TO: FROM: DATE: SUBJECT: Mayor and City Council Scott Harlicker, Senior Planne~" February 20, 2001 Northstar Corridor Update At the NCDA meeting held on February 1st, the main item discussed was the attached letter from MnDOT dated January 5, 2001 in which MnDOT states that it is taking over control and project management of the Northstar Corridor commuter rail project. At this meeting the Commissioner of Transportation, Elwyn · Tinklinberg, explained that since MnDOT will ultimately be responsible for financing and operations, it was time for them to take control of the project. The NCDA adopted a resolution that gives MnDOT decision making control as of June 1, 2001. The NCDA will continue in an advisory capacity as a Commuter Rail Corridor Coordinating Committee (CRCCC). MnDOT will be advising the NCDA on it's role as a CRCCC. The Council is also being asked to adopt the attached resolution which approves the preliminary layout of the park and ride facility. The resolution includes conditions that MnDOT continue to work with the City on final design, that the final layout include landscaping and improved pedestrian access to be approved by the City, and that MnDOT work with the City on the timing of each phase. The preliminary plan is to be phased. The first phase includes a parking area for 311 cars and bus pick-up and drop-off area. The first phase will be located at the front of the site, along Twin Lakes Road. Improvements will include landscaping along the street, bituminous curbing and the construction of the stormwater pond. Construction should begin this year. The second phase will include upgrading the first phase and expansion of the parking area. The second phase will be timed so that it is coordinated with the construction of the commuter rail station. MnDOT is also working with the developer of the remainder of the Eull property (Elk River Station) on integrating design elements of Elk River Station with the final design of the park and ride. Executive Committee Report: a) Ken Stevens reviewed responses to the City Resolutions on the Advanced Corridor Plan. b) A motion was made by Paul McCarron, seconded by Duane Cekalla and carried unanimously to approve the recommendation of the Executive Committee that the Mn/DOT Commissioner and NCDA submit to the Metropolitan Council and St. Cloud APO the Advanced Corridor Plan, the resolutions from the cities and comments from the Counties, and the response from Mn/DOT and the NCDA. c) A motion was made by Bob Johnson, seconded by Patrick Cairns and carried unanimously to approve the recommendation of the Executive Committee that the NCDA advance the 2001 contract start date for Mainline Management and the NCDA agreement in order to continue capacity modeling and BNSF negotiations. d) A motion was made by Art Daniels, seconded by Lewis Stark and carried unanimously to approve the year end adjustment of the NCDA 2000 budget as set forth in the table dated 11/13/00, totaling $19,750,000 and the 2001 projected budget at $23,235,000. e) Paul McCarron gave an update on the Metropolitan LRTJPB's request to the Legislature which includes a funding request which supports the NCDA funding request totaling $119 million. Two firms (Himle Hornet, Inc. and Padilla, Speer, Beardsley) responded to the RFP for Public Information Services. A motion was made by Paul McCarron, seconded by Duane Cekalla and carried unanimously to approve the recommendation of the Project Management Team to award the RFP to Himle Homer, Inc. for professional services to conduct public information and participation activities and authorize the Chair to finalize negotiations and execute a contract in an amount not to Page l exceed $250,000 for services and expenses with a term of January 1, 2001 through December 31, 200 I. NCDA members asked that members and staff give updates to the general public on the progress of the Northstar Corridor Project by speaking at rotary club meetings and meetings of other civic organizations. Two firms (URS/BRW and TKDA) responded to the RFP for engineering and desi=on services for Multi-Modal Facilities to be located in the City of Ramsey and the City of Coon Rapids (Riverdale). A motion was made by Bob Johnson, seconded by Duane Cekalla and carried unanimously to approve the recommendation of the Project Management Team to award the RFP to URS/BRW for the engineering and desi=o-n services for multi-modal facilities to be located in the City of Ramsey and the City of Coon Rapids (Riverdale) and recommend that the Anoka County Regional Railroad Authority execute a contract in a amount not to exceed $100,000 for services and expenses with a term of December 12, 2000 through March 30, 2001. o An updated was presented by Tim Yantos on BNSF negotiations. Mr. Yantos noted that capacity improvements need to be agreed upon as soon as possible. PAUL, Minn.