Zoning/Land Use Rla (Single Family Residential) and I1 (Light Industrial) / CC (Community Commercial) and MR (Medium Density Residential) Attachments · Location map · Development plans · Townhouse elevations Memo to Mayor and City Council/P 01-05 November 18, 2002 Page 2 · EAW · Memo from the City Engineer * Ordinance No. 02- Overview Project Description The proposal includes approximately 70 acres on the east side of Twin Lakes Road, northeast of the Burlington Northern Railroad tracks at 171st Avenue. The property is adjacent to the proposed commuter rail station, which is to be located on the west side of Twin Lakes Road. The project is a mixed use development that includes townhomes, apartments, a commercial/office component and senior housing. Of the 70 total acres, 49 will be included in the townhouse portion of the project. The applicant is requesting a zone change to PUD, conditional use permit for the PUD and preliminary plat approval for the entire project. The developer will be moving forward into final plat approval for just the townhouse portion of the project. The remainder of the site will be platted as outlots in the final plat. Background Information In August of 2001 the City Council approved a land use plan amendment to include this property in the Urban Service Area and to change the land use designation to CC (Community Commercial) and MR (Medium Density Residential). At that meeting the Council postponed action on the zone change, preliminary plat and conditional use permit. The main issue that the City and the developer were struggling over was project generated traffic impacts. Because of the number of trips the project was going to generate, a second full access would be required. The City would not allow a second full access at the location proposed by the developer. The project has since been changed to address the issue of project generated traffic. Zone Change The developer is requesting a zone change from Light Industrial and Single Family Residential to Planned Unit Development. Most of the property is currently zoned Rla (Single Family Residential- 2 ~ acre minimum lot size). An area extending about 300 feet from and parallel to the railroad tracks is zoned Light Industrial. When considering the proposed zone change to PUD, the Council should look at the compatibility with adjacent zoning and land uses. The property to the south and east is zoned AR (Agricultural Research). It is owned by Cargill and is farmed as part of their research facility. The property to the north is zoned Rla (Single Family Residential) and is large lot single family residential. There is a large wetland that separates the residences from this project. To the west is Twin Lakes Road and the Mn/DOT park and ride facility. The mix of uses includes a commercial/office component, senior housing with a daycare center, an apartment building and townhouses. Environmental Review The applicant has submitted an EAW for this project that has been reviewed by the City. Staff has reviewed the initial draft of the EAW, determined it was complete and accepted it for distribution. A copy of the EAW is included in your packet. The Council will be asked to make a negative declaration on the need for an EIS. Conditional Use Permit and Preliminary Plat Proposed Uses The project includes a mix of commercial/office space, senior housing, apartments and townhouses. Apartments The project includes 60 apartments that overlook the large wetland in one 4-story building. There will be underground parking as well as a surface parking lot. The apartments will be a mix of 1, 2 and 3 bedroom units. Building elevations The design of the building includes a stepped down design at the ends of the buildings. The architectural character of the apartments reflects a railroad theme and incorporates components of the craftsman design style. The building is also "bent" so it will not provide the appearance of an extremely long fasade. Parking Parking will be provided at 2.25 spaces per unit (a total of 135 spaces). Underground parking will be provided at a ratio one space for each unit. There will also be 75 surface parking spaces. The parking requirements found in the zoning code for apartments are 2.5 spaces per unit (150 spaces required). The plan is 15 spaces short of the required number of parking spaces. Commercial/Office A mix of office and commercial space is being proposed along the east and west sides of Twin Lakes Road. · West side of Twin Lakes Road S:\PLANNING\Case Files\P 01-05 Elk River Station\ 11-18cc.doc Memo to Mayor and City Council/P 01-05 November 18, 2002 Page 4 A 12,000 square foot retail/office building, a 5,000 square foot retail/restaurant building and a 5,000 square foot convenience store are proposed. All the buildings will be 1-story buildings. Building elevations Specific building elevations are not being proposed at this time. The building designs will have to be compatible with the design standards that will be approved as part of this PUD. The design of the buildings will be evaluated as part of the review of the conditional use permit for each building. Access and Parking Access to the west side commercial area will include a right in/right out access from Twin Lakes Road and two full access drives from the shared driveway with MNDOT's park and ride facility. A right in only is also proposed near the main entrance from Twin Lakes Road. This should be configured so that it could not be used as an exit. A central parking area is proposed. The number of parking spaces required for this commercial area is 110 spaces (25 for the convenience store, 25 for the retail/rest, building and 60 for the retail/office building). The site plan shows 108 spaces, two spaces short of the required number of spaces. · East side of Twin Lakes Road Two 11,000 square foot office/retail buildings and a 15,000 square foot office building are proposed. All three buildings will be 1-story buildings. Building elevations Specific building elevations are not being proposed at this time. The building designs will have to be compatible with the design standards that will be approved as part of this PUD. The design of the buildings will be evaluated as part of the review of the conditional use permit for each building. Access and Parking No direct access from Twin Lakes Road is proposed. Access will either from Street A or Street B. The number of parking spaces required for the two office/retail buildings is 110. There are 88 spaces proposed, 22 spaces short. The number of spaces required for the single office/retail building is 75. There are 77 spaces proposed, two spaces more than the required number of spaces. Senior Housing/Daycare A senior housing component is also proposed. The senior housing consists of 70 condo units. Underground parking is proposed as a component of the senior housing complex. Parking and access Surface parking spaces will be provided along with 70 underground spaces. The parking requirement for senior housing is one space per unit plus one space for each employee. The parking requirement for a daycare is 1 space for every 12 children and 1 space for each employee. There are 95 parking spaces proposed for the senior housing and 12 spaces proposed for the daycare. Building elevations As with the commercial buildings, the design of the senior housing building and the daycare will have to be consistent with the approved design standards and will be evaluated when the applicant applies for a conditional use permit for the use. Townhouses There are 298 townhouses proposed. The townhomes will be a mix of row style homes and back-to-back style homes. Townhouse elevations are included in the packet. The density of the townhouse portion is about 9.4 units/net acre (298 units/31.51 acres). Layout The townhouses are a mix of row style homes and back-to-back homes. The row style "Georgetown" homes are located along the wetland and on the south side of Street B, opposite the proposed senior housing. These units will be setback 25 feet from the