Overview
In 2000, the City Council approved a 6,000 square foot building for Elk River
Muffler and Brake on the subject property. The applicant is now looking to
receive approval of a conditional use permit to allow a 6,300 square foot addition
to the building. Construction has started on Phase 1 of the building.
Analysis
Access
Access is proposed from the temporary driveway approved as part of Phase 1.
No parking will be allowed within the Ulysses Street right-of-way along the
temporary driveway.
Grading, Drainage and Erosion Control
See attached Howard R. Green memorandum. The City Engineer notes in his
memo that there is not adequate room for the proposed expansion, the pond,
and the fire lane. Staff concurs that the proposed expansion should be reduced
by 10 feet.
Building Elevations
The addition is proposed to be constructed of the same painted rock-face block
proposed under the original proposal. The blocks will be painted buff color with a
red accent stripe near the cornice.
Parkinq
With the addition, the applicant has indicated nine additional parking stalls, as
indicated on the original site plan. This does meet the ordinance requirements.
The parking area will need to be surrounded by concrete curb and gutter and the
parking stalls will need to be 9 feet x 18 feet. Parking will be permitted on paved
surfaces only.
Landscaping
The proposed landscape plan indicates existing trees to be saved as well as new
trees to be planted. The existing trees can be counted for credit, depending on
the size and type of tree. Staff will be working with the applicant to ensure that
the ordinance requirements have been met based on the amount of credit given
for the existing trees.

Signs
One monument sign has been indicated along 171st Avenue. Wall signs have
not been identified at this time. The monument sign will be required to be utilized
for tenants in both portions of the building. Both the wall signs and monument
sign will need a sign permit prior to construction of the sign.
Dumpster
With the proposed expansion the dumpster is identified as being located at the
end of the proposed fire lane adjacent to the addition. The dumpster cannot be
located in this location as it conflicts with emergency access for fire protection
purposes. The applicant will need to find an alternative location for the dumpster.
The dumpster enclosure is proposed to be constructed out of concrete block
which will match the building materials and will comply with City Code.
Outdoor Stora,qe
Outdoor storage is a conditional use in the I1 zoning district. The dumpster and
recycling enclosure will hold recycled metal and trash. Outdoor storage should
be limited to this area. Damaged or inoperable vehicles should be stored inside.
Planning Commission Action
The Planning Commission conducted a public hearing regarding the request at
its January 23, 2001 meeting. No one spoke for or against the request. The
applicant presented an alternative to reducing the building ten feet in order to
resolve the issue of excess slope on the fire lane noted in the City Engineer's
memo. The applicant's solution was to build a retaining wall in the pond to create
a fiat fire lane. The City Engineer stated that in his opinion, the site is maximized
to the fullest extent possible, and that no further concessions can be made.
The Planning Commission voted unanimously to recommend approval of the
request as recommended by staff, with the reduction in building area. The
Commission also added another condition:
1. That the addition shall comply with all requirements of the Chief Building
Official.
Recommendation
The Planning Commission recommended that the City Council approve the
request for a 5,600 square foot expansion with the following conditions:
1. That the City Engineer's comments be incorporated into the site plan.

2. All parking stalls be a minimum of 9 ft. x 18 ft. face-of-curb to face-of-curb
with a minimum drive aisle of 24 feet.
3. Parking shall be on paved surfaces and there will be no parking in the
Ulysses Street right-of-way.
That the dumpster/recycling enclosure be located outside of the fire lane
and shall be constructed of materials similar to the building and include an
opaque gate.
5. That outdoor storage be limited to the 1,000 sq. ft. dumpster/recycling
enclosure.
6. That the site be landscaped to conform to City ordinance.
7. That a lighting plan be provided that conforms to City ordinance.
8. That access to the property be limited to the Ulysses Street right-of-way.
9. That damaged or inoperable vehicles be stored inside.
10. That the addition shall comply with all requirements of the Chief Building
Official.
Since the Planning Commission meeting, the applicant has submitted a revised
plan with a retaining wall adjacent to the Fire Lane. Drainage calculations were
also submitted and reviewed by the City Engineer. Based on this review, staff is
recommending that the applicant be allowed to construct the addition at 6300
square feet with the above conditions.

RE: ELK RIVER MUFFLER AND BRAKE EXPANSION
Dear Ms. McPherson:
As requested, we have reviewed the plans prepared by John Oliver and Associates for
the expansion of the Elk River Muffler and Brake facility located on 171st Avenue at
Ulysses Street. Based upon our review, we would offer the following comments:
The grading, drainage, and erosion control plan is essentially the plan from the first
construction. It does not show any detail for the future expansion relative to the
parking area or other site improvements. A revised plan which shows the detail on
the proposed expansion should be submitted, reviewed, and approved.
The retention pond is construction with 3:1 side slopes. Therefore, according to
City policy, it must be fenced. The proposed fencing is shown attaching to the
proposed expansion. There must be an access point provided for the fire lane
required by the Fire Chief.
There is not sufficient room on the site for the proposed expansion, the 20-foot fire
lane, and the ponding. Currently, the 20-foot fire lane is at least five to seven feet
down the 3:1 slope of the pond. We would suggest that the building expansion be
shortened by ten feet to allow sufficient room for all of these items.
The top of the pond should be lowered by approximately half a foot at the area of
the emergency overflow. Currently, the top of the pond dike is at 877.0 all along
the top. By Iowedng it to 876.5 at the emergency overflow, it can be predicted
where the overflow will occur:
5. It is unclear where the dumpster for the building will be placed after the expansion.

Dear Ms. McPherson:
We have reviewed the revised drainage calculations that were provided by John Weicht
and prepared by John Oliver & Associates for the expansion of the Elk River Muffler and
Brake building. By slightly reconfiguring the pond, and installing a small retaining wall
adjacent to the fire lane, it appears as if the ponding that is necessary can be
accomplished with the odginal sized building. By reviewing the original drainage
calculations and the revised drainage calculations, it appears that the odginal pond was
slightly oversized. Therefore, from an engineering perspective, we would recommend
approval of the odginal building size proposed.
