Green Company November 18, 2002 File: 806550J-0325 Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: 175TM AVENUE IMPROVEMENTS MN/DOT VARIANCE REQUESTS Dear Council Members: We have recently had conversations with Mn/DOT State Aid staff concerning 175th Avenue improvements. The plans were approved by Mn/DOT in June 2002. In July 2002, pdor to the bid, we made minor adjustments to the plans to accommodate the plat of Park Pointe. These minor adjustments included revisions to watermain and elimination of the roadside ditch adjacent to the Park Pointe pond. Technically, making these revisions and not having them reapproved by the Mn/DOT Office of State Aid is a violation of Rule 8820.2800 Subpart 2, which states that only projects whose plans have had final approval by the state-aid engineer before bid openings are eligible for use of state-aid construction funds. In order to rectify this, Mn/DOT State Aid staff has requested that we seek a Mn/DOT vadance to Rule 8820.2800 Subpart 2. Attached is a resolution we have prepared for the City Council's consideration, which will initiate the vadance procedure. Vadance Committee meets in mid-December; we will prepare a presentation package and appear before the vadance committee. We are requesting that City Council adopt the attached resolution. TJM:sw Enclosure Ltr-111802~Council 1326 Energy Park Drive · St. Paul, MN 55108 ° 651/644-4389 fax 651/644-9446 toll free 888/368-4389 RESOLUTION 02- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION REQUESTING A VARIANCE TO STATE AID RULE 8820.2800 CONSTRUCTION REQUIREMENTS SUBPART 2 PLANS AND ESTIMATES WHEREAS the City of Elk River proposes to reconstruct 175"~ Avenue NW from Fillmore Avenue to Twin Lakes Road; and WHEREAS Minnesota State Aid Rule 8820 Construction Requirements Subpart 2 Plans and Estimates requires final plan approval by the state-aid engineer for the project to be eligible for the use of federal and state-aid construction funds; and WHEREAS minor revisions were made to sixteen sheets out of forty-one of Delegated Contract Project S.P. 204-M-04 after state-aid plan approval to accommodate the single family plat of Park Pointe adjacent to the project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: The City Council requests a vadance to Minnesota State Aid Rule 8820.2800 Subpart 2 so that all eligible construction items in revised plans may be funded with federal and/or state-aid construction funds.
