Fees for services are reviewed by staff and council on an annual basis to ensure that fees charged cover the services that are provided by the city. The attached fee schedule shows the proposed changes to the fee schedule. There are several fees that are still under consideration by the perspective review committees. These fees are marked with asterisks and will hopefully be ready to be presented to the council on November 18th. Those fees highlighted in yellow are fees that the City has been charging in the past, but they have not been included in the fee resolution. Staff is attempting to make the resolution inclusive of all city fees. The fees that are in red and underlined are new fees, and those that are marked with a line through them are proposed to be deleted. EXHIBIT A CITY OF ELK RIVER FUEL-GAS PIPING PERMIT FEES The Chief Building Inspector, before issuing any permit for the installation of any fuel- gas piping, shall require the payment by the applicant for such permit of fees in the amount herein provided. Minimum Fee In no case shall the fee charged for any permit issued by the Chief Building Inspector be less than Forty-five Dollars ($45.00). Basic Fees (A) The fees for all fuel-gas piping permits shall be computed on the basis of the number of fuel-gas appliances. The fee for each appliance so provided for shall, except as hereinafter otherwise specifically provided, be Six Dollars ($6.00) for each fuel-gas appliance. (B) Where any such permit is issued for roughing-in of fuel-gas lines for future appliances, a fee of Six Dollars ($6.00) shall be charged for each line or lines. (c) In addition to the Six Dollar ($6.00) charge for each fuel-gas appliance and future fuel- gas lines mn for appliance, a Six Dollar ($6.00) charge for the main fuel-gas supply in the building shall be charged. Lions Park Center Policy and Application for Facility Use City of l13, e r Email: II 04 Lions Park Drive Elk River, MN 55330 Phone: 763.441.2949 Fax: 763.274. 1842 recreation@ci.elk-river, mn.us City of Elk River Policy and Application for Use of Lions Park Center The Elk River Lions Park Center, located at 1104 Lions Park Drive is operated by the City of Elk River. Lions Park Center has a large banquet/meeting room, with adjacent kitchen facilities, outside staged bandshell and an outside picnic shelter, which may be scheduled for use by community residents, civic groups, non-profit organizations and non-residents. AREAS OF USE Meeting Room/Kitchen Facility: The meeting room with adjacent kitchen facilities can provide seating for up to 170 people. A variety of tables and layouts of the space are possible, for suggestions see page 4. Outside Picnic Shelter: The outside picnic shelter provides room for eight picnic tables and is connected to the Center with access to restroom facilities and a serving area. The catering kitchen may also be accessed by users of the Picnic Shelter. Outside Staged Band Shelter: The bandshell has permanent seating for 200. Electricity (110) is available for sound equipment. This facility is quite popular for concerts. HOURS OF USE Lions Park Center office hours: Monday through Friday, 8:00 a.m. to 4:30 p.m. Lions Park hours: Monday through Sunday, 6:00 a.m. to 10:00 p.m. The Lions Park Center is closed on City holidays, except for contract use or previously scheduled events. The park itself is open 365 days per year. The Lions Park Center will close no later than 1:00 a.m. on Friday and Saturday and 11:00 p.m. Sunday through Thursday for any and all functions. 4. Access is limited to the period of time reserved. HOW TO RESERVE THE FACILITY Obtain a Facility Use Application from the City Recreation Department, 1104 Lions Park Drive. The phone number is 763/441-2949. Applications may also be obtained on the City Recreation site at http://www, ci.elk-river.mn.us/. Submit the application, reservation fee, and deposit to the City Recreation Department a minimum of fourteen (14) business days prior to your requested date of use. Also required to be submitted by resident and non-resident users is a copy of the applicant's certificate of insurance. If the event is to be catered, the caterer's certificate of insurance and liquor license must also be submitted at the time of application. Application and all corresponding fees and paperwork must be completed by the user. 3. Upon receipt of the items listed in #2 above, the Recreation Department will complete the following: a. Verify that the facility is available for use on the requested date b. Arrange for required building supervision, custodial or police staff for the event if needed Residents of the City of Elk River may make reservations up to eighteen (18) months in advance. Non-residents of Elk River may make reservations up to six (6) months in advance. 5. Residents may not reserve the facilities for a non-resident. An application will be denied if the Lions Park Center has been previously reserved or if the requested use is for an activity contrary to City Ordinance. The City reserves the right to deny or cancel a permit if the regulations are violated. Applications may not be assigned, transferred or sub-let to anyone other than the person/organization making the application. The City reserves the right to cancel an application at any time. In these circumstances, the City assumes NO responsibility for any disruption cancellation may cause. The City will attempt to notify the applicant immediately if cancellation is necessary. GENERAL RULES The user of the Lions Park Center and surrounding grounds agrees to follow these roles: 1. Supervise the conduct of the members of their group. Disorderly conduct of partidpants is prohibited. 2. Use only spaces approved for use. 3. Leave spaces used in a clean, orderly fashion, including replacing items removed. 4. Trash shah be placed in designated containers. 5. All activities to conclude at the dosing time stated on the permit. 