public street tight-of-way and 22 feet from the private drives. The back-to-back "Carriage" units are located in the center of the project and in the southeast and east sections. These units have similar setbacks as the row style homes. Building Elevations Included in the packet are proposed townhouse elevations. Breaks in rooflines and facades are provided in both styles of townhomes. A mix of colors should be provided on each building. Two different options of end unit elevations are proposed for the row style "Georgetown" units. The double peak end units will be located on the high visibility end units and the other end units will consist of the single peak/lower level brick elevations. The exterior building materials consist of a mix of brick and vinyl siding. When compared to the building materials requirements in the R3 (Townhouse) District, the proposed building elevations do not comply with the following requirements: The code requires that 25% of all building elevations shall have an exterior finish of brick, stucco and/or natural or artificial stone. More than 75% of all building elevations are vinyl. Each elevation of the townhouses have more than 75% vinyl siding. · Except for brick, stucco, and/or natural or artificial stone no townhome shall have more than 60% of all building facades of one type of exterior finish. More than 60% of all the building facades are vinyl. Parking Four off street parking spaces will be provided for each unit. Each unit will have a two car garage and there will be room for two cars in the driveway. On street parking will be allowed on one side of the public streets. Parking on the private streets will be restricted, depending on the street width, to allow for emergency access. Traffic and Streets The project includes a mix of public streets and private drives. The public streets include the main loop road through the project and two connecting streets on the east and west sides of the central drainage pond. Most of the townhouses are serviced by private drives. Four townhouse buildings have driveways with direct access to public streets. Street right-of-way is platted to the east boundary of the plat to provide for future road connection to the east. The private drives, with the exception of the drives servicing the five quad buildings at the east end of the project, will include curb and gutter. In order to provide a more residential feel, no curb and gutter are proposed for five quad buildings at the east end of the project. Pedestrian Access Sidewalks are proposed from Twin Lakes Road around both sides of Streets A and B. There are also sidewalks proposed around the drainage pond in the center of the project. Grading, Drainage and Utilities Grading, drainage and utility issues are outlined in the City Engineer's memo. Park and Recreation The Park and Recreation Commission recommended cash dedication based on a per unit basis for the townhouses, senior cooperative and the apartments, and a per acre rate for the commercial/office portion of the project. They also requested a 30' easement for pedestrian purposes parallel to the railroad right-of-way in the southwest corner of the site. Design Standards Attached are the design standards proposed by the developer. These standards will be incorporated into the PUD Agreement and will be used to guide future development in this PUD. The signage standards are similar to those in the Elk River Crossing PUD. The lighting standards include lighting to reflect the neighborhood scale and pedestrian atmosphere that the developer is trying to create. General parking lot lighting in the commercial area will be limited to 30 feet high. Additional language regarding the style of architecture and character of the development should be included. For instance, the commercial/office buildings should appear as though they are multiple smaller buildings, similar to those downtown on Jackson Street, instead of one large building. It is important that the Council is comfortable with the design standards as they will establish the character of this development. Landscaping The applicant has submitted a preliminary landscape plan for the townhouse portion of the project. The applicant will be working with staff on a final plan. A preliminary landscape plan for the remainder of the project has not been submitted. Planning Commission Meeting At the Planning Commission meeting held on October 21't no one spoke at the public hearing. The Commission discussed the need to make this a pedestrian friendly project. They felt that pedestrians should be directed to cross Twin Lakes Road at the intersection with Street B and not mid block at the two office buildings, and they wanted the pedestrian crossing to be inviting. They also felt that some method of traffic calming should be incorporated into the layout. The Commission also thought that the townhouses should at a minimum comply with the exterior material standards of the R3 (Townhouse) zoning district. The Commission wanted the area adjacent to the wetland to be kept in a natural state. Recommendation The Planning Commission recommended that the City Council approve the following: Zone Change to (PUD) Planned Unit Development based on the following findings: 1. Approval of the zoning request will not have adverse impacts on adjacent uses. 2. The zoning request is consistent with the land use designation of the Comprehensive Plan. 3. The property is within the urban service area and will be serviced by municipal sewer and water. The property is adjacent to Twin Lakes Road and the MNDoT park and ride facility that will meet the transportation needs of the commercial and residential uses. Final approval of each component of the PUD will require a conditional use permit. 1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. 2. A LANDSCAPE PLAN BE SUBMITTED FOR STAFF REVIEW AND APPROVAL. 3. A TREE PRESERVATION PLAN BE APPROVED PRIOR TO RELEASING THE PLAT FOR RECORDING. 4. ANY TREES OFF SITE OR ON SITE, NEAR THE LIMIT OF GRADING THAT ARE TO BE PRESERVED, SHALL BE FENCED WITH A SNOW FENCE AT THE DRIP LINE TO PREVENT GRADING, COMPACTION, OR STORAGE OF EQUIPMENT, DEBRIS OR MATERIALS. STAFF SHALL INSPECT FENCING PRIOR TO CLEARING OR GRADING COMMENCING. 5. THE TOWNHOUSE ELEVATIONS SHALL COMPLY WITH THE R-3 ZONING DISTRICT SECTION 9.E. II. 1-4. 6. Preliminary Plat with the following conditions: A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS PRIOR TO RELEASING THE PLAT FOR RECORDING. A PLANNED UNIT DEVELOPMENT AGREEMENT BE PREPARED AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. The two most recent sheets submitted were a Preliminary Site Plan/PUD dated August 26, 2002, and a Concept for the Commercial Property, which had no date. These submittals were all prepared by Westwood Professional Services for Centex Homes. As you are aware, Centex Homes is planning to develop approximately 298 townhomes on about 50 acres of the site. This would encompass all of the residential development; the remaining commercial development would be done at a future date by a different developer. 