Background/Discussion Late in 2007, the City Council authorized the preparation of the attached feasibility report fox the 2008 Bituminous Overlay Improvement. As the City Council is acvaxe, fox many years now, in even numbered years the city has undertaken an assessable bituminous overlay project. As has been past practice with bituminous overlay projects, the public hearing and assessment hearing axe held the same evening to minimize the amount of trips the public has to make to the City Council meetings to hear basically the same information. The city has typically bid the project before the meeting date so that an actual bid unll be available the night of the hearings. 'T'his year's project includes seven bituminous street areas proposed to be overlaid, along with three areas of gravel roads. This has also been the city policy to try to eliminate gravel roads with each of the bituminous overlay projects. The resolutions the Council is asked to consider include receiving the feasibility study and ordering the public hearing to be held on July 7, 2008, determining the cost to be assessed and ordering the preparation of the assessment roll, establishing the date fox the assessment hearing to beheld also on July 7, 2008, ordering the preparation of plans and specifications and allowing the project to be bid on June 19, 2008, so that firm construction costs will be available fox the public/assessment hearing. Financial Impact As has been the city's practice in the past, the bituminous overlay is proposed to be 100 percent assessed to the benefiting properties. There is a mixture of single family homes, townhomes, and apartment buildings throughout this project. Single family homes axe assessed 1 unit; townhomes are assessed .75 Lunt per dwelling; and apartments axe assessed .25 unit per apartment. The city's contribution to these projects in the Street Division's preparation of the areas prior to the overlay by patching and restoring areas that are badly deteriorated. T'he Street Division is also responsible fox some cleanup and fmal work after the bituminous overlay has been placed. The City Council will consider the 2008 Bituminous Overlay improvements as described in the Feasibility Report and the assessment of the property abutting this proposed improvement for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section 429, at an estimated total cost for the improvement of $648,000. 2. A public heazing shall be held before the City Council on the proposed improvement on the 7th day of July, 2008, at 6:30 o'clock p.m. at the Elk River Ciry Hall Council Chambers. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. Based upon the City Assessment Policies, it is determined that the portion of this improvement to be paid by the City and not assessed to benefited properties is $-0-. 2. The portion of the cost to be assessed against benefited pxopexdes pursuant to the Elk River City Assessment Policies shall be $648,000. 3. The assessments shall be payable in equal annual installments and shall extend over a period of five years, the first of the installments to be payable on or before the first Monday in January, 2009, with interest at the rate of 4.0% per annum from the date of the adoption of the assessment resolution. 4. The City Administrator with the assistance of the Project Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, ox parcel of land, without regard to cash valuation, as provided by law, and shall have available at the City Administrator's office a copy of the proposed assessment roll for public inspection. 5. Upon completion of the proposed assessment roll, the City Administrator shall notify the Council and schedule a public hearing upon the proposed assessment, causing notice of the hearing by publication and mail to be made at least two weeks prior to the hearing. NOW, THEREFORE, BE IT RESOLVED by the Ciry Council of the City of Elk River, Minnesota: 1. A hearing shall be held on the 7th day of July, 2008, in the City Hall at 6:30 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the heating on the proposed assessment to be published once in the official newspaper at least two weeks prior to the heating, and shall state in the notice the total cost of the improvement. The City Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City of Elk River, except that no interest shall be charged in the entire assessment is paid within 30 days from the adoption of the assessment. The owner of any property may at any time thereafter pay to the City of Elk River the entire amount of the assessment remaining unpaid, with interest accrued to December 31st of the year in which such payment is made. INTRODUCTION The City Council of the City of Elk River adopted Resolution 07-99 on December 3, 2007 authorizing preparation of this report to determine the feasibility of overlaying streets within seven developments in the city. The seven areas for bituminous overlay are: 1. Barrington Place 5. Presidential Estates 2. Town of Orono 6. The Best Point on Orono Lake 3. Orono Hills 7. Circle Bay Addition 4. Island View Additions In addition to the overlay of the developments listed above the City Council authorized the study to be expanded to cover paving all the following gravel roadways: 8. Camp Cozy 10. Yankton Street 9. Union Street The feasibility study was initiated by the City Council based on the City's ongoing pavement maintenance program. The locations for the bituminous overlay areas and gravel road paving areas are shown on Figure 1 at the end of this report. This study will summarize the existing conditions, proposed improvements, estimated construction costs, and associated overhead costs for the project. Overhead costs include City administration, engineering, fiscal, and legal expenses. Previous projects will be used as a guide to establish financing methods for the project. II. EXISTING CONDITIONS The streets in the seven developments proposed to be overlaid; five are rural sections with no storm sewer and two are urban developments with curb and gutter. The streets are generally in fair condition; however, additional bituminous surfacing is needed to maximize the useful life of these streets before more costly repairs, such as reconstruction, are necessary. 