Overview
On December 17, 2001 the Council approved the preliminary plat for Trott Brook Farms
South. This plat includes 149 dwelling units (19 single family units and 130 townhouse units)

on 41 acres. On February 19, 2002 the Council approved the preliminary plat for Trott
Brook Crossing. Trott Brook Crossing is a 32 acre residential development south of Trott
Brook Farms South. It is a similar type of development with the same mix of residential
units; there are 103 dwelling units (21 single family units and 82 townhouse units). The
developer is proposing to combine these two projects into one. The plat will be called Trott
Brook Farms South. At this time the developer is proposing to final plat sections of both
projects.
Layout
Lots
The first addition of this plat includes 126 condominium style townhomes and 30 single
family units. Future additions will include additional single family lots and rambler style
townhomes. The single family lots are located along Street C and the townhouse lots are
located along Streets A, B and D. The proposed final plat is consistent with the approved
preliminary plats of both Trott Brook Farms South and Trott Brook Crossing.
There are 7 outlots included with this plat. The outlots will have to be platted in future
additions in order to be developed. Outlot A, located east of Street B and south of County
Road 12, will serve as the main entrance to the project. Outlot D will be a trail connection to
Hillside Park. If future additions are consistent with the approved preliminary plats, Outlots
B, C, E and F will be platted as rambler style townhomes and Outlot G will be platted as
single family lots.
Streets
All the streets constructed with this first phase will be public streets. Future phases will
include several private streets. Street A will terminate in a cul de sac. The cul de sac shown
on the final plat will have to be partially located on adjacent property. To do this the
developer will have to either purchase the property or get an easement. If the developer is
unable to acquire the necessary property or easement, the cul de sac will have to be shifted
to the south and east and located entirely on their property.
Grading, Drainage and Utilities
The City Engineer will address grading, drainage and utilities in his memo.
Landscaping
The developer will have to submit a landscape plan that complies with the landscape
ordinance. A detailed landscape plan for the townhouse portion of the development will also
be required.

The Park and Recreation Commission recommended cash to meet the park dedication
requirements. A trail connection to Hillside Park will be provided through Outlot D.
Sidewalks will be provided on one side of each of the public streets.
Recommendation
Staff recommends that the City Council adopt Resolution No. 02- granting final plat
approval for Trott Brook Farms South with the following conditions:
I. ALL COMMENTS OF THE CITY ENGINEER SHALL BE
ADDRESSED.
THE CUL-DE-SAC ON STREET A SHALL BE RELOCATED TO BE
ADJACENT TO THE BLACK PROPERTY UNLESS THE
NECESSARY LAND OR EASEMENT IS OBTAINED FROM THE
BLACKS SO THAT THE CUL DE SAC CAN BE PARTIALLY
LOCATED ON THE BLACK PROPERTY.

8. THAT THE MAILBOXES SHALL BE CLUSTERED.
ANY ADDITIONAL ARTIFACTS THAT ARE FOUND DURING ANY
PHASE OF THE PROJECT SHALL BE REPORTED IMMEDIATELY
TO THE CITY AND SHPO. THE CITY BUILDING AND
ENGINEERING INSPECTORS SHALL HAVE THE ABILITY TO

TO GRANT CREDIT FOR EXISTING TREES TO BE SAVED.
21.A HOMEOWNERS ASSOCIATION SHALL BE ESTABLISHED FOR

27. THE COST OF SAID RESTORATION IS COVERED IN THE LETTER

Dear Ms. McPherson:
As requested, we have reviewed the final plat of Trott Brooks Farms South. This is actually the
combination of Trott Brook Farms South and Trott Brook Crossing. Based on our review, we
would offer the following comments:
1. The plat does not have street names at this time. It still refers to streets by letters. Actual
street names will have to be placed on the final plat before recording.
2. The cul-de-sac required at the north end of Street A is shown to be partially built on Trott
Brook Farms South and partially built on the Black's property. The Developer should
either provide an easement from the Blacks to indicate that they can complete the
construction of the cul-de-sac, or perhaps a better option would be to include that portion
of the Black's property in the final plat.
3. Outlot A of Elk River Crossing Addition, which was attached to Trott Brook Farms South,
has a northerly extension adjacent to the Black property. We would suggest that
consideration be given to giving this northerly extension to the Blacks in exchange for the
necessary area to complete the cul-de-sac on Street A. This northerly extension does not
serve any particular purpose in Trott Brook Farms South, and would "square off" the Black
property for future redevelopment.
4. Between Outlot A and Outlot B of Elk River Crossing there is a 60-foot right-of-way for
179th Avenue. This is not going to be needed with the development of Trott Brook Farms
South and should be vacated. This will require a separate vacation procedure.
The final plat is showing drainage and utility easement covering the entire common Lot 5
and also a 10-foot drainage and utility easement adjacent to the street. These two are
redundant. If the entire outlot is covered by a drainage and utility easement, there is no
need to give a separate 10-foot easement adjacent to the street.

The third page of the final plat appears to have forgotten the drainage and utility easement
covering the entire common area of Lots 7, 8, and 9. If these are added again, the 10-foot
drainage and utility easements adjacent to the street are redundant.
The 10-foot drainage and utility easement around the perimeter of Outlot G is
unnecessary. This can be provided when the outlot is final platted. It should be noted that
the alignment of a street through Outlot G and where it ultimately hits the south boundary
of Trott Brooks Farms South is still unresolved. This does not need to be resolved at this
point in time, but will need to be resolved prior to final platting of Outlot G.
The 10-foot drainage and utility easement along the perimeter of Outlot F should continue
all the way to the south plat boundary into the United Power Association easement.
The final plat is showing an area in the southwest corner that would be part of the Tyler
Street right-of-way. It was our understanding that this right-of-way was taken in fee title.
Apparently, the document could not be found at the County or was never properly
recorded. In any case, this area should be platted as the Tyler Street right-of-way to clean
up this issue.
There appears to be something wrong with the dedication of Outlot D. It is our
understanding that Outlot D is to serve as a trail corridor between Trott Brook Farms South
and Hillside Park to the east. This should be reviewed and corrected, if necessary.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Trott Brook Farms South
Case No. P 01-14
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on December 17, 2001 and February 19, 2002; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as

The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
The physical characteristics of the site, including , but not limited
to, topography, soils, vegetation, susceptibility to erosion and

type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.

damage.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member Kuester and