1. Public roadways will service most of the development. The majority of the public roadways are shown to be 28 feet in width, face of curb to face of curb, within a 50-foot right-of-way. At the staff review meeting, Cliff Anderson from the fire department expressed concern regarding the 28-foot wide roadways. It is the fire department's opinion that with parking on one side of the 28-foot wide roadway, there is insufficient room remaining to preserve the 20-foot width for emergency vehicle access. However, according to MnDOT design criteria for Iow-volume roads, which these roads would be considered, a parking lane width is eight feet wide. Thus, the remaining width would allow for a 20-foot wide emergency vehicle access. We have received drainage calculations dated September 14, 2002, from Westwood Professional Services. We haVe done a preliminary review of these drainage calculations and find them generally to be acceptable. We have a number of minor comments regarding the drainage calculations, which we will share directly with Jason McCarty of Westwood Professional Services. A general review of the grading plan indicated that while the overall plan appeared to be adequate, there are a few items that will have to be reviewed in greater detail at a larger scale. These items have been explained to the developer; they include the grading along and adjacent to the large wetland at the north side of the property, and also a determination of emergency overflows for all portions of the property. There is sufficient capacity for sanitary sewer and watermain to service this development. Generally, the sanitary sewer and water system will be considered public and will be maintained by the City and the Elk River Municipal Utilities. Final determination of hydrant locations, valve locations, watermain looping, and sewer alignment has yet to be finally determined. Based on this discussion, sidewalks have now been added on both sides of all public streets, although in some cases, the sidewalks are located outside of the public rights-of-way. In addition, sidewalks are shown around Block 1 and Block 3 of the townhouse units, which are located on the north side of the project. One issue yet to be decided would be who maintains the sidewalks adjacent to the public streets: the City Street Department or the Townhouse Association. The two most recent submittals, the Preliminary Site Plan/PUD and Concept Commercial Plan, are in conflict with one another. Some of these conflicts are as follows: · Driveway locations shown differently on each of the plans. · Parking areas segregated on one plan while combined on another plan. · There is no ponding shown on either plan for the area west of Twin Lakes Road. · The Concept Commercial Plan shows a layout for property on the west side of Twin Lakes Road, which we understand is not owned by the developer. · The proposed access into the site on the east side of Twin Lakes Road does not line up with the existing access into the MnDOT park and ride facility on the west side of Twin Lakes Road. · Both of these plans, the Concept Commercial Plan and the Preliminary Site Plan/PUD show Street A accessing Twin Lakes Road at a full access intersection, providing for left turns into Street A and left turns onto Twin Lakes Road. This is not acceptable; Street A must be a right-in/right-out only. The Environmental Assessment Worksheet (EAW) for this development has been revised, reviewed and approved by City staff. We believe it is still in the period of public comment. From an engineering standpoint, the major change in the EAW caused by the change in usage from the original proposal for Elk River Station is a much lower traffic count. The current proposal of this property will generate traffic that can be handled by the two access points shown, one being full movement at the southwest comer of the site, and the other a right-in/right-out at the northwest comer of the site. Facades and Exterior Walls The Elk River Station development will be located southeast of the Central Business District where Highway 10 and Twin Lakes Road intersect. The exterior appearance of the buildings should include elements of buildings found in historic rural railroad stations. The project will have a transportation theme. Facades should be articulated to reduce the massive scale and uniform impersonal appearances of large retail buildings and provide visual interest. Buildings should incorporate recesses, offsets, pilasters or angular forms. Buildings should have architectural features and patterns that provide visual interest at a pedestrian scale. The features should be an integral part of the building fabric, and not applied to the trim, graphics or paint. Variations in roof lines and cornice details should also be used to add interest to the buildings. Exterior building materials and colors comprise a significant part of the visual impact of a building. Therefore they should be aesthetically pleasing and compatible materials and colors. Facade colors should be subtle, neutral or earth tone colors. The development shall use a consistent palate of materials and colors throughout. Facades of a building, which are visible from adjoining properties or public streets, shall include certain design elements found in the front facades. Predominant exterior facade material should include, but not be limited to, one or more of the following: · brick · native stone · cultured stone · tinted, textured, integrally colored masonry units · fiber cement sidings Predominant exterior building material shall not include the following: · smooth faced concrete block · smooth faced or rakes faced tilt up concrete panels · prefabricated steel panels -1- 10/4/02 2. Entryways Entrances should be carefully defined and visible. They should incorporate devices such as canopies, overhangs, recesses/projections, arcades, raised parapets over the doors, peaked roof forms, display windows, architectural details such as tile works and moldings which are integrated into the buildings design. 3. Lighting General site and street lighting (excluding general parking lot lighting) shall be architecturally integrated with the building style, material and colors. It shall be at a pedestrian scale. Wall lighting fixtures shall be consistent with the pedestrian and general scale lighting. General parking lot lighting shall be at a height of no greater than 30 feet. Poles and fixtures shall be a design that compliments the street and general site lighting standards and fixtures. 4. Loading Areas, Trash Collection and Outdoor Storage Loading Docks, track parking, HVAC equipment, and other service functions should be incorporated into the overall design of the building and screened from view of adjoining properties and streets. Trash compactors and dumpsters should be within and enclosure constructed of the same materials and colors as those used in the building. 5. Signage Signs shall be an integral part of the overall architectural design of the project, rather than contrasting with it. They must consist of materials and design, which compliments the architectural elements of the project. Signs to be lit either directly or indirectly. 6. Monument and Wall Signs for Freestanding Sites Each of the internal entries and freestanding buildings within the Elk River Station xvill be allowed to have a freestanding and/or wall sign. The commercial component of the project includes 81,000 square feet of retail, office, sit-down restaurant, daycare and convenience/fuel. Elk River Station is a Planned Unit Development proposed for construction in the N ¼ of NE ¼ of Section 11, T32N, R26W, City of Elk River, Minnesota. The project site is located one-half mile east of State Trunk Highway 169 at Tyler Street (Exhibit 1). Proposed residential land use includes the construction of 60 apartment units, 300 townhome units, and two buildings that will include 70 senior living units. All residential development will be located on the east side of Tyler Street. Commercial land use east of Tyler Street will consist of 42,000 square feet of office/retail and a 5,000 square-foot day care facility. The portion of the site west of Tyler Street will include 20,000 square feet of office/retail, an 8,000 square-foot sit-down restaurant, and a 6,000 square-foot convenience/fuel station with 12 vehicle-fueling positions. The development types are summarized in the following table. The project will include five stormwater ponds designed to provide water quality treatment and rate control for runoff from impervious surfaces, and consideration is being given to construction of small parks, open spaces, and trails (Exhibit 2). However, construction timing will ultimately depend on the pace of townhome sales and market conditions. Approximately 51.3 acres of the site will be mass graded in phases to construct roadways, buildings, stormwater ponding, amenities, and.install utilities. It is anticipated that construction will entail moving a