SUBJECT: Request by City of Elk River for Sale of Excess Property-
Public Hearing
Request
The City Council is asked to conduct a public hearing to consider an exchange of property
with D. R. Horton.

Analysis
As was discussed with the City Council at its February 11th meeting, the City is considering a
land exchange with D.R. Horton of Outlots A and B - Elk River Crossing, Outlot B - Elk
River Business Park, and the remnant from the George Deschenes property.
Prior to disposition of publicly owned land, the City is required to conduct a public hearing.
The Planning Commission at its February 26, 2002 meeting reviewed the request for
consistency with the Comprehensive Plan and found that the request is consistent. The Park
and Recreation Commission supports the land exchange with D.R. Horton, as they would
obtain a parcel of land they have been interested in for park purposes (Outlot K, Trott
Brook Farms.
Recommendation
Staff recommends that the City Council conduct a public hearing and take testimony from
the public. The contract for the exchange of land will be scheduled for approval by the
Council at a later date.