--The Minnesota Department of Transportation today supported Gov. Jesse Ventura's request for funding of the Northstar rail project in the state's capital budget. Mn/DOT and the Northstar Corridor Development Authority are working together on the Northstar project that will link Minneapolis with St. Cloud. "Governor Ventura's inclusion of the Northstar rail project represents a major step forward for the project and for creation of a passenger rail system to serve the region's growing need for rail transit," said Elwyn Tinklenberg, commissioner of transportation. The capital budget includes $115 million from the state of Minnesota to design and construct the commuter rail line as well as its multi-modal connection with the Hiawatha light rail transit line in downtown Minneapolis. "Some of the money we are requesting from the Legislature will be matched by the federal government," said Gov. Ventura. "We intend to see an integrated, -regional commuter rail system that will ease congestion throughout the seven-county Twin Cities metro area." Mn/DOT expects the total capital cost for this rail project to be $283 million, with 50 percent coming from the federal government. There are currently 4 contracts that expired as of December 31, 2000. I would suggest that we snmultaneously amend these contracts and reassign to Mn.DOT~. This should be done within the next 30 days. There are two additional contracts that need to be reassigned to M. nDOT. I would suggest that these be reassigned to MnDOT by March 15, 2001 and then any amendments would be done by MnDOT. This would allow tlle contracts to mn almost to expiration. We don't have the expiration on the BNSF contract bemuse as of yet we have not received a fully executed copy ~ requested. ha the case of ,Ken Stevens and Mary Richardson--both of those contracts appear to have expired. I would suggest that the contracts not be amended and consequently no reassignment. If you determine that you wish to continue these services you could but the costs would not automatically be covered by the project. A: a minirnu_ng tl~ese services would need to be competitively bid before any consideration for reimbursement in the 10%. Attached is a copy of the contract list which indicates which contracts should be reassigned and which will remain with NC]DA either permanently or we will just let run to expiration. I have indicated on the attachment the six contracts I have listed above. Normally these budgets have a very high level of&tail and take months to assemble but I have asked for a high level breakdo~vn within the next two to thzee weeks so we can issue guidance to you as quickly as possible. As soon as we have that completed I will send that info to you. The PD for Re Project Manager position (indicated on the org chart faxed to you earlier today) is in the process of being rated and will be posted ASAP. We will be looking for rail experience as well as PM and construction experience. As I indicated to you last week--Tim Yantos would work most closely with this potation. As I told you when we spoke last week, the FTA had akeady raised the concern about the role of consultants irt the Northstar project in their letter authorlz, ing Re project to move into PE. I have just been advised that they raised tkis concern in a second letter to Mary Richardson dated September 6, 2000. Tkis is not good. It is imperative that we move quickly to get a handle on the controls of this project quickly and that the controls meet the FTA's requirements. The language I am seeing in these letters is very similar to language used in early correspondence to MnDOT regarding the Hiawatha project. The correspondence referred to in the last paragraph was not addressed to Mary Richardson; it was sent to me as Project Director. The letter discussed in detail the FTA rating of the project. The concern regarding management was a caution to us not to repeat the mistakes made on the Hiawatha Project. On the Hiawatha Project, management consultants participated in the preparation of RFP's and then proposed on the RFP. This activity resulted in a lawsuit. The collaborative structure clearly acknowledges both the statutory authority of Mn/DOT as well as its role as grantee to the Federal Transit Administration. It is the structure contemplated by the governance legislation adopted by the Legislature in 1999 and by the Agreement for Coordination of Commuter