total of approximately 165,000 cubic yards of soil. Project development will convert approximately 31.9 acres of old field/grassland, 15.4 acres of woodland, and 3.8 acres of brushland/grassland to residential and commercial land uses, Page 2 ~ Westwood Professional Services, Inc. Elk River Station EAW September 6, 2002 including impervious surface, landscaping, and stormwater ponding. Tyler Street includes 2.4 acres of existing impervious surface that will remain. Preservation of approximately 15 acres of wetland and 1.5 acres of woodland is expected to help mitigate adverse effects on wildlife. Land Use The site has been undeveloped and vacant since 2000. Prior to 2000, open portions of the site outside of wetlands were used for agricultural purposes. United Power Association owns a 55-foot easement along the north edge of the site. A power transmission line is located within this easement. The eastern and southern adjacent properties are owned by Cargill Corporation and used as a research facility for agricultural products. Large-lot residential development is located on the adjacent property to the north, and this residential area will be buffered from the proposed development by a minimum of 600 feet of wetland. The City of Elk River anticipates the improvement of 175th Avenue North in this area and predicts that the large lot residential property will be subdivided and served by municipal services that have been installed in Tyler Street. The Minnesota Department of Transportation recently constructed a Park and Ride Facility on the adjacent property to the west. The Northstar Corridor Development Authority will continue to pursue the development of the Commuter Rail Station on that site (Exhibit 3). Trucking terminals are located to the southwest, opposite the railroad tracks from the proposed development. Adioinin.q Land Use Compatibility Adjoining land uses are described in the paragraph above. On August 27, 2001, the City Council of the City of Elk River changed the land use designation for this site from Light Industrial and Low Density Residential to Medium Density Residential and Community Commercial. Currently the site is zoned for Light Industrial and Single Family Residential development. The proposed project will require rezoning of the property to PUD (Planned Unit Development). It is anticipated that the large- lot residential development to the north may be subdivided and served by municipal sewer and water, and the adjoining property to the west includes a park and ride lot and a potential North Star Light Rail Corridor that would run between St. Cloud and Minneapolis. Operations at the Cargill research facility may include some activities that are not completely compatible with residential use, but the Cargill property is guided for residential use and some day will likely be converted to residential development. The engine noise and diesel fuel odors associated with the trucking terminals located southwest of the proposed development do not present substantial land use compatibility concerns because: (1) these properties are located at least 500 feet from the nearest proposed residential use, (2) the proposed development will be transportation oriented, and (3) most truck traffic will be distributed west toward Highway 10, away from the proposed development. The proposed project and mixed land use is actually more compatible with adjacent and future land uses than the existing Light Industrial and Low Density Residential zoning. No land serious use conflicts are anticipated. Page 4 W Westwood Professional Services, Inc. Elk River Station EAW September 6, 2002 Potential for Environmental Contamination Although a Phase I Environmental Site Assessment has not yet been completed for the property, Westwood Professional Services conducted a site review on August 9, 2002 and did not observe stained soils, stressed vegetation, old foundations, or other characteristics that would suggest evidence of recognized environmental conditions. The historical land use on the property is agricultural crop production, and the past land use does. not suggest potential for environmental contamination. As discussed in more detail under Item 13, there is one non field-verified registered well within the project site. Active wells on the property will be field-located, abandoned, and sealed in accordance with Minnesota Department of Health regulations. 10. Westwood Professional Services, Inc., with the assistance of Tim Edgeton, Sherburne County Forester, conducted a site visit on Aug0st 9, 2002 to map the cover types and assess the quality and quantity of woodlands and wetlands on the site (Exhibit 4). The old field/grassland, which covers approximately 46 percent of the site, was farmed for agricultural crops until two years ago and is currently dominated by foxtail grass, Canada fleabane, common milkweed, common mullein, smooth brome, sweet clover, and sandbur. Brushland/grassland is located near Tyler Street, and' includes unpaved road right-of-way as well as upland meadow that has been invaded by staghorn.sumac. Woodlands border the north side of the old field/grassland and occurs in strips along the eastern and southern property boundaries. The overstory is dominated by bur oak and pin oak and dense patches of prickly ash, red raspberry, current, American hazelnut, and gooseberry occur in the understory. The herbaceous layer includes smooth brome, giant goldenrod, white snakeroot, Pennsylvania sedge, and Virginia creeper. Many of the pin oaks are infected with oak wilt disease and all pin oaks that are either diseased or threatened with disease will be removed during project construction. Passe Engineering, Inc. delineated and flagged one 15-acre wetland in the northern portion of the property in mid-April of 2001 using the Corps of Engineers Wetlands Delineation Manual (Environmental Laboratory, Waterways Experiment Station, 1987) (Exhibit 5) According to the USDA/NRCS List of Hyd~c Soils for Minnesota (1995), Seelyeville muck and Marky muck are located in the northern portion of the site and correspond to the delineated wetland. National .Wetlands Inventory (NWl) mapping shows the wetland classified as a Type 3/7, Shallow marsh/Wooded swamp (Exhibit 6). The wetland is dominated by reed canary grass (Phalaris arundinacea; FACW+), wool grass (Scirpus cyperinus; OBL) and green bulrush (Scirpus atrovirens; OBL). Page 5 Elk River Station EAW September 6, 2002 representing the Local Governmental Unit for the City of Elk River, confirmed that the delineated boundaries are acceptable for local administration of the Minnesota Wetland Conservation Act (WCA). 11. Fish, Wildlife, and Ecologically Sensitive Resources a) Identi~.., fish and wildlife resources and habitats un or near the site and describe ho~v they would be affected by the project. Describe any' measures to be taken to minimize or avoid impacts. Fish and wildlife resources on and near the site are directly related to the composition, quality, size, and connectivity of natural communities including grasslands, woodlands, and wetlands. The composition of the 31.9 acres of old field/grassland has been altered by years of agricultural practices. These historical farming practices have caused some wildlife species that would otherwise occur on the site to decline or become extirpated. Wildlife resources that exist th. roughout the site include species that have adapted to open lands, small woo~lots, and wet meadows, such as pheasant, meadowlark, field sparrow, cottontail, red fox, and white-tailed deer. The open fields provide seasonal food and cover for these species. The woodlands and wetlands provide habitat and cover for many species commonly found in the upper Midwest such as woodcock, thrushes, woodpeckers, raccoon, and amphibians. This wetland is part of a larger system that extends east, west, and north. A ditch along the' north property boundary extends north to Kleiver Marsh. The connectivity of this wetland provides a potential travel corridor for wildlife. Fisheries