6. Comply with all City ordinances, Minnesota State Statutes, Federal laws and the established rules for use, which apply to authorized use of the Lions Park Center. Use of candles or any open flame is prohibited unless approved in writing. The permit holder shall assume full responsibility for any unlawful act committed in the exercise of the permit. All persons and any equipment associated with the rental must be out of the Lions Park at the end of the rental time. No items are to be left overnight. 10. Ail bands and audio equipment must stop playing at 12:00 a.m. if inside the building. Outside bands and audio equipment must stop playing at 11:00 p.m. Violation of these rules may result in forfeiture of all deposit money, the termination of the event, and the loss of opportunity to use the facility in the future. 11. ALCOHOL 2o 4° An Elk River police officer must be present if alcohol served from the time alcohol is served until the end of the event. This will require an additional fee based on a minimum of three (3) hours at $50 per hour. The Facilities Coordinator may waive the presence of the officer for certain portions of the rental period. In the event a caterer is hired to manage the serving of alcohol, the caterer must show proof of having a caterer's permit issued by the Commissioner of Public Health and Safety. The caterer shall notify the Police Chief and the City Clerk of the event. The caterer may sell beer/wine as an incidental part of food service that serves prepared meals. Service and consumption of alcohol is allowed only in the Meeting Room. Alcohol can only be dispensed to persons twenty- one years of age or older that are attending the event for which the beverage is being served. No compensation may be exchanged for alcohol unless a caterer is hired according to the stipulations as listed in #2 or unless a temporary liquor license is acquired by a club or charitable, religious, or other non profit organization that has been in existence for at least three (3) years. This includes donations, advance sale tickets and tips. No alcohol may be served after 12:00 midnight on Friday and Saturday evenings or after 10:30 p.m. on other nights. The applicant, the caterer, and all parties consuming alcohol must conform to all city and state liquor laws. Applicant must provide a copy of Certificate of Liability Insurance (including host liquor liability) when alcohol is served with total liability for all damages of $1,000,000 per occurrence. In the event a caterer is not hired, a copy of the applicant's homeowner's insurance will be required, showing $1,000,000 of liability coverage. Violation of these rules may result in the denial of future permits for use of the Lions Park Center. Denial of use does not exempt violators from possible civil or criminal prosecution under applicable City Ordinances, State or Federal laws. SMOKING The Lions Park Center is a smoke-free building. Smoking is allowed outside the building in designated smoking areas only. Cigarette butts are to be disposed of in the receptacles provided. Clean up of cigarette butts is required in order to receive full refund of deposit. SUPERVISON The group, individual or organization using Lions Park Center must provide competent adult supervision for the entire time participants are in the building or on the surrounding grounds. LIABILITY AND INDEPlNIFICATION The group, individual or organization using any or all of the facilities at Lions Park shall agree to compensate the City of Elk River for all damages to facilities, equipment or other property owned by the City, to compensate an employee for damage to personal property by any persons(s) attending the event, and further assumes ali liability for any personal injuries, including death caused by partidpants in the scheduled event. The permit holder will be responsible for rdmbursement of damages, including those in excess of the deposit. Permit holder shall be wholly and solely l/able and responsible for any and all acts of every kind and nature of any member, agent, employee or guest of permit holder. Permit holder further agrees to indemnify the City and defend and hold it harmless from any and all damages, claims for damages and claims of each and every nature which might arise out of the use of the Premises during the term hereof occasioned by the act or acts of any of permit holder's members, agents, employees or guests on the Premises. IN NO EVENT SHALL THE CITY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER CONSEQUENTIAL DAMAGES WHETHER OR NOT FORESEEABLE (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR THE LOSS OF GOODWILL OR PROFITS) ARISING OUT OF OR IN RELATION TO THIS AGREEMENT EVEN IF ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH LIABILITY. ROOM SET-UP AND DECORATION 1. Room set-up will be done the day of the event by the applicant. Decorations may be put up by the user and must be removed upon completion of the event. Installation of decorations may not inconvenience any other group and must be done within the period of time reserved. Items may not be attached to the walls or ceiling. 3. Paper/metallic confetti or rice shall not be used in the building or on the grounds. USERS AND FEES An Elk River organization is one with its primary physical location being within the City's boundaries. For entities without set physical locations, an organization will be considered an Elk River Organization if it certifies that at least 60% of its membership is comprised of Elk River residents (subject to potential confirmation). The exempt purposes set forth in 501 (c)(3) are charitable, religious, educational, scientific, literary, testing for public safety, fostering national or international amateur sports competition, and the prevention of cruelty to children or animals. The usage may not be for prayer or other worship purposes. Elk River service organizations are identified as Rotary, Kiwanis, Masons, Knights of Columbus, Jaycees, American Legion and Auxiliary, VFW and Auxiliary, Lioness, and the Eagles and Auxiliary. Deposits are to be provided by money order, cashier's check or credit card for amounts over $100. A random fee survey was conducted by staff to find out what