Rail Activities as executed by Mn/Dot and the NCDA in Fall, 2000. The proposed structure reflects an oversight role for Mn/DOT and its Office of Passenger Rail. It clearly depicts Mn/DOT's sole responsibility for operations and Mn/DOT's direct relationship with the Federal Transit Administration. The work involved in developing the Northstar Commuter Rail Project would continue to be performed by the NCDA, its staff and consultants, through preliminary engineering, final design and construction. Mn,cDOT staff would participate in all key work activities. The regional railroad authorities, counties, cities and towns that comprise the NCDA would have direct responsibility for the performance of the work, including public information and public involvement, station development and area planning, technical work, BNSF negotiations and the environmental impact statement process. The organizational structure of the NCDA, the Executive Committee, PMT and TAC would remain intact. Rationale 1. The structure ensures the continuing success of the NCDA in maintaining local support for the project. 2. The structure ensures the continuing success of the NCDA in developing commuter rail in a timely and cost-effective manner. 3. The structure reflects the organization contemplated by law and by Agreement Minn. Stat. § 174.82 gives to the Mn/DOT Commission the responsibility for all aspects of developing the commuter rail. The same law authorizes the Commissioner to enter into agreements with joint powers boards (e.g. NCDA) to carry out these activities. The Agreement for Coordination of Commuter Rail Activities (Mn/DOT Agreement #80272.R) provides that the NCDA, in cooperation with and under supervision of Mn/DOT, will: "conduct feasibility studies, planning, preliminary engineering, final design, construction, operational planning and planning of related facilities." (Section 3.4) Mn/DOT Agreement. Number 80272 AGREEM]ENT FOR COORDINATION OF COM]MUTER RAIL ACTIYITI[ES Parties This Agreement is entered into by the Commissioner of the Minnesota Department of Transportation ("Mn/DOT") and Northstar Corridor Development Authority ("NCDA"), a Joint Powers Board for the "Northstar Corridor". NCDA is studying and developing a potential commuter rail corridor. Recitals Mn/DOT is authorized to enter into this agreement by Minnesota Statutes {}174.82; and NCDA is a Joint Powers Board created under, and authorized to enter into this agreement, by Minnesota Statutes {}471.59; and Mn/DOT is responsible, pursuant to Minnesota Statutes {}174.82, for all aspects of planning, developing, constructing, operating and maintaining commuter rail, including system planning, advanced corridor planning, preliminary engineering, final des!gn, construction, negotiating with raikoads and developing financial and operating plans; and Mn/DOT must ensure~ pursuant to Minnesota Statutes § 174.84 (subd. 4), that Commuter rail facilities are planned, designed and implemented in such a way as to move tran.~it users to, from and within the metropolitan area, and to provide a unified, inte~ated and efficient multimodal transportation system with rail transit lines that interface with each other and wkh other transportation facilities; and Mn/DOT has developed and published, pursuant to Minnesota Statutes {}174.84 (subd. 1), the "Commuter Rail System Plan" ("System Plan") to govern and guide development of commuter rail in Minnesota; and NCDA will assist in the implementation of the System Plan and desires to receive federal and state funding through Mn/DOT for activities conducted pursuant to the System Plan; and M.nTDOT and NCDA will c6ordinate commuter rail activities in such a manner as to permit Mn/DOT to perform its statutory responsibilities; and MnTDOT and NCDA will coordinate commuter rail activities in such a manner as to enable commuter rail projects to qualify for and receive federal funding. The Paroles Agree as Follows: A~reement 1.2 TerTrl This agreement is effective upon execution and approval by appropriate NCDA, Mn/DOT and State of Minnesota officials, and will remain in effect until it is terminated by either the mutual assent of all parties or pursuant to article 1.2. Tkis agreement, or a party's participation in this agreement, may be terminated as follows: A: NCDA may terminate its participation in this agreement by giving 60 days written notice to Mn/DOT. Dissolution of NCDA pursuant to applicable law will be deemed a termination of NCDA's participation in this agreement. B. Mn/DOT may terminate this agreement on 60 days written notice to NCDA. 2. Designation of Mn/DOT as Lead Agency, Mn/DOT Duties Pursuant to Minr~esota Statutes section 174.82-, Mn/DOT is the Lead Agency for all commuter rail activities. As such, Mn/DOT's duties and responsibilities are to: 2.1. Ensure consistency in commuter rail activities and to coordinate commuter rail activities with regional transit plans developed by the Metropolitan Council and the St. Cloud Metropolitan Planning Orgarfization. Seek state and federal funding, including federal "full funding" grants, for commuter mil activities. Be the recipient and grantee of all state and federal funding, including federal "full funding" grants, for commuter rail activities. - Be the Responsible Governmental Unit, in parmershil~ with NCD& for l:iurposes of all Environmental Impact Statements related to commuter rail activities. 2.4 Negotiate with railroad companies for the use of milroad facilities and services necessary for commuter rail activities. 2.5 Review, for conformance with the System Plan, and approve each stage'of NCDA's commuter raiI planning, including I) feasibility studies, 2) planning, 3) preliminary engineering 4) final design, 5) construction, and 6) operational planning, including acquiring rolling stock 2.6 Respond to requests for approval submitted by NCDA, pursuant to article 3.7 of this agreement, no later than 30 days after receipt of the request. 2.7 Designate a Mn/DOT official to serve as a non-voting advisor to NCDA's "executive committee", or equivalent policy committee responsible for planning and developing commuter rail. 2.8 Designate a Mn/DOT official to serve as a non=voting advisor to NCDA's "technical advisory committee", or equivalent technical committee, responsible for overseeing the engineering, specifications and other technical aspects of commuter rail. 2.9 Provide NCDA with standards, forecasting models and other relevant data. applications and planning tools which will promote uniformity in corridor planning. 2.1 '2.2 2.3 2.10 Review, for conformance with the System Plan, and approve, disapprove or modify plans for commuter rail-related facilities, including stations, park-and- ride lots and interfaces to other modes of transit. 2.11 Monitor work conducted by NCDA so that corridor planning, design and construction is consistent with system integration, and to ensure that it is in compliance with federal funding requkements. 2.12 Appoint members to the Commuter Rail Steering Committee, as provided in Article 4 of this agreement. 2.13 Disburse grant funds received by Mn/DOT on behalf of NCDA. 3. Duties Of NCDA NCDA duties and responsibilities, in cooperation with and under the supervision of Mn/DOT, are to: 3.1 Conduct all activities in a manner designed to produce an integrated commuter rail system and to ensure continuing eligibility for federal funding.' 3.2 Permit a designated Mn/DOT official to serve in a non-voting advisory capacity on NCDA's "Executive Committee ", or equivalent policy committee, responsible for planning and development of commuter rail. 3.3 Permit a designated Mn/DOT official to serve in a non-voting advisory capacity on NCDA's "Technical Advisory Committee ", or equivalent technical committee, responsible for overseeing the engineering, specifications and other technical aspects of commuter mil Conduct feasibility studies, planning, preliminary engineering, final design, construction, operational planning and planning of related facilities. 3.5 Adhere to the guidance, requirements and specifications of the .System Plan tn conducting all commuter rail activities, unless a variance from such · gXtidance, requirements and specifications in expressly granted in writing by 3.6 Include and utilize data, planning standards and forecasting models provided by Mzl/DOT 3.7 AtSer completing each stage of the development process, request and receive written approval from Mn/DOT before advancing to the next stage. Prior to executing any sub-consultant agreement, request and receive Mn/DOT's written approval of the proposed agreement. Participate in negotiations with railroads at the request of Mn/DOT. 0 Appoint a member to the Commuter Rail Steering Committee as provided in Article 4 of this agreement 1 Request Mn/DOT's written approval before varying from any of the duties set out in this agreement. 3.8 3.9 3.1 3.1 4. Commuter Rail System Steering Committee 4.1 Mn/DOT has established and utilized the Commuter Rail System Steering Committee CCommirtee') to develop the system plan. As recommended in section 2.3 of the system plan. Mn/DOT will continue to use the Committee as a review board for maintaining the system plan 4.2 The Committee reports to and advises Mn/DOT and Mn/DOT will manage the functions and operations of the committee. The Committee serves in an advisory capacity and its recommendations are not binding upon Mn/DOT. Mn/DOT may accept, modify or reject the Committee's advice as k deems appropriate. 