resources do not exist on the site. Project construction will convert approximately 31.9 acres of old field/grassland, 15.4 acres of woodland, and 3.8 acres of brushtand/grassland to streets, buildings, parking areas, lawn, landscaping, and stormwater ponding. Conversion of open fields to a more urbanized setting is expected to result in a decline in the type and number of wildlife species. Populations of species that depend upon cropland and grassland, such as ring-necked pheasants, will likely be displaced. Migratory birds are'expected to respond to the development by locating alternative nesting sites upon their return from wintering habitats. Some songbirds that readily adapt to suburban habitats may become more numerous. Non-migratory species with small home ranges, such as small mammals, will experience more adverse effects. These species will compete with other individuals of the same species to claim territories in neighboring habitats or succumb to mortality during project construction. Preservation of a. pproximately 15 acres of wetland, and 1.5 acre§ of woodland, combihed with creation of about 2.6 acres of stormwater pOnding, is expected to help minimize adverse effects on Wildlife to some degree. Are any state-listed (endangered, threatened, or special concern) species, rare plant communities or other sensitive ecological resources such as native prairie habitat, colonial waterbird nesting colonies or regionally rare plant communities on or near the site? If the DNR Nantral Heritage and Nongarne Research program has been contacted give the correspondence reference number: ERDB 20010847. Describe measures to minimize or avoid adverse impacts. No evidence of threatened, endangered, or rare plant or wildlife species was observed on the site during field reviews conducted in September 2001 and August 2002. The.Minnesota Department of Natural Resources (DNR) reviewed the Minnesota Natural Heritage database in March 2001 to determine if any rare plant or animal species or other significant natural features are known to occur within an approximate one-mile radius of the project site. The DNR identified two records of rare species or communities that occur near the site, including: (1) a dry oak savanna located about 0.25 mile east of the site, and (2) a loggerhead shrike observed roughly 1.2 miles southwest of the site, across the Mississippi River, in 1996. The dry oak savanna will not be affected by the development because project construction will not extend east of the property boundaries. Page 6 W Westwood Professional Services, Inc. Elk River Station EAW September 6, 2002 13. Loggerhead shrikes are a state-listed threatened species in Minnesota. According to Minnesota's Endangered Flora and Fauna (University of Minnesota Press, Coffin and Pfannmuller, 1988), loggerhead shrikes are widely distributed throughout the United States and the southern Prairie Provinces of Canada. However, shrike numbers have drastically declined during the past 10 to 20 years. Suspected causes for the decline include intensive farming and environmental contamination. Preferred habitat is considered dry upland open country with hedgerows, shrubs, or small trees. Unused prey (frogs, mice, or large invertebrates) impaled on thorns of shrubs or barbed wire is considered an indicative sign of the presence of shrikes. The DNR Natural Heritage Program recommends that small red cedars and other small nesting and perching trees be preserved whenever possible. Mr. Steve Kittelson of the Minnesota DNR Nongame Program has indicated that shrikes are typically observed in association with fence lines and old pastures, particularly those that support small red cedars and wild plum thickets. Shrikes typically nest about five to six feet above the ground. Potential habitat for loggerhead shrikes on the project site is generally limited to woodland edges and brushland/grassland. Approximately 46 percent of the site was used for growing agricultural crops prior to 2000, and no shrikes were observed during field reviews by Kjolhaug Environmental Services on September 14, 2001 and Westwood Professional Services on August 9, 2002. Although potential shrike habitat 'such as woodland edges and brushlandlgrasstand will be reduced on the on the project site, shrikes have not been documented on this specific ~operty. The 15- acre wetland on the site, which is described under Item 10, will be completely avoided by project construction. Appropriate erosion control measures will be implemented in accordance with NPDES permit requirements to reduce the potential for incidental wetland fill. Consideration will be given to leaving an undisturbed buffer above the wetland edge where possible. The Protected Waters and Wetlands Inventory for Sherburne County (Minnesota DNR, 1983) indicates the property includes no DNR Protected Waters. Five stormwater ponds will be constructed throughout the site for rate control and water quality treatment. Stormwater runoff from impervious surfaces on the site will be treated according to NURP (National Urban. Runoff Program) guidelines prior to discharging to the wetland. The wetland will allow the water to drain to the existing city ditch along the north property line of the site. The ditch drains along State Highway 10 to the intersection of Highways 169 and 10 before ultimately draining into the Mississippi River. The construction of the ponds will minimize potential for indirect impacts to other water bodies within and adjacent to development areas. Page 7 Elk River Station EAW September 6, 2002 According to the Well Location Points digital database from the Minnesota Geological Survey's (MGS) County Well Index, there is one non field-verified registered well within the project site (Exhibit 7). The data consists of a Geographic Information System (GIS) point coverage that was created from wells listed in the County Well Index (CWI) database, and are current as of December 28, 1998. According to the CWI database, this well (unique well number 159959) is an active, domestic well, is 59 feet deep, and is registered under the name of Quintin. Lanner. This well location has not been confirmed in the field. However, active wells on the property will be field-located, abandoned, and sealed in accordance with Minnesota Department of Health regulations. The proposed development will be connected to the City of Elk River municipal water supply system for domestic use and fire protection. The City has planned for an adequate municipal water supply system to supply the proposed and future developments. A trunk watermain exists in Tyler Street and will be looped through the site provide water service to the development. The project, will not require installation of any new domestic wells. The Elk River municipal water supply is authorized to pump up to 600 million gallons per year (mgy) under DNR Water Appropriation permit number 75- 3215. The Elk River municipal water supply currently includes six wells, which have the capacity to pump 5.5 mgy. The quantity of water used by the residents of Elk River Station is expected to be proportional to the amount of sanitary wastewater produced (Item 18a). The estimated water demand for Elk River Station is 139,850 gallons per day. Water demand estimates are based on the assumption that consumption is approximately 110 percent of wastewater generation. Although it is possible that a DNR Water Appropriation Permit may be necessary to conduct construction dewatering, it is unlikely that dewatering will be necessary during construction because the depth to groundwater exceeds the planned depth of sanitary sewer, municipal water, and storm sewer in most areas within the project site. If groundwater is encountered, contractors will carry out dewatering on a case-by-case basis at the minimum duration and quantity necessary to construct utility service for the affected sites. The quantity and duration of potential construction dewatering is not known at this time, but it is expected that any necessary dewatering will be temporary. Groundwater appropriated for construction dewatering purposes will be discharged to temporary or permanent stormwater ponds located within the project site before discharging the wetland. If construction dewatering and pumping from the proposed development exceeds the 10,000-gallon per day or 1,000,000 gallons per year thresholds, a DNR Water Appropriation Permit will be obtained. If it becomes apparent that construction dewatering will not exceed 50 million gallons in total, and_ duration of one year from the start of pumping, the contractor or project proposer will apply to the DNR Division of Waters for coverage under the amended DNR General Permit 97-0005 for Temporary Water Appropriations. It is not anticipated that construction dewatering or pumping from the proposed development will be extensive or continue long enough to impact domestic or municipal wells. 