1 A description of the existing streets in the seven developments is as follows: A. Existing Paved Bituminous Roads 1. Barrington Place Roadways consist of 27 to 29 foot wide pavement, some bituminous berm, some concrete curb and gutter. Pavement is 28 years old, built in 1980 and 1989, area was seal coated in 1995 and 1999. Based on normal degradation curves this pavement would rate a pavement condition index (PCI) below 30 although based on field observations the condition that exists appears better than that. Island View Additions The roadways consist of 21 to 22 foot wide pavement and some bituminous berm. T'he area was platted between 1960 and 1986 there is no detailed records but it appears the pavement was built in the early 1970's. The area was seal coated in 1982 and 1990. Based on condition surveys of 2003 photos this pavement rates a pavement condition index (PCI) between 64 and 87. The west end of Island View Drive was platted in 1999 as Island View 5`h Addition. This portion of the pavement is substantially newer and in much better condition therefore it has not been included in the study. PROPOSED IMPROVEMENTS The proposed improvement to the streets is to provide an overlay with 1 `/2 to 2 inches of bituminous surfacing. The streets can be overlaid while maintaining traffic, so there will be minimal disruption during construction. In addition, the improvements will consist of milling and/or removal of a small portion of existing bituminous in front of relatively flat driveways, and concrete curb and gutter to ensure they can be made to match properly with the newly overlaid street. Figure 2 (located at the end of the report) shows the relationship between life of service and strength of pavement. This graph shows that once a street reaches 75 percent of years of service the pavement strength rapidly drops and the cost to maintain the road increases. By overlaying these roads, the strength and life of the road will be increased. The overlay will seal the cracking in intermediate stages. The overlay will also fill the low areas in the pavement, which collect water and decrease the life of the pavement. Existing transverse cracks, which are caused by freeze-thaw cycles, will likely reflect through the overlay in the future. As with all previous bituminous overlay projects, the City Street Division will patch any severely damaged areas before the overlay. The contract for the street work will restore the gravel shoulders after the overlay. IV. EASEMENTS AND PERMITS The right-of--way width for these streets is generally 60 feet and is adequate for these improvements. No work is proposed outside of the right-of--way. V. NECESSITY AND COST-EFFECTIVENESS The streets being reviewed are in need of repair. The project is necessary to provide the residents of these areas with a safe and adequate public transportation system. If the overlay is not done in a timely fashion, the roads will continue to deteriorate and reach a point where an overlay will not be a feasible alternative. The project will minimize future maintenance costs and increase traffic safety. The size of the project will ensure competitive bidding; from this standpoint, the project is cost- effective. 10 VI. ESTIMATED PROJECT COST The estimated construction and project cost for the proposed improvements is provided below: Estimated Total Construction Cost $ 518,400 Contingency (10%) $ 51,840 Overhead (15%) $77,760 Total Overall Project Cost $ 648,000 The project cost includes both construction and overhead costs. In accordance with the City's assessment manual, the overhead costs are estimated as 28 percent of the total construction cost. The overhead cost includes City administration, engineering design, construction staking and inspection, and fiscal and legal costs. Since this project will not require detailed plans and specifications, the overhead has been reduced to 15 percent. VII. PROJECT FINANCING As has been the City's practice on past overlay projects, it is proposed that 100 percent of the cost of the improvements be financed by assessments to the benefiting properties. As established by previous similar projects, all properties with frontage abutting the roads or properties dependent on the road to be overlaid shall be assessed on a per unit basis. Each residential property is considered one unit. Each multi family unit is assessed at 75% of the residential rate. The apartment units are assessed at 25% of the residential rate The total number of assessable units in the project is 330. Dividing the total project cost of $648,000 by 330 units, the cost per unit is $1,963 The existing parcels and corresponding property identification numbers for the benefiting properties are shown on Figures 3 through 12. 11 VIII. CONCLUSION Based on the information gathered and the analyses presented, the proposed overlay improvements are feasible from an engineering standpoint and would meet all standards set forth by the City. The proposed project would increase the total life of the existing bituminous roads and improve the condition of the roads. 12 IX.