4.3 The Committee will meet regularly and will advise M,n/DOT on: A. The overall coordination of commuter rail activity to ensure that the commuter rail corridors are an integrated part of a multi-modal transportation system. B. Establishment of technical standards for the commuter rail system. C. Methods for providing commuter rail information to local governments and the citizens of Minnesota. ' D. The publication of necessary updates to the System Plan to maintain its vitality as a "living document". E. Timing and scheduling issues, to coordinate commuter rail lines with each other'and with other modes oftransporzafion. F. The development and use of related facilities such as maintenance shops, park and ride lots and interfaces with other modes of transportation. 4.4 The Committee will consist of the following members: A. One member appointed by NCDA. B. One member appointed by the Metropolkan Council. C. One member appointed by the St. Cloud Metropolitan Planning Organization. D. Representatives appointed by, or as invited to participate by Mn/DOT, through its Commissioner. 1. One Mn/DOT employee, who will serve as committee chair; 2. Other representatives of Mn/DOT, as deemed appropriate; 3. One representative of the Council on Disabilities; 4. House and Senate Transportation Committee staff; 5. One representative of the railroad industry; 6. One representative of a railroad labor organization; 7. ·Such others as may be required by law; 8. Such others as are deemed appropriate. 4.5 The Committee will continue to operate for the purposes set out above for as long as Mn/DOT deems such operation appropriate. 5. Compliance With Federal Funding Requirements To ensure receipt of all available federal funds for commuter rail, Mn/DOT and NCDA will, individually and collectively, conduct all commuter rail activities in compliance with applicable federal laws and regulations. NL-u/DOT and NCDA agree to align the commuter rail planning and programming process to follow the Federal Transit Administration's "New Starts Criteria," as defined in 49 USC § 5309. 6. Compliance With Other Agreements Nothing in this agreement is intended, nor will be construed to, relieve NCDA of any obligation k has or will have under any other grant or agreement with Mn/DOT. To the extent this agreement conflicts with any other agreement between the parties, this agreement will control over and supersede the terms of any such agreement, unless precluded by law 7. Mn/DOT Program Costs, Management Fee 7.1 Mn/DOT will provide the resources necessary to execute its obligations under this agreement, the system plan and applicable statutes. In executing its obligations, Mn/DOT will incur costs including, but not limited to: A. Salaries and benefits of Mn/DOT employees assigned to manage commuter rail programs; B. Necessary miscellaneous program management expenses incurred by Mn/DOT, including office supplies, printing and travel; C. Expenses of consukants engaged to carry out program management, engineering and planning tasks; D. Expenses of consultants engaged to conduct or assist with railroad negotiations. 7.2 A Mn/DOT Management Fee will be included, as an element of grant applications and program budgets associated with the Northstar Corridor, to cover all costs incurred and estimated to be incurred in the execution of Mn/DOT's obligations under Article 7.1. The following Specified Funds are subject to the Management Fee, regardless of whether the Specified Funds are received directly by NCDA or by Mn/DOT, acting as NCDA's agent: .4,. Federal funds appropriated by an act of Congress; B. Grant funds received fi-om any agency of the United States Government; C. State funds appropriated by an act of the State Legislature; D. C_.¢rant fuiids received fi-om any agency or department of the State of Minnesota. 7.3 NCDA and Mn/DOT shall negotiate in good faith the amount of the Management Fee, taking into account the scope of work to be accomplished by each party during the stage of commuter rail development covered by the grant agreement and Mn/DOT's program costs as provided in Article 7. I. 7.4 NCDA and Mn/DOT agree that Mn/DOT will apply for, receive and disburse state and federal funds. NCDA and Mn/DOT further agree that a Management Fee will be included as an element of grant applications to the Federal Transit Administration CFTA). M.n/DOT will, as necessary, seek required matching funds from state appropriations or other appropriate funding sources. 