SUBJECT: Water/Sewer East of CR40
In December of 2006, the City Council approved a land use amendment to the property
known as Liberty Heights Estates, changing the land use classification from rural residential
to urban residential. One of the conditions imposed by the Council was that should a
Planned Unit Development Agreement not be approved by the City by iVlaxch 2007, the
property could revert back to total residential, removing it from the urban services district.
Through 2007, staff was in constant contact with the main pxopexry owner of the area,
working on concepts and discussions toward fulfillment of the project. Since this action,
staff has been approached by several adjacent property owners, desiring an urban services
boundary extension fox their properties as well.
Since the PUD evas not approved in the required timeframe, the CouncIl is asked to
authorize the Comprehensive Plan amendment, changing the pxoperry from the urban
residential to rural residential. If authorized, staff will begin the formal amendment process.
Formal amendment of the Comprehensive Plan will require 4/5 vote of the Council, in
addition to public hearings at the Planning Commission and City Council.
