Location The subject property is located at 13390 Ranch Road, Elk River, Minnesota 55330. Legal description of the property is the Southwest Quarter of Section 8, Township 33, Range 26. The administrative subdivision would create three parcels: Parcel A - 2.5 acres Parcel B - 2.5 acres Parcel C - 5.97 acres 13065 Orono Parkway · P.O. A 240' Northern States Power utility easement crosses the parcels adjacent to County Road No. 33. The subject property is high and, based on aerial photo interpretation, appears to have been farmed in row crops on a regular basis. The proposed lots meet the dimensional requirements for lot width and area for the Rla, Single Family Zoning District. County Access Requirements Sherburne County Public Works has reviewed the administrative subdivision and has indicated that the proposed 50 feet of right-of-way dedication will meet the County requirements. This right-of-way will need to be granted in fee title to Sherburne County. They have also required, in their letter, that Parcels A and B share a single driveway. Staff would recommend that cross-access easements be recorded against Parcels A and B, acknowledging a shared driveway onto County Road No. 33. The City Engineer has reviewed the administrative subdivision and has observed that the existing home does not comply with the setback requirements and therefore, would be nonconforming. To correct this situation, a variance would need to be granted or the property owner would need to acknowledge that if the home were to be damaged beyond 50 percent of its value, it could not be rebuilt in its current location without a variance. Park Dedication/Storm Water Manaqement Fees The Park and Recreation Commission, at its January 10, 2001 meeting, recommended that cash dedication be accepted for this subdivision. Surface water management fees at the rural rate will be required to be paid. Recommendation Staff recommends that the City Council approve the administrative subdivision request AS 01-01, to create three parcels in the Rla Single Family Residential zoning district, with the following conditions: 1. The dedication of 50 feet of right-of-way shall be completed in fee title. 2. The applicant shall pay Park Dedication fees for two parcels. 3. The applicant shall pay Surface Water Management fees for two parcels. 4. The applicant shall execute Grant of Easement Agreements for drainage and utility easements over the parcels. Box 490 Elk River, MN 55330-0490 RE: MILT TUTTLE ADMINISTRATIVE SUBDIVISION Dear Ms. McPherson: As requested, we have reviewed the administrative subdivision for Milt Turtle. The document was prepared by Meyer-Rohlin, Inc., and was dated November 30, 2000. The administrative subdivision divides one large parcel into three smaller parcels, two of them 2.5 acres in size and the larger one approximately 6 acres. Based on our review, we would offer the following comments: The administrative subdivision shows a dedication of 50 feet of right-of-way for County Road 33. This administrative subdivision should be reviewed by Sherburne County to ensure that this 50-foot dedication is adequate and also for their comments regarding driveway locations. We are reasonably confident that Sherburne County will require joint driveway access for two of these lots. It appears that the house located on Parcel C is too close to the property line. If this building has not received a vadance in the past, it will require a vadance with this administrative subdivision. We have talked with Meyer-Rohlin regarding the legal descriptions for the parcels. We have suggested to them that the legals be rewritten because in their current state, they are rather vague. We required 17 feet of additional of right of way, be granted in fee title (for a total of 50 feet) and that parcel A and B share access on their common lot line. We offer no comment on the plats for Fox Haven and Ridges of Rice Lake or the plan for Elk River Muffler and Brake. Sherbume County does not oppose the access for Twin Lake Townhomes 2"4 Addition. An access permit will be required with the following conditions: 1) The access must align with the proposed Trott Brook access. 2) Right and left turn lanes with necessary length and dimension. 3) Make required pavement marking changes. 4) Pay the signage fee required to bring this segment up to standard.