14. Water-Related Land Use Management District Does any part of the project involve a shoreland zoning district, a delineated 100-yearfloodplain, or a state or federally designated wild or scenic river land use district? The hydrology of the area will be studied and lowest floors will be set at elevations that will not be subject to localized flooding. DNR protected waters, wetlands, and watercourses do not exist on the site, The nearest DNR protected wetland is Kleiver Marsh (72-3W), which is located approximately 1,800 feet northeast of the project site. The project is not located within 1,000 feet of Kleiver Marsh, and is therefore not within the shoreland overlay district. Page 8 ~¥ Westwood Professional Services, Inc. Erosion and Sedimentation Give the acreage to be graded or excavated and the cubic yards of soil to be moved: Acres: It is anticipated that approximately 51 acres of the 70-acre site will be graded. Describe any erosion and sedimentation control measures to be used during and after project construction. According to the USDAJNRCS Highly Erodible Soil Map Unit List for Sherburne County (July, 1994), there are no highly erodible soils located within the project site. Surface topography is relatively level, with elevations ranging from 880 to about 902 (Exhibit 5). The 2-foot contour topographic mapping indicates small areas of 9 to 12 percent slopes exist in the area leading down to the wetland edge. Most slopes on the project site are 7 percent or flatter. Because project construction will involve disturbance of more than five acres of land, application for coverage under the NPDES General Permit for Construction Activities will be submitted to the Minnesota Pollution Control Agency prior to initiating earthwork on the site. This permit requires that Best Management Practices (BMPs) be used to control erosion and that all erosion controls be inspected after each rainfall exceeding 0.1 inch of precipitation. Erosion control practices to be considered for use on the site include: 1. Construction of temporary sediment basins in the locations proposed for stormwater ponding, and development of these basins for permanent use following construction. 2. Silt fence and other erosion control features installed prior to initiation of earthwork and maintained until viable turf or ground cover is established on exposed areas. 3. Periodic street cleaning and installation of a rock construction entrance to reduce tracking of dirt onto public streets. 4. Stabilization of exposed soils within 14 calendar days of completion of rough grading unless otherwise directed by the project engineer. 5. Energy dissipation, such as riprap, installed at storm sewer outfalls. 6. Use of cover crops, native seed mixes, sod, and landscaping to stabilize exposed surface soils after final, grading. Erosion control plans will be reviewed and approved by the City of Elk River prior to project construction. It is anticipated that potential adverse erosion and sedimentation impacts will be limited primarily to short-term effects, and therefore are not expected to affect water quality in the wetland over the long term. With the implementation of the above BMPs, potential adverse effects from construction-related sediment and erosion on water quality will be minimized to the extent practical. Water Quality: Surface Water Runoff Compare the quantiO, an,l qualio~ of site runoff before and after the project. Describe permanent controls to manage or treat r~.~noj~. Describe any stormwater pollution prevention plans. Surface water drainage generally flows to the wetland located at the north end of the site. The wetland allows the water to drain to the existing city ditch along the northern property boundary of the site. The quantity of surface water runoff will increase during storm events as additional impervious surface area is added with the construction of pavement and buildings. The increase in impervious surface will be mitigated by construction of onsite stormwater ponds, which will be constructed to protect water quality and limit peak discharge rates from the site. These discharge rates will be maintained at or below existing levels. The proposed ponding system will be designed to meet all requirements of the Minnesota Pollution Control Agency (MPCA) and the City of Elk River for water quality treatment, and the post development rate of runoff will not exceed existing rates. Stormwater ponds will be designed to remove suspended sediment and nutrients from stormwater runoff entering the city ditch. b) k'lent(~, routes and receiving water bodies for runoff fi'om the site; include major downstream water bodies as well as the immediate receiving waters. Estimate impact runoff on the quali~.' of receiving waters. According the DNR Division of Waters digital watershed mapping, the project site is located within the Mississippi River minor watershed (Exhibit 8). Stormwater generated from this development will be routed into a series of five newly created stormwater ponds, which will provide rate control and water quality treatment prior to discharging the wetland at the north end of the site. The stormwater ponds will be designed to protect water quality and limit runoff rates from the site, and the project is expected to have only minor effects on downstream wetlands and the Mississippi River. Construction of a total of approximately 2.6 acres of stormwater ponds will be required as development occurs. The ponds will be designed in accordance with NURP (Nationwide Urban Runoff Program) and be designed to handle a 100-year storm event. In a 100-year event, stormwater will be retained in the basins and discharged at or below existing levels. NURP guidelines indicate that ponds designed in accordance with Walker (Walker, W.W. 1987. Phosphorus Removal by Urban .Runoff Detention Basins. Lake and Reservoir Management: ~olume I11. North.American Lake Management Society) have: 1. A permanent pool (dead storage) volume greater than or equal to the runoff from a 2.5 inch st°rm over the entire contributing drainage area assuming full development. 2. A permanent pool average depth that is > 4 feet, with a maximum dePth of < 10 feet. 3. An emergency spillway adequate to control the one percent frequency/critical duration rainfall event. 4. Basin side slopes no steeper than 4:1, with a 10:1 bench for the first one foot above the normal water level. 