Location The property is located on the south side of 193rd Avenue west of Zane Street. Zoning/Land Use PUD (Planned Unit Development) / MR (Medium Density Residential) Attachments Location map Memo from the City Engineer · Preliminary plat Woods at Hillside · Final plat Overview The applicant is requesting final plat approval for Woods at Hillside Third Addition. The preliminary plat for the Woods at Hillside, approved on April 19, 1999, consisted of 61 single family lots on 43 acres. The final plat for the Woods at Hillside 1~ Addition included Memo to Mayor & City Council/P 02-16 July 15, 2002 Page 2 15 single family lots and the final plat for the Woods at Hillside 2na Addition included 15 single family lots. The final plat for the Woods at Hillside Third Addition includes 16 single family lots. One of the 16 lots was originally platted as part of Woods at Hillside 2na Addition and is being replatted as part of this plat. Layout Lots Sixteen lots will be platted as part of Woods at Hillside Third Addition. The lots are consistent with what was approved on the preliminary plat. There are five outlots proposed as part of this final plat. Outlots A, C and D are center medians in 193ra Avenue, Outlots B is a center island in the "eye-brow" cul de sac on 193ra Avenue and Outlot E is the center island in 192n~ Court. Streets Three streets are proposed as parr of this final plat, 19Ya Avenue, Vance Street and 192~a Court. The streets are consistent with the approved preliminary plat. The island in 192na Court does not meet the current design guidelines for cul de sac islands; the turning radius is not wide enough. However, it was designed and received preliminary approval prior to the recent change in the design guidelines and complied with the design guidelines in place at that time. Grading, Drainage and Utilities Grading, drainage and utility issues are addressed in the City Engineer's memo. Landscaping Landscaping will have to be provided per the City Ordinance, which is two trees per lot and four trees on corner lots. Park and Recreation The Park and Recreation Commission recommended cash to meet the park dedication requirements. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. e THE DEVELOPER SHALL ENTER INTO A DEVELOPER'S AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE DEVELOPMENT. 3. THAT THE MAILBOXES SHALL BE CLUSTERED. 4. A SEALCOAT FEE IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. AN ENGINEERING ESCROW IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 6. PARK DEDICATION FEES FOR 16 LOTS AT THE CURRENT RATE BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. STORM WATER MANAGEMENT FEES IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. WATER ACCESSIBILITY FEES IN THE AMOUNT DETERMINED BY THE CITY BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 9. THE DEVELOPER SHALL PROVIDE AT LETTER OF CREDIT FOR 100% OF THE COST OF THE IMPROVEMENTS. 10. A WARRANTY BOND SHALL BE PROVIDED AFTER THE IMPROVEMENTS ARE ACCEPTED BY THE CITY AND SHALL BE HELD FOR ONE YEAR. Based on our review, we would offer the following comments: The plat includes the replat of Lot 4, Block 3, The Woods at Hillside Second Addition. This lot is included because a wetland was found'to be existing on Lot 4, Block 3, which made the lot essentially unbuildable. Therefore, it is being replatted with the third addition to be slightly larger so that there is a buildable location. We would recommend that the existing drainage and utility easements around Lot 4 be vacated as necessary and replatted with the third addition. o o There are various outlots throughout the plat for the median along 193rd Avenue and the islands in the cul-de-sacs. All of these outlots should be covered by drainage and utility easements so that utilities can freely cross under them. The islands in the "eyebrow" cul-de-sac along 193rd Avenue and in 192"d Court do not meet the new City standard for design of a cul-de-sac island. However, they do meet the same standards that were used for the cul-de-sac islands in the first and second additions. The right-of-way east of Vance Street on 193rd Avenue is proposed to be used for ponding on an interim basis. The concept from the original The Woods at Hillside Development Plan was to use this area for ponding and to eventually move the pond further to the east as 193rd Avenue is extended to Tyler Street. It would be appropriate with this plat to formalize the agreement with the Developer whereby he would escrow sufficient funds to eventually fill in the pond and extend the sewer, water, storm sewer, and street to the east plat boundary. SiC'Oil M,,O0,00,ON L I d Z <~ 13_ 0 0 RESOLUTION NO. 02 - CITY OF ELK RIVER A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR: Woods at Hillside Third Addition Case No. P 02-16 WHEREAS, application has been made for final plat approval, pursuant to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Council; and WHEREAS, a preliminary plat of the Property was approved by the City Council on April 19, 1999; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, as follows: It is hereby determined by the City Council for the City of Elk River as follows: The proposed subdivision is consistent with the Zoning Ordinance and conforms with all of its requirements. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Development Plan. Co The physical characteristics of the site, including , but not limited to, topography, soils, vegetation, susceptibility to erosion and = siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. Do The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. The proposed subdivision will not cause substantial environmental damage. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time.
