MEMORANDUM Mayor & City Council Steve Rohlf, BZ Administrator February 26, 1996 Consider Wetland Mitigation by Dan Bowman Issue In order to construct the roads in the plat of Ridgewood Hills, it is necessary to fill 1.71 acres of type 2 wetlands. There is a site plan attached showing the location of the areas to be filled. That site plan also shows the location of the 3.42 acres of wetland (at a ratio of 2 to 1) that will need to be created to replace the wetland filled. The City of Elk River is the Local Unit of Government (LGU) responsible for reviewing this type of request for compliance with the Wetland Conservation Act (WCA). The City's Technical Evaluation Panel reviewed this request. This panel is made up of a representative from the State Board of Soil and Water Resources, Sherburne Soil and Water Conservation District, City Engineer Terry Maurer, and Stephen Rohlf. We concluded that the request is in compliance with the WCA and offer the following findings: · The developer has minimized the impact on the wetlands as much as he could by modifying his plat (moving the road as far south as possible). · The developer tried to avoid impacting the wetlands by trying to gain access to his property from adjacent property. · Not being able to fill wetland would mean not being able to access the property, which would constitute a hardship. Recommendation The Technical Panel is recommending that the Council approves the wetland mitigation plan for Mr. Bowman with the following conditions: That this approval is subject to obtaining the necessary permit from the Army Corps of Engineers. s:kb&z\steverkbow-wet.doc 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 o That the letter of credit for the improvements in the plat also covers the cost of the replacement wetlands for one year after the City approves their construction and that the developer agreement reflects this. o That the replacement wetlands are protected by having a restrictive covenant recorded. o That the bottom of the culvert for the proposed road in the location of former Judicial Ditch #1 is at the approximate level of the existing wetlands so they are not drained. That the slopes of the replacement wetlands are a maximum to 4 to 1 for safety and no materials excavated from any wetland can be placed back into a wetland. o That the developer provides the City with a status report on the replacement wetlands one year after they are created.
