193`d Avenue Corridor Update -Pathway Options

Consider deleting a portion of bituminous pathway proposed on the south side of the 193`d Avenue east
of Xavier Street continuing to Tyler Street.
Background/Discussion
Throughout the process of determining the location of the 193`d Avenue extension, the City Council has
been very responsive to the requests and concerns of Mr. and Mrs. Burandt, who are property owners on
the south side of the 193`d Avenue extension. The Council and staff have been working with the Burandts
on the temporary easement needed to accommodate the addition of a bituminous pathway along the
south side of 193"' from Xavier Street to County Road 13. At the last meeting, the Council directed staff
to send a letter to Mr. and Mrs. Burandt with the City's proposal for compensation options for the
temporary easement. However, since that time, another option has come to light that staff is presenting
for your consideration. The attached memo from Public Works Director Terry Maurer provides
additional detail information.
The option staff is asking the Council to consider in order to elitxunate any impact on the Burandt
property is to delete the section of pathway from Tyler Street to Xavier Street thereby eliminating the
need for a temporary easement from Mr. and Mrs. Burandt. There will still be pedestrian facilities along
the entire length of 193`d from Hwy 169 to County Road 13 via a sidewalk on the north side; part of that
sidewalk was constructed with development along the existing 193`d Avenue and the balance will be
constructed with the extension of 193`d. City policy has been to add pathways along with sidewalks
whenever possible. However, given the slope of many of the existing driveways on the south side of
193`d and the fact that development has already occurred along the existing part of 193`d, it is difficult to
add a pathway west of Xavier Street. For that reason, and because a sidewalk will be available on the
north side to provide a safe means for pedestrians, extending the pathway from Xavier to Hwy 169 is not
being proposed at this time. Therefore, eliminating the section of pathway along the Burandt property is
not critical to the pathway system at this time. It could always be added in the future if that property is
developed.

Financial Impact
According to the engineering analysis, eliminating the pathway section on the Burandt property does not
affect project cost. It does eliminate the need for a temporary easement.

SUBJECT: Burandt Easement for 193~d Avenue Corridor
After last Monday evening's discussion, I have had an opportunity this week to talk face to
face with Mr. Burandt about the Council direction. It is my opinion that it will be difficult to
negotiate a satisfactory scenario where the Burandts will execute the necessary easement in a
timely fashion. Therefore, I have reviewed the preliminary plans for 193Ld Avenue to look at
other possibilities.
As you axe aware, the plans currently include a bituminous pathway on the south side
(Burandt side) of the roadway. This bituminous pathway starts at CSAH 13 and goes to
Xavier Street in the Woods at Hillside area. At that point, there will be no pedestrian facility
on the south side of the existing 193`d Avenue; therefore, pedestrians will need to cross to
the north side where there is an existing concrete sidewalk. If the city were to eliminate the
bituminous pathway from the south side of 193`d Avenue between Tyler Street to Xavier
Street and add a small portion of retaining wall approximately 100-125 feet long and up to 6
feet high, the roadway could be built without any easements from the Burandts. If no
easements from the Burandts are needed, the city could also remove excess chain link
fencing that was added at the Burandts request as we were working with them to mitigate
any impacts the roadway would have on their property. There would still need to be a small
section of chain link fence as the roadway crosses the wetland, utilizing retaining walls that
need protection facilities along the top.
I have done a quick analysis of the potential cost of adding a retaining wall to the project
versus removing the pathway mentioned above and a portion of the chain link fence. From
a financial standpoint, the affect on the total cost of the project would be neutral. The
pathway could always be added at a latex date from Tyler Street to Xavier Street.
One other question should be asked of the Council if they want to pursue this course of
action; should we eliminate the bituminous trail in its entirety including the section between
CSAH 13 and Tyler Street.
At this point, I have not sent a letter to the Burandts .regarding the Council action and
direction last Monday. I will wait for City Council thoughts on this approach before I send a
letter to the Burandts. If you have any questions, please contact me.