other cities were charging for liquor and tobacco licenses. The survey is attached. The reason for some of the high liquor fees is due to the fee structure being set by the size of the establishment or percentage of food sales. Those cities would probably have Liquor Fee Increase Memo October 28, 2002 Page 2 enough staff to provide inspections and monitoring of the required criteria set for the liquor license (i.e. percentage of food, size of establishment). State law requires that license fees cover the costs of issuing, inspecting, and other directly related costs of enforcement. The following comments have been provided by the Chief of Police and Assistant Police Chief regarding liquor enforcement. "The liquor industry in general creates a very heavy call load for us in the evening and early morning hours. Calls of possible intoxicated drivers, fights in lots, person trying to get in with bad ID's - all of these eat up our manpower allotments and time. If we make an arrest that takes up time, not only for the initial report but follow-up, reports and then of course prosecution costs, court time (usually overtime) and maintaining files and reporting to the state. Add to that increased patrols due to nature of calls and past reports and it really starts to build in a hurry. Finally, add compliance checks and over-time costs to insure that each business is within the legal limits provided by statute and ordinance." It seems that there is an increased demand on law enforcement resulting from the liquor licenses in the City. Elk River currently has 9 on-sale liquor establishments, with a potential to increase this to 18. The State law requires that that liquor related fee increases require a hearing by the council with a notice of the hearing to be sent to all affected licensees. This notice has been sent to all liquor license holders. Staff has made recommendations regarding the liquor and tobacco fee increases. These are only recommendations and can be decreased or increased as the council deems appropriate. Mayor Klinzing opened the public hearing. Tom Bakritges, representing D.R. Horton reviewed the issues in his letter to the Mayor and City Council on June 4, 2002. He noted that D.R. Horton would prefer that escrow be done through the City and not a title company, bank, or other financial institution as it would hold up closings and financial and rifle company processes and could be a hindrance to future homeowners. He stated that he would prefer to see the escrow at the time of building permit issuance. There being no further comments, Mayor Klinzing closed the public hearing. Liquor and Tobacco Fees The City Clerk indicated that the Council previously requested Staff to research the city's existing liquor and tobacco fees to see if expenses are being recovered. The City Clerk indicated that she compiled information in a survey from other ciries regarding tobacco and liquor fees. The City Clerk noted that of those surveyed, the approximate average charged for tobacco licenses is $160 compared to Elk River's fee of $100. She noted that based on the cost of enforcement and administration, the fees could be increased in the City of Elk River. The City Clerk noted that according to the survey, Elk River's liquor fees are also quite a bit lower than the average. She indicated that the on-sale liquor fees have not been increased for at least 20 years. She also noted that after reviewing the police reports, it is evident that there is an increase in demand on law enforcement due to liquor licenses. The Clerk indicated that if the Council wants to consider increasing the license fees, it would be best to coordinate the increase with the resolution considering the fee schedule at the end of the year so that new license fees are in place at the beginning of 2003. She also noted that City Council Minutes Page 5 June 10, 2002 liquor fee increases require a public hearing and notification of the hearing to all liquor licensees. The Clerk also noted that State Statute indicates that on-sale liquor fees are intended to cover the costs of issuing, inspecting and other directly related costs of enforcement. It was the consensus of the Council that liquor fees and tobacco fees should be increased to meet the City's cost of enforcement. The Council authorized the City Clerk to have further research the cost of police enforcement related to liquor licenses. 5.4A. Renewal of Liquor Licenses The City Clerk presented the list of liquor licenses for approval. She noted that all liquor fees have paid, and all licensing requirements have been met. Consider Amendment to Animal Ordinance Relating to Kennels The City Clerk indicated that staff is requesting an amendment to Section 502 of the City Code pertaining to animals. She indicated that the amendment is necessary due to confusion in interpreting the ordinance. The existing ordinance indicates that a person can have 3 dogs or cats before a kennel license is required. The Clerk noted that the question always arises as to whether this means 3 dogs and 3 cats or a total of 3 animals. She noted that the proposed ordinance reflects that a kennel license is required for anything over 3 animals. Discussion was held regarding the total number of 3 animals. The Council requested Staff to rewrite the ordinance using language that allows up to 4 animals, but no more than three dogs. 5.6. Consider Amendment to Billiard Hall Ordinance Council recently directed staff to revise the existing Billiard Hall Ordinance to allow the Council flexibility to extend the hours of operation beyond the 1:00 a.m. requirement through a conditional use permit. The meeting will be held at the City Council Chambers located at 13065 Orono Parkway, Elk River, MN at 6:00 p.m. According to the City's Ordinance the City must notify liquor license holders of a proposed fee increase. The current liquor license fees are as follows: On-Sale Liquor - $4,000 On-Sale Wine - $650 3.2 Beer On-Sale - $225 3.2 Beer Off-Sale - $75 The Council will receive public input during consideration of this issue.
