A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF THE CITY OF ELK RIVER
ACCEPTING MnDOT'S OFFER TO SELL A
MEMORANDUM OF CONDITIONS REGARDING THE
MULTIMODAL PARK AND RIDE FACILITY
WHEREAS
MnDOT anticipates constructing a Park and Ride facility on property
adjacent to the railroad tracks near 171st Avenue and Tyler Street; and
WHEREAS
the parking lot will require a stormwater quality control and detention
pond; and
WHEREAS
the outlet from this pond needs to cross City-owned property to get to the
outlet ditch.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
It is understood that only an easement will be granted even though (2)
State's title to said real estate shall pass to the State of Minnesota as of
the date of acceptance subject to conditions hereinafter stated.
The Mayor and City Clerk are authorized and directed to execute the
Offer to Sell a Memorandum of Conditions on behalf of the City.