5. Maximized distance between basin inlets and outlets. Water Quality: Wastewaters a) Describe sources, composition and qt.tantities of all sanitmn; muntcipal and indttstria] wastewater produced or treated at the site. Only normal domestic sewage wastewater production is expected. The types of wastewater produced will be typical of mixed-use developments. No on-site municipal or industrial wastewater treatment is anticipated. Sanitary wastewater production was estimated based on the methods outlined in the Service Availability Charge (SAC) Procedures Manual (Metropolitan Council Environmental Services, 2000). One SAC unit is defined as 274 gallons of maximum potential daily wastewater flow volume. The volume of wastewater production for multi-family housing was calculated using one SAC unit per dwelling unit. The volume of wastewater production for commercial/retail/institutional development was estimated by assigning one SAC unit per 2,400 square feet of total floor area. Based on these methods, the proposed Elk River Station development is expected to generate a maximum of 127,136 gallons of wastewater per day as shown in the following table. Table 18.1. " All wastewater from the Elk River Station development will be routed through a series of lateral and trunk sanitary sewer pipes.. The later sewer pipes will be 8 inches in diameter, and be located at appropriate depths below ground. The lateral sewer pipes will connect to an existing 8- inch sanitary sewer main in Tyler Street before reaching the Elk River Wastewater Treatment Plant (WWTP). The project will not include on-site sewage treatment systems. If wastes will be discharged into a publicly owned treatment facility, identi~, the facility, describe any pretreatment provisions and discuss the facility's ability to handle the volume and composition of wastes, identijSying any improvements necessary. The Elk River WWTP is located in Elk River on the Mississippi River and serves the City of Elk River. The plant was upgraded during 1995 to 1996. The facility currently has a design capacity to treat 1.6 million gallons per day of wastewater and the capability to expand to an ultimate treatment capacity of 2.2 million gallons per day. The Elk River WWTP currently treats an average of 1.0 million gallons per day, which is approximately 65 percent of the plant's current capacity. W Westwood Professional Services, Inc, Page 11 Elk River Station EAW September 6, 2002 The Elk River Station development is estimated to produce approximately 127,136 gallons of wastewater per day, which is eight percent of the plant's current capacity. Because the WWTP has adequate treatment capacity for [he additional wastewater, treatment capacity issues are not anticipated. d) If the project requires disposal of liquid animal manure, describe disposal technique and location and discuss capaciO: of handle the volume and composition of manure. Depth to groundwater was estimated by calculating the difference between the water table elevation and the surface topography. Braun Intertec prepared a Report of Geotechnical Evaluation in December 2000 and supplemented it in September 2001. The December 2000 report indicated that water was not encountered during soil boring advancement. Based on the measured cave-in depths and.the evaluation of moisture contents apparent in the penetration test samples, the groundwater could be within 10 to 20 feet of the ground surface, with corresponding elevations of 875 and 878, respectively. Some soil borings completed in September 2001 were located adjacent to the wetland, and groundwater was encountered between one and five feet below grade, with corresponding elevations of 878 to 880, respectively. According to the Anoka Sand Plain Regional Hydrogeologic Assessment (Minnesota Geological Survey, 1993), the water table contour is 875 feet above mean sea level.(msl). Two-foot topographic mapping indicates elevations on the site range from 880 to 902, and exist mostly between 888 and 894 feet msl. Thus, depth to groundwater averages 16 feet. Because surficial groundwater is sometimes encountered in the wetland, the minimum depth to groundwater is estimated at 0 feet. Depth to bedrock was determined from Geologic Map of Minnesota: Depth to Bedrock (Minnesota Geological Survey, Map S-14, 1982). Page 12 W West'wood Professional Services, Inc. Upland soils generally consist of loamy sands of the Hubbard series and wetland soils consist of decomposed organic muck of the Seelyeville and Markey series. Soil series mapping indicates slopes range from 0 to 12 percent across the site. 20. Solid Wastes, Hazardous Wastes, and Storage Tanks Describe ~, pes, amounts and compositions of solid or hazardous ,vastes, including solid animal manure, shtdge and ash, produced during consnxlction and operation, ldentij~y' method and location of disposal. Forprojects generating municipal solid waste, indicate if there is a sot.wce separation plan; describe how the project will be modified for recycling. Solid waste generation will be typical of mixed-use development. It is not anticipated that the proposed residential development will generate significant amounts of wastes that would be considered "hazardous." According to the Minnesota Office of Environmental Assistance, there are no available statewide, solid waste generation studies for Minnesota. Based on data provided by the California Integrated Waste Management Board (http://www.ciwmb.ca.qov/WasteChar/WasteGenRates/default. htm and SOlid Waste Characterization Study: Results and Final Report, December 1999), solid waste generation for the development is estimated at 830 tons per year. This estimate is detailed in the following table. No animal manure, sludge, or ash generation is anticipated. Table 20.1. The City of Elk River has a curbside recycling program for cardboard, newspaper, glass, metal, and plastic. Participation in the recycling program by future residents of the site will be expected to reduce costs for solid waste trucking and disposal. The City contracts the disposal of non- recycled waste in the project area. Two haulers truck the waste to the Elk River Refuse Derived Fuel (RDF) facility, where the waste is sorted and combustible waste is used for power generation. All non-recyclable waste that is rejected by the RDF facility is deposited in the Elk River Landfill. Identify any' tox'ic or hazardous materials to be used or present at the site and ident(~: measures to be used to prevent them from contaminating ground~vater. If the use of toxic or hazardous materials Mil &ad to a regulated waste, discharge or emission, discuss any' alternatives considered to minimize or eliminate the waste, discharge or emission. No known hazardous materials are currently located on the site. Westwood Professional Services, Inc. prepared a Traffic Analysis for the proposed Elk River Station development to assess potential effects of the Elk River Station development on the local and regional roadway network. The complete Traffic Analysis is contained in Appendix B. Traffic entering and exiting from the development will access Tyler Street. Tyler Street is a four lane, divided roadway with turn lanes at key intersections. The portion of the site east of Tyler Street will be served with two internal roadways. The southernmost of these roadways lines up opposite of the south transit station access and will be a full movement intersection. The northerly access on the east side will be a right in/right out only access point. Further north there is a second access to the transit station to the west of Tyler; this transit access point does not serve Elk River Station movements on the east side of Tyler. Trip Generation The trip generation for the Elk River Station development was determined based on the standard trip generation rates contained in Trip Generaii0n, 6th Edition (institute of Transportation Engineers, 1997). Trip generation data are. provided in the following table. The project is expected to generate a total of 4,593 trips per day and 667 trips in the P.M. peak hour. Table 21.1. Using this distribution, the various elements of the development were assigned to the roadway network and tabulations were recorded of the new volumes at the Elk River Station access points and the transit access point immediately north on Tyler. The traffic analysis used conservative approach to estimate that the transit station west of Tyler Street and other growth in the Tyler Street corridor will reach approximately 7,000 vehicles per day, with a P.M. peak hour distribution of about 10 percent. These background and development volumes were added together to determine the post development total traffic volumes. ~¥ Westwood Professional Services, Inc. Page 15 Elk River Station EAW