TO: FROM: DATE: SUBJECT: Mayor and City Co/,~ci~ Michele McPherso'n;"Director of Planning January 16, 2001 Holt & Jackson Proposal Request At its October 16, 2000 meeting, the City Council reviewed a preliminary proposal for a retail facility at the Holt and Jackson site. Staff received direction to continue working with the developer, HJ Development, on plans with the intent to sell the property. Attachments · Location map · Colored rendering · Site plan · Landscape plan · Lighting plan · October 25, 2000 Elk River Star News article · Permitted and Conditional Uses, C-4 District Analysis Staff has received a formal site plan review application for a 14,000 sq. ft. retail facility for the Holt and Jackson property. Staff has not completed its formal review of the proposal, however, the Council had directed staff that they would like to see the site plan prior to the closing date on the project. Preliminarily, staff has made the following determinations: The building will be 14,100 sq. ft. The site provides 82 parking stalls, 12 more than required by Code. The landscape plan meets the ordinance requirements, however, staff is suggesting and the developer is agreeable to providing additional evergreen plantings to increase screening for the properties across Holt Street. 13065 Orono Parkway · P.O. No lights will be located on the residential side of the site. The proposed light standards will be 25' in height, 5' taller than the proposed building. · The proposed building will be constructed of rock-face block brick, artificial stucco and standing seam metal roofs in an earth-tone color palette. The developer has submitted sign criteria for the tenant spaces which staff has reviewed and which complies with the Ordinance. A free-standing sign is also proposed adjacent to the Highway 169 right-of-way, however, no details have been provided. The maximum height of the free-standing sign may be 20 feet with a maximum area of 100 feet. Uses Currently, the only tenant to commit to the facility is Simonson's, a day spa, which is a permitted use within the C4 Neighborhood Commercial district. Attached is a list of permitted and conditional uses allowed within the district. The developer is speaking with a number of potential tenants including a meat retailer, sandwich shop, coffee shop and other similar uses. With the exception of restaurants, the tenants the developer is courting would be permitted without the need for a conditional use permit. This item has been brought to the Council for informational purposes. The developer, Gary Janish, will be attendance at Monday evening's meeting to provide additional information or answer any questions the Council may have. The Elk River City Council approved a proposal last week from H.J. Development to purchase the city-owned Holt and Jackson site for $350,000. H.J. Development plans to construct a 13,000-square- foot retail facility on the site in order to house several busi- nesses. Simonson's Day Spa has committed to leasing 5,500 square feet of space and will be the building's anchor ten- ant. The remaining space will be divided into small bays and will most likely house a bagel shop or similar businesses. Construction for the facility is slated to begin in March or April of 2001. "I think this is a good fit," Vice Mayor Paul Motin said of the plan. Although generally in favor of the proposal, the council did voice some concerns. One of H.J. Development's pur- chase contingencies was that the undevelopable northerly portion of the site be donated to the city to be used as park or green space. This portion of land is difficult to police and the developer does not want to be liable for question- able activities that may occur in this area. At the recommendation of Michele McPherson, director of planning, the city added a condition to the proposal stat- ing that it would not accept the northerly piece of proper- ty. McPherson does not feel that the city should willingly assume liability for the prop- erty. Motin raised a concern about what would happen if the plans to lease space to Simonson's did not material- ize. ~What happens if (Simonson's) backs out of the deal?" Motin asked. "I don't want it to be a Denny's-type restaurant. We're in a strange situation. When the city does own the property, we can be a bit more choosy." City Attorney Peter Beck said the city could either put a restrictive covenant on the property or rezone it as a planned unit development. McPherson noted that any prospective restaurants would require a conditional use permit. The H.J. Development pur- chase proposal was the fifth proposal for the site made in the past 18 months. Two of the previous proposals were for restaurants, and the other two were for an office building and a day-care center. None of these proposals materialized due to problems with design requirements. storm sewer, and municipal water must be available and hooked up in order to occupy the particular business. A.
