Council motion to adopt a resolution extending the moratorium on the issuance of licenses for the sale of
tobacco products.
Background/Discussion
The current moratorium expires on July 15, 2008 and the Council is asked to extend this moratorium for
a few more weeks as the ordinance will be discussed at the July 21 Council meeting. If approved and
passed, the new tobacco ordinance would be effective upon publication on July 30, 2008.

RESOLUTION 08-
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION EXTENDING THE MORATORIUM ON THE ISSUANCE
OR TRANSFER OF LICENSES FOR THE SALE OF TOBACCO PRODUCTS
WHEREAS, The Ciry Council of the City of Elk River imposed a moratorium on the
issuance or transfer of licenses for the sale of tobacco products for establishments where the
sale of tobacco products is the primary business of the establishment; and
WHEREAS, The purpose of the moratorium was to have city staff research and prepare
amendments to the city's ordinance requirements for the issuance of licenses for tobacco
sales; and
WHEREAS, City staff needs additional time to prepare an ordinance amendment for City
Council consideration.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ciry of Elk
River, Minnesota:
1. That the moratorium on tobacco licensing shall be extended to and including July 29,
2008.
2. That during the moratorium period, the city shall not issue any new license for the
sale of tobacco, nor approve any transfer of any existing license to a new licensee, for
any establishment where the sale of tobacco products is the primary business of the
establishment.
3. That the extension of the moratorium shall take effect upon adoption of this
resolution.
