This preliminary plat included replatting Lots 3-5, Block 1, Elk River Crossing and Lot 2, Block 1, Elk River Crossing 2nd Addition from 4 lots into 7 lots. The newly created lots will range in size from .91 acres to about 1.75 acres. Outlot A will have to be platted prior to development. It is possible that Outlot A could be platted into 2 or 3 lots. Access to Lot 1 is restricted to the existing shared access with Jiffy Lube and the Conoco convenience store and a shared access with Lot 2. Shared driveways should be considered when possible on the remaining lots. The existing drainage and utility easements along the current property lines will have to be vacated. There is a 40 foot wide easement that extends from the lift station to Zane Street that will have to remain in place. New easements will be located along the proposed property lines. Recommendation Staff recommends that the City Council approve the final plat for Elk River Crossing Third Addition with the following conditions: 1. All comments of the City Engineer shall be addressed. 2. Access to Lot 1 shall be restricted to the existing shared driveway and a shared access with Lot 2. Shared access shall be required on the other lots. o The existing easements on the current property line shall be vacated, except for the 40 foot wide easement that extends from the lift station to Zane Street, and new easements shall be dedicated along the proposed property lines. Box 490 Elk River, MN 55330-0490 RE: ELK RIVER CROSSING THIRD ADDITION FINAL PLAT Dear Mr. Harlicker: As requested, we have reviewed the final plat of Elk River Third Addition. Based on our review, we would offer the following comments: As you are aware, this is the replat of some existing lots along Zane Street in the Elk River Crossing Addition. Prior to approving and filing this plat of Elk River Crossing Third Addition, the existing drainage and utility easements need to be vacated from the underlying plat. 2. Limited access needs to be shown along the TH 169 frontage. The 10-foot wide drainage and utility easements along the Zane Street and TH 169 frontage need to be continued through Outlot A. At the north end of Lot 1, there is existing public sanitary sewer and watermain that was extended in when the Wash 'N Fill was constructed. We believe there may be a wider easement for these public utilities that affects the width of the easement on the north lot line of Lot 1, Elk River Crossing Third Addition. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Development Plan. The physical characteristics of the site, including , but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. Do The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. The proposed subdivision will not cause substantial environmental damage. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded.
