SUBJECT: Flag Lot Discussion
At the February 19, 2008 City Council meeting, an administrative subdivision proposal was
approved with a "flag lot" design. Members of the Council had voiced concern with this
practice.
At the March 10, May 19, and June 16 meetings the Council reviewed and discussed
information regarding flag lots, including review of an ordinance prohibiting these lots.
Council asked staff to define "access" and "access strip". The attached ordinance has
revised and clarified that definition.
Council is asked to review the proposed ordinance. A formal amendment would be
presented for approval at the July 21 Council meeting.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER REGULATING FLAG LOTS BY
AMENDING
SECTION 30-1 "DEFINITIONS" AND ADDING SECTION 30-482 "FLAG LOTS" TO
THE CITY CODE OF ORDINANCES
Case No. OA 08-04
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 30-1, titled "Definitions" of the City of Elh River Code of Ordinances shall
be amended by adding the following definitions:
Access: A means of vehicular or pedestrian approach, entt-~- to, ox slit from property.
Flag Lot: means a lot so shaped that the building site aiea is set back from the street on
which the lot fronts and the lot includes an access ship, which is at any point narrower than
the minimum lot width requirement in the zoning distl"ict, connecting the building site area
with the frontage street.
Section 2. That the Elk River Code of Orenances be amended bS- addii'g in Section 30- 482
thereto:
Section 30-48?. Flag lots. Flag lots are prohibited
Section 3. That this ordinance shall take effect uponpublication as provided bylaw.
