State Historic Preservation Office) site is
located on the property. Staff recommends that the standard condition listed below
is placed upon the request:
"Any item ox condition found that indicates the site is likely to yield information
important to prehistory or history shall be reported to the City immediately. Further,
the City reserves the right to stop work authorized in its approval until the site is
appropriately investigated and work is authorized to continue by the City."
