Preliminary and Final Plat approval.
Background/Discussion
The City acquired approximately 90 acres of land from Cargill and intends to prepare the property for
industrial/ commercial development. As a fltst step in the development process, the City, through its
Economic Development Authority, proposes to plat the property with outlots, preserving the necessary
road right-of-way, and identifying any potential title issues that could delay formal development. No
streets or public improvements are proposed to be constructed at this time.
The street right of way location is fairly fixed, with the connection to Ulysses to the north, and a future
connection through Cargill-owned land to the south. The proposed connection is consistent with the
location identified in the Cargill agreement. An existing gas easement along the west side of the road
restricts lateral options.
Platting the property as outlots allows the City to be flexible to accommodate desired users of the
property. No public improvements or building is proposed with this plat. The property will be replatted
in the future to accommodate uses.
Financial Impact
None.
Planning Commission Discussion
The Planning Commission voiced no concerns with the platting proposal.
Public Comment
During the Public Hearing, an adjacent property owner, Larry Morrell, questioned the City's goals for the
property. He voiced no concerns with the platting project.

RESOLUTION NO. 08-
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Gateway Business Park
Case No. P 08-04
WHEREAS, application has been made for final plat approval, pursuant to Section
30-374 (a-g) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed plat is consistent with the Land Use Regulations and conforms
with all of its requirements.
B. The proposed plat is consistent with all applicable general and specialized
city, county, and regional plans including, but not limited to, the City's
Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to
flooding, and drainage are suitable for the type and density of development and uses
contemplated.
D. The proposed plat makes adequate proVlslOn for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
E. The proposed plat will not cause substantial environmental damage.
F. The proposed plat will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed plat will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member and
duly seconded by Council Member . The following voted in favor
of the Resolution.

Legal Description:
The Northwest Quarter of the Southeast Quarter of Section 11, Township 32, Range 26,
Sherburne County, Minnesota, except the East 585.00 feet.
And also:
That part of the Northeast Quarter of the Southwest Quarter, said Section 11, lying Easterly
of the Easterly line of the right of way of U.S. Highways No. 10, 52, and 169. Excepting
therefrom that part thereof described as commencing at the Northwest corner of said
Northeast Quarter of the Southwest Quarter, thence South along the West line thereof a
distance of 521.10 feet; thence East at right angles a distance of 275.00 feet; thence South at
right angles a distance of 200.00 feet to a point to be hereafter known as Point "B" for the
purpose of this description; thence deflect 69 degrees 27 minutes 30 seconds to the right in a
Southwesterly direction along a line to be hereafter known as Line "A" for the purpose of
this description, a distance of 277.15 feet, more or less, to intersect said Easterly line of the
right-of-way of U.S. Highways No. 10, 52, and 169, said point of intersection also being the
actual point of beginning of the tract to be hereby described; thence Northeasterly along said