7.5 Unexpended Management Fees will remain with the Northstar Corridor Commuter Rail Project to the ex'rent this conforms to applicable federal and state laws, regulations, rules, and standard government accounting practices and procedures. 7.6 Under Minnesota Statutes section I6C.05, subd. 5, each party's books, records, documents and accounting procedures and practices retevant to this agreement are subject to .examination by the Mn/DOT Audkor, State Audkor and Legislative Audkor, as appropriate, for a minimum of six years from the end of this agreement. Mn/DOT will maintain records of its Program Costs and the application of Management Fees to such costs, and will provide NCDA an annual accounting upon request. 8. Dispute Resolution 8.1 If any dispute arises .conce. rning a topic covered by this agreement, the parties will use their best eft'om to resolve the dispute in as informal and cost-effective a manner as po.ssible. Before proceeding to the dispute resolution process outlined in Article 8.2, the parties will meet and will use their best efforts to resolve the dispute. If discussion between the parties does not result in a mutually acceptable solution, the parties may use the procedure outlined in Article 8.2. 8.2 If a dispute arises concerning the interpretation or application of the guidance, requirements or specifications contained in the System Plan, or a dispute arises concerning NCDA's financial obligation to lVln/DOT under Article 7 of this agreement, the parties may resolve the dispute as follows: A. If the dispute involves interpretation or application of the system plan to any aspects of planning, developing, constructing, operating or maintaining commuter rail, includ!ng system planning, advanced corridor plannin~ preliminary engineering, final design, construction, negotiating with raikoads or developing financial and operational plans, then: I. A part7, must provide notice to the other party identifying the dispute, its position relative thereto and the reasoning for that position. 2. The party-receiving the notice will provide a written response no later than 21 days after receipt of the notice. 3. No later than 14 days a.,,ier receipt of the response, the parties will meet with a neutral facilitator, who will be appointed by Cornmissioner of Transportation or his designee, and approved by NCDA. The neutral facilitator may be any person mutually aD'eed upon by the parties and may be a State ofM. innesota employee, employed by an agency other than MaffDOT. The. parties will, with the assistance of the neutral facilitator, seek a mutually satisfactory solution. The parties to the dispute will pay equal shares of the Neutral Facilitator's costs. 4. IX'the parties are unable to resolve their differences, the neutral facilitator will declare an impasse. 5. No later than 14 days after a declaration of impasse, the parties will meet with the Commissioner of Transportatiork or his designee. Each party will have an equal opportunity to present its position. After the parties have presented their positions, the Commissioner, or his designee, will issue a memorandum of decision to resolve the issue. This decision will be binding on the parties. If the dispute involves NCDA's financial obligation to Mn/DOT under Article 7 of this agreement, then: 1. ,4. party must provide notice to the other party identifying the dispute, its position and the reasoning for that position. 2. The party receiving the notice will provide a written response no later than 21 days of receipt of the notice. 3. 1'4o later than 14 days of the receipt of the response, the party will meet with a mediator appointed by the Commissioner of Transportation or his designee and approved by NCDA. The mediator may be a State of Minnesota employee, employed by an agency other than MmIDOT. The mediator will assist the parties in reaching a mutually satisfactory settlement of the dispute. The pardes to the dispute will pay equal shares of the'Mediator' s costs. 9. Governing Te'rms 9.1 The provisions of this agreement are severable. If any part of this agreement is determined by a court of competent jurisdiction to be contrary to law, or contrary to any rule or regulation having the effect of law, such determination will not affect the remaining portions of this agreement. 9.2 M. innesota law governs this agreement. Venue for ali legal prqceedings arising from this agreement will be in the appropriate state or federal court of.competent jurisdiction in Kamsey County, Minnesota. 9.3 YLniDOT's failure to enforce any provision of this agreement does no~.operate as a waiver of its right to subsequently enforce that provision. 9.4 This agreement contains all negotiations and agreements between the ponies. No other understanding regarding the subj ecl matter of this agreement, whether written or oral, rSay be used to bind any parry. 9.5 Any amendment to this agreement must be in writing and wiIl not be effective until it has been executed and approved by the same parties who executed and approved this agreement, or their successors in office. 10. The cost effectiveness indices are useful to the FTA in its process of ranking the large number of funding requests it receives from cities across the country. The analysis also provides local decision-makers with data essential to their own process of determining viable and appropriate termini for the project. In addition to developing cost effectiveness indicators for the Northstar Corridor project between downtown Minneapolis and Rice, the FTA requires similar information for what is termed the Minimal Operable Segment (MOS). The Northstar MOS analysis, therefore, evaluates shorter segments of the total project while still maintaining a viable commuter rail project. The FTA intent is to ensure that local decision-makers have evaluated all reasonable alternatives to the full-length project proposal. The Northstar Corridor MOS analysis includes the base case of Minneapolis to Rice as well as potential northerly termination points at E. St. Cloud, Big Lake and Elk River. The various incremental ridership, operations cost, and capital costs are used to determine the cost effectiveness indicators for the various segments. In addition, the data also includes analysis based upon the September, 1998 NCDA Policy for Extension to the Northstar Corridor. Finally, a chart comparing the cost effectiveness indicators for the Northstar project with other projects from across the country is included. The attached data will be reviewed at the February 1 NCDA Board meeting. It is anticipated that action by the Board recommending a project termination location will be taken at the March 1 meeting. In response to a request from Benton County, the NCDA agreed to include the City of Rice as a part of the study area for the Major investment Study. The NCDA further agreed, at its last meeting, to include in its current study the assessment of the feasibility of commuter rail in St. Cloud. Mn/DOT has offered to pay for the additional costs associated with the western extension of the Corridor. Morrison County has submitted a resolution requesting a station in Little Falls and supporting the station in Rice if such an extension is not feasible. At its meeting on September ] 7, the Executive Committee discussed elements of a draft policy on extensions of the Northstar Corridor and recommends that the NCDA adopt the following policy. NO. 7102 - 54 WHEREAS, the Commissioner of the Department of Transportation has prepared a preliminary layout for the construction of a park and Ride Facility near T.H. 10 and Tyler Street/171st Avenue, within the corporate limits of Elk River, and seeks the approval thereof; and WHEREAS, said preliminary layouts are on file in the Office of the Department of Transportation, Saint Paul, Minnesota, being marked, labeled, and identified as Layout No. 1, near T.H. 10 and Tyler Street/171st Avenue, Elk River, Propose Park and Ride facility, prepared January 17, 2001. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River as follows: That said preliminary Layout No. 1 prepared January 17, 2001, for the improvement of said Trunk Highway within the corporate limits be and hereby is approved, with the following conditions: 1. That MN/DOT continue to work with City staff and the developer of Elk River Station on final design of the facility; The final layout/design of the facility shall include sidewalks to encourage pedestrian access and landscaping to be approved by the City; That MN/DOT work with the City on the timing of each phase of the project and which improvements will be installed as part of each phase. This park and ride facility is needed in order to meet the demands of suburban commuters now. This future facility will be located in a developing, light industrial area that is currently undeveloped land used for agricultural purposes. The location is 1/3-mile (0.5 km) east of TH 10 on 171 Avenue NW/Tyler Street. The land consists of two parcels that are currently for sale. See attached project location map and preliminary layout. We would like to show this layout to the City Council on the February 12, 2001 City Council meeting for municipal approval.
