There shall be no access to the Ports ide subdivision via Naples street. 4. Staff shall approve the landscaping plan 5. Staff shall approve the building design, consistent with the design requirements. 6. Outdoor Storage Tanks shall match the building color. 7. Any item or condition found that indicates the site is likely to yield information important to pre-history or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized to continue by the City. Backl:round/Discussion In February 2008, Portside addition was approved with two buildable lots. There are currendy two separate projects the City is reviewing, one for each lot. This proposal (on Lot 2) requires a Conditional Use Permit as it has outdoor storage tanks, while the other proposal (on Lot 1) is an administrative reVIew. The Planning Commission had some general comments regarding screening and the color of the storage tanks. They recommend the tanks match the building. The Planning Commission unanimously recommended approval of the request. Two above ground storage tanks are needed for the operation of their business. The Business Park Zoning District requires a Conditional Use Permit for above ground storage tanks. Other than the proposed storage tanks, the proposed use is consistent with a permitted use on the Business Park zoning district. Applicable Rel:ulations Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentallY qifect the use and enjqyment of other properry in the immediate viciniry or the public health, scifery, morals, comfort, convenience or general welfare of the neighborhood or the ciry. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderlY development and improvement of sUTTOunding vacant properry. 4. Will fullY complY with all other requirements of this Code, including a1!Y applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the ciry. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. In the review of the standards for CUP as oudined, it appears that the request is consistent with all of these standards. Analysis The two above ground storage tanks are 12-feet in diameter and 24-feet tall which is 4-feet shorter than the shortest portion of the building. The two tanks are proposed to be located on the east side of the building and are proposed to be milky white in color. The building will be earth-tone colors, a tan limestone mixed with red rock, and red rock. These mixed with the concreted base will give a warm golden appearance. The tanks will be screened by the building from most of the properties of the Sandpiper Estates. The tanks will not be screened by the building for those living in the Country Crossing townhome area. Staff is recommending berming to help further screen the tanks from the residential areas. Based on the possible future expansion area and view angles, the building will provide additional screening from Sandpiper Estates. Building Design The drawings indicate the building will be tilt-up construction with material and reveal patterns. It is unclear what the material changes are or the percentage of punched openings. The ordinance requires 30% of the fa<;:ade to be a second approved material or 40% punched openings, with or without glass. Major exterior surfaces that are adjacent to any public street, public trail/path, or adjacent residentially zoned properties shall not exceed 160 feet zero inches in length without a minimum four-foot depth change (recesses, protrusions, or a combination thereof), with at least two feet of such change to be in the entire height of the facade. The design of the building does not meet this requirement. The front and rear facades must meet this requirement. Staff will be working with the applicant on the building design to assure that it meets the ordinance requirements. The Light Industrial category includes industrial uses that are lower in intensity of activity. These uses limit the potential for adverse impacts on adjacent land uses due to factors such as noise and odor. Examples of Light Industrial uses include offices, enclosed storage and warehousing, research laboratories and light manufacturing. Transportation Access to the site will be off of Business Center Drive at two locations; one near the east property line, the other near the west property line. Staff reviewed the number of access along Business Center Drive, but felt that sharing of drives was unnecessary due to the lack of conflicting movements across the street. The cul-de-sac at the north end of Naples Street will be removed from the property. Naples Street will dead end at the property line and will have no access to the subject property. No new cul-de-sac will be rebuilt. Gradin&lDrainal:e Grading, Drainage and Utilities are addressed in the City Engineer's memo dated April 3, 2008. landscapinl: Generally, the largest concerns in developments adjacent to residential include concerns with noise, light, and traffic. As noted above, no access is provided to the residential development. To alleviate light and noise, staff is recommending a low berm and substantial landscaping. A low berm would provide year round interest, but will not be substantial enough to provide adequate screening. Significant landscaping including a mix of coniferous, ornamental, and overstory (shade) will help buffer the industrial character of the building from the established residential properties to the south. The required number of proposed trees meets the ordinance requirements. To help buffer the proposed building for the adjacent residential neighborhood, staff recommends that a 3'-4' undulating berm along the southern property line shall be created with a minimum 3:1 slope. The berm should have a majority of coniferous trees but provide a mix of ornamental also. This may require reordering of the proposed trees. The berm shall be designed so it does not create any potential flooding on the adjacent properties. To account for surface water, it will be appropriate to provide breaks in the berm. The berm design recommendation from staff is consistent with the recommendation to the property to the west. The revised plans were dated March 26, 2008. Based upon our review, I believe all the necessary easements have been added or revised on the final plat and therefore the final plat should be approvable from an engineering standpoint. The site plan has been revised to include or correct the comments that were made in my earlier memo dated March 10, 2008. There are still a few items that cannot be corrected on the site plan but must be accomplished prior to construction, such as the NPDES permit and the Stormwater Pollution Prevention Plan. Also, the note added about rip-rap at the storm sewer end section does not meet the City standards for the class of rip-rap. This also can be corrected in the final construction plans. The watermain encircling the building should be looped with the Metalcraft site to the west (lot 1 Portside Addition) to provide for a better system. Also, watermains on the south side of the building should be moved out of the future expansion area to eliminate the need to relocate it in the future. Finally, hydrant locations will need to be approved by the fire chief in the final design phase, prior to construction. Finally, record drawings need to be provided at the conclusion of the construction along with GIS data on the constructed utilities including field-surveyed locations of water, storm sewer and sanitary sewer (X, Y, Z) on the county coordinates system. The building will serve as the new headquarters and will house all domestic operations for the company. The 55,000sq ft facility will be of tilt-up construction with material and reveal patterns to give the appearance of a varied and architecturally pleasing structure. Wall heights vary from 28 to 32 ft, with a prominent glass entry in the NW comer of the building which will face the entry of the Metal Craft building. E & 0 will have signage on the buildings north elevation facing Hwy 10, and will provide 97 parking spaces on the sites north side with 2 access points on to Business Center Drive for the approximately 125 employees that operate the company presses 24 hours per day, 7 days per week. The building will also have 6 docks, and 1 drive in door, 2 material storage silos, and 1 chiller cooling unit all of which are on the east side of the building facing Faribault Foods. The 2 silos stand approximately 30 ft high. The chiller unit stands approximately 13 feet high. The silos and the chiller unit are located adjacent to the building on the east side. The silos are for material storage only. The material is pumped into the silos via vacuum pump so there is no external mess. There is also no fumes or odiferous result associated with either the silos or the chiller. Silos are typically filled during day hours between 8:00am and 5:00pm and will be screened from view to residents on the south by a row of evergreens as shown in the landscape plan. The following concerns were identified: 1. Due to the amount of grading and excavation that will occur on each of the sites, an NPDES (National Pollutant Discharge Elimination System) permit will be necessary for each project with a SWPPP (Storm Water Pollution Prevention Plan). The NPDES permit may be obtained from the Minnesota Pollution Control Agency prior to or concurrent with application to the City, but must be obtained prior to any grading taking place on the project. 2. The City's Archaeological Model indicates a moderate to high potential for an archaeological site in both project areas. Staff recommends that the standard condition listed below is placed upon each request: a. "Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the City immediately. Hydrocadd Overview Existing Conditions The majority of the site now drains Southwest, with a small part of the Northwest side of the site draining Northwest. Overall site discharge in the 100 year event is 12.42 cfs Proposed Conditions The City has directed that the proposed drainage not be allowed to discharge to the Southwest as the existing street is rural. Therefore the combined site will discharge into a sedimentation basin except for the loading dock area ofE & 0 which will discharge directly into the existing storm sewer.
