RESOLUTION OF THE CITY OF ELK
A RESOLUTION APPROVING NOT
SUMMARY PUBLICATION OF ORