Analysis
The property is located at the end of 192 ¼ Avenue and is 9.42 acres in area with a single
family home and a pole barn located on the property. The new parcel is located along the
western property line of the subject parcel. The parcel to be created is 2 ~ acres which
meets the minimum lot area requirements of the Rla District.
The City Engineer's memo notes that the new parcel is encumbered by a large wetland as
well as a natural gas main easement, which limits the buildable area. Additional information

will be required prior to recording the Administrative Subdivision, indicating a house pad
and a primary and secondary septic system location. The City Engineer also suggests that
the boundary line between the two parcels be straightened in order to simplify the legal
descriptions.
The Park and Recreation Commission reviewed this request for park dedication purposes at
its April l0th meeting. The Commission recommended cash dedication for one lot.
Recommendation
Staff recommends that the City Council approve the Administrative Subdivision request by
Bob and Terri Bostrom to create one buildable lot with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED.
A REVISED CERTIFICATE OF SURVEY INDICATING A BUILDABLE
SITE AND PRIMARY AND SECONDARY SEPTIC SITES SHALL BE
SUBMITTED.
3. THE APPLICANTS SHALL PROVIDE THE REQUIRED DRAINAGE
AND UTILITY EASEMENTS.
PARK DEDICATION FOR ONE SHALL BE PAID PRIOR TO
RELEASING THE ADMINISTRATIVE SUBDIVISION FOR
RECORDING.

Dear Ms. McPherson:
As requested, we have reviewed the proposed administrative subdivision for Bob and
Terri Bostrom. The Certificate of Survey we reviewed was prepared by Bogart Pederson
and Associates, Inc., and was dated March 19, 2002. Based on our review, we would
offer the following comments:
I have researched the original file for the M-Vale Addition of which this area was
originally a part. One of the conditions on that 1986 subdivision was that 196-1/2
Avenue not exceed 500 feet, which was the cul-de-sac maximum length at that
time. That is why this area was not subdivided at the time of the M-Vale plat.
Since that time, this area has gone through one administrative subdivision. The
currently proposed administrative subdivision is to divide Parcel A into two lots, one
with an existing home on it and a new 2.5-acre parcel.
A large portion of the newly created parcel is covered by wetlands and
incorporated into a drainage easement. There is also a Northern Natural Gas
Company easement which crosses the newly created parcel. It is unclear from the
information that was provided whether or not the remaining area in the newly
created parcel is sufficient for a building site and a primary and secondary septic
location. Additional information needs to be provided relative to the buildable area
of the newly created parcel to ensure that it can support the home plus septic
systems.
Both legal descriptions for the original parcel and the newly created parcel have a
line which reads, "Subject to an easement of undefined width for County ditch
purposes along westerly boundary." The surveyor should discuss this issue with
the County and show a defined easement on the Certificate of Survey. Depending
on the width of the easement, it may affect the buildable area in the newly created
parcel.

The proposed boundary line between the two parcels takes a sharp jog as it
approaches 192-1/2 Avenue NW in order to accommodate 160 feet of width at the
setback line for the remnant parcel. With the presence of the existing home and
the Northern Natural Gas easement, we would suggest that the line between the
two parcels could actually be a straight line without the jog for ease of identifying a
boundary line between the two parcels.
The Certificate of Survey needs to provide the new legal description for the
remnant tract. Currently, the only descriptions contained on the Certificate of
Survey are the existing parcel and the newly created parcel. In addition,
descriptions of the drainage and utility easements required around the perimeter of
the two tracts are also needed.
