RESOLUTION FOR THE CITY OF ELK DER
A RESOLUTION ESTABLISHING THE DA'I'S FOR THE ASSESSMENT HEARING FOR
THE I'T UMIN S oVE IAY IMPROVEMENT OF 2008
WHEREAS, by a resolution passed by die CouncH on May 19, 2008, the City Clerk was directed to
prepare a proposed assessment roU of the cost of the 2008 Bituminous Overlay
Improvement; and
WHEREAS, the Clerk- has notified the Council that such proposed assessment roll -\viU be completed and
f�fled In the Clerk "s off ce for public inspection by the appropriate time.
OW, THEREFORE, BE IT RESOLVED by the Cite Council of the City of Elk River, Minnesota:
1. A hearing shall be held on the 761 day of July, ?008, in the City 1 -1all at :30 p.m. to pass upon such
proposed assessment and at such time and place aH persons owning property affected by such
i prov- extent Nvill be given are opportunity to be heard'With reference to such assessment.
The City Clerk is hereby directed to cause a not*ce of the hearing on die proposed assessment to be
published once in the of al. newspaper at least two weeks prior to the hean'ng, and shall state in the
notice the total east of the improvement. die City Clerk shall also cause mailed notice to be given to
the o wner of each parcel described in the assessment roll not less than v'vo weeks prior to the
hearings.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
County Auditor, pay the whole of the assessment on such property, Nvith interest accrued to the elate
of pa yment, to the City of Elk River, except that no interest shall be charged in the entire assessment
is paid *%Nqthin 30 days from the adoption of the assessment. The owner of any property may at any
time thereafter pay to the City of Elk River the entire amount of the assessment re a *nmi unpaid,
Nvith interest accrued to December 31st of die year in which such payment is made. Such payment
must he jade before November 1511, or interest \viU be charged through December 3I�t of die
succeeding year.