September 6, 2002 Traffic Analysis With the post development volumes, intersection capacity analyses were computed to assess the ability of the nearby roadway system to accommodate the Elk River Station development (and expanded the transit station). An initial set of analyses was conducted with the following assumptions: Table 21.2. However, with two-way stop sign control and full growth in background traffic to the assumed levels, the south 'access to' Elk River Station (opposite the Transit Station south access) would not function properly in either the A.M. or P.M. peak. The analysis programs indicate that at those volume levels the vehicles turning left (westbound) out of the Elk River Station site would be unable to exit onto the roadway in an acceptable amount of time and that queues would continue to grow on this leg. The south intersection access to Elk River Station was also analyzed with four-way stop sign control. At the full estimated volume levels, with four way stop signs the intersection would function very efficiently with very moderate delays for all movements. The traffic analysis recommended that upon opening of development, the intersection could be operated with two-way stop control, with a plan of monitoring the operations. In the future, as both background growth continues to occur and Elk River Station reaches full build out and occupancy, four-way stop sign control may become the appropriate control strategy for this intersection; With appropriate turn lanes and stop sign controls, the proposed project is not expected to affect local or regional traffic operations. 22. The proposed development is subject to the City of Elk River 1995 Comprehensive Plan, which was amended in 2001 to change the land use designation for the property from Light Industrial and Low Density Residential to Medium Density Residential and Community Commercial. The property is currently zoned for Light Industrial and Single Family Residential development, and the proposed project will require rezoning of the property to PUD (Planned Unit Development). It is anticipated that the large lot residential development to the north may be subdivided and served by municipal sewer and water, and the adjoining property to the west includes a park and ride lot and a potential North Star Light Rail Corridor that would run between St. Cloud and Minneapolis. Operations at the Cargill research facility may include some activities that are not completely compatible with residential use, but the Cargill property is guided for residential use and some day will likely 'be converted to residential development. The engine noise and diesel fuel odors associated with the trucking terminals located southwest of the proposed development do not present substantial land use compatibility concerns because: (1) these properties are located at least 500 feet from the nearest proposed residential use, (2) the proposed development will be transportation oriented, and (3) most truck traffic will be distributed west toward Highway 10, away from the proposed development. The proposed project and mixed land use is actually more compatible with adjacent and' future land uses than the existing Light Industrial and Low Density Residential zoning. CLOUD 8RAINERD Traffic Analysis for Elk River Station Introduction Elk River Station is a proposed mixed-use development next to the existing transit station located along Tyler Street. The purpose of this memorandum is to summarize a traffic analysis conducted to assess potential impacts of the Elk River Station development. The concept plan for the development is shown in Exhibit 1. The proposed development consists of property east and west of Tyler Street, as summarized below. The portion of the site west of Tyler Street is immediately adjacent to the transit station. The portion of the site east of Tyler Street is proposed to be served with two internal roadways. The southernmost of these roadways lines up opposite of the south transit station access and will be a full movement intersection. The northerly access on the east side will be a right in/right out only access point. Further north there is a second access to the transit station to the west of Tyler; this transit access point does not serve Elk River Station movements on the east side of 'Tyler. Trip Generation The daily, A.M. peak hour and P.M. peak hour traffic forecasts for the site are summarized on Table 1. The site is expected to generate approximately 530 total A.M. peak hour trips and 670 Westwood Professional Services, Inc. 1 August 2002 Designing the Future Today...since 7972 d ~, o · :~ '13 ._o P.M. peak hour trips. The trip rates utilized are those contained in the publication Trip Generation, 6th edition, 1997, published by the Institute of Transportation Engineers. (Note: The trip generation values presented in Table 1 and utilized for analysis purposes do not include reduction factors for shared trips or pass-by trips.) At the bottom of Table I is a supplemental table of trip generation data for the additional volume due to the planned expansion of the transit station park and ride lot from its current 330 spaces to 754 spaces. Trip Distribution and Assignment The trip distribution for the site estimates that 35% of the traffic is oriented to the north on Tyler Street and 65% is oriented to the south. Using this distribution, the various elements of the development were assigned to the roadway network and tabulations were recorded of the new volumes at the Elk River Station access points and the transit access point immediately north on Tyler. In addition to the transit station and Elk River Station traffic, other growth in the corridor is expected to cause volume increases. For the purposes of this analysis, a conservative analysis was utilized assuming that other background volumes along the corridor will reach approximately 7,000 vehicles per day, with an A.M. peak hour percentage of about 8% of the daily volume and a P.M. peak hour percentage of about 10%. These background and development volumes were added together to determine the post development total traffic volumes. These volumes are depicted on Exhibit 2. The lane arrangements for each intersection are also depicted on Exhibit 2. Traffic Analysis With the post development volumes, intersection capacity analyses were computed to assess the ability of the nearby roadway system to accommodate the Elk River Station development (and expanded the transit station). An initial set of analyses was conducted with the following assumptions: south access to Elk River Station (opposite Transit Station south access) north access to Elk River Station Transit Station north access right in/right out only stop sign control for west (Transit Station)leg two-way stop sign control for east-west moves The results of the traffic analyses show that with side street stop control, the north access to Elk River Station and the north Transit Station access will function well, with only moderate delays. However, with two-way stop sign control and full growth in background traffic to the assumed levels, the south access to Elk River Station (opposite the Transit Station south access) would not function properly in either the A.M. or P.M. peak. The analysis programs indicate that at those volume levels the vehicles turning left (westbound) out of the Elk River Station site would be unable to exit onto the roadway in an acceptable amount of time and that queues would continue to grow on this leg. (Table 2 summarizes the projected post-development delay values.) The south intersection access to Elk River Station was also analyzed with four way stop sign control. At the full estimated volume levels, with four way stop signs the intersection would West'wood Professional Services, Inc. 2 August 2002 function very efficiently with very moderate delays for all movements. It is recommended that upon opening of development the intersection could be operated with two way stop control with a plan of monitoring the operations.
