Appointment of Assistant City Weed Inspector
Item #3.5.
Minnesota Statutes requires the Mayor to act as a local weed inspector for the City. The
statute provides for the appointment of an assistant weed inspector to act on behalf of the
Mayor. The assistant weed inspector has the same power, authority, and responsibility as the
Mayor in the capacity of weed inspector.
Phil Hals has been appointed to this position in the past and has indicated that he would be
willing to assume this position again.
Listed below is an excerpt from the state Statutes indicating the duties of the weed inspector.
18.81 Duties of inspectors. Local weed inspectors. Local weed inspectors shall:
(1) examine all lands, including highways, roads, alleys, and public ground in the territory over which their
jurisdiction extends to ascertain if section 18.78 and related rules have been complied with;
(2) see that the control or eradication of noxious weeds is carried out in accordance with section 18.83 and
related rules;
(3) issue permits in accordance with section 18.82 and related rules for the transportation of materials or
equipment infested with noxious weed propagating parts; and
(4) submit reports and attend meetings that the commissioner requires.
Action Requested:
Adoption of the attached resolution appointing Phil Hals as Assistant Local Weed Inspector
for the Mayor's term -January 1, 2003 through December 31, 2006.

RESOLUTION
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPOINTING ASSISTANT WEED INSPECTOR
WHEREAS,
Minnesota Statutes require the Mayor to act as a local weed inspector for the
City of Elk River; and
WHEREAS,
Minnesota Statutes also provides for the appointment of an assistant weed
inspector to act on behalf of the Mayor; and
WHEREAS,
the assistant weed inspector is granted the same power, authority and
responsibility as the Mayor m the capacity of Weed Inspector.
NOW, THEREFORE, BE IT RESOLVED that Phil Hals is hereby appointed as Assistant Weed
Inspector for the City of Elk River for the term of Mayor Stephanie Kdinzing from January 1, 2003 to
December 31, 2006.
