I MEMORANDUM TO: Mayor and City Council FROM: Chris Leeseberg, Planner DATE: March 18, 2002 SUBJECT: AS 02-01 Request by Ruth Moos for an Administrative Subdivision Request The Ruth Moos estate is requesting an Administrative Subdivision to create 3 parcels, two of which will be vacant. Location Southeast corner of County Road 32 (Meadowvale Road) and Pascal Street 20192 Meadowvale Road NW Zoning/Land Use Rla (Single Family Residential) / LR (Low Density Residential) Attachments · Location map · Survey · Memo from City Engineer Analysis The subject property is located at the intersection of County Road 32 and Pascal Street. It is 7.7 acres with an existing homestead located on the property with access to County Road 32. The proposed subdivision will create three parcels; one for the existing home, and two parcels which will be buildable with access to Pascal Street. The northwest 2.5-acre lot (Lot 1) will have frontage on both Pascal Street and County Road 32. It will not be allowed to have access to the County Road. The southwest 2.5-acre lot (Lot 2) will front on Pascal City Council March 18, 2002 Page 2 Street. The east 2.71-acre lot (Lot 3), which is the location of the existing homestead, fronts on County Road 32, and will maintain its current access there. Park and Recreation The Park and Recreation Commission recommended that the City accept cash dedication for the two vacant lots. Drainaee and Utilities The City Engineer's memo addresses site drainage and utilities. Recommendation Staff recommends that the City Council approve the Moos Administrative Subdivision with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADRESSED. 2. Box 490 Elk River, MN 55330-0490 RE: MOOS ADMINISTRATIVE SUBDIVISION Dear Mr. Leeseberg: As requested, we have reviewed the Ruth E. Moos Estate Administrative Subdivision of the piece of property located in the southeast quadrant of County Road 32 and Pascal Street NW. Based upon our review and comments received at the staff review meeting, we would offer the following comments: The property appears to be approximately 7.7 acres and is proposed to be subdivided into three parcels, one containing the existing home which will access directly onto County Road 32, and two others which will front on Pascal Street, one having frontage on both Pascal and County Road 32. Any development on the two new lots should be required to provide their access onto Pascal Street. Therefore, the administrative subdivision should provide access control along the County Road 32 frontage of Lot 1. At the staff review meeting, Mr. Dick Corbin from Sherburne County indicated that the County needs 50 feet of right-of-way along County Road 32, and that right-of- way needs to be provided in fee title. If the plat is changed to provide the County Road 32 right-of-way in fee title, there will not be sufficient area to create two additional lots of 2.5 acres each. In fact, Lot 3 that the existing home sits on will be under 2.5 acres in size if the 50-foot right-of-way for County Road 32 is subtracted. However, whether the right-of-way is given in fee title or easement does not affect the buildable area of the lots. Therefore, this may be an appropriate place for a lot size variance. There is no indication whether or not there are any wetlands on the site. There is also no information provided that can be used to determine whether the two created lots are buildable. Additional information should be provided such as spot elevations or topography along with building site locations and primary and secondary septic system locations. 4. Easements will be required along all property lines according to the City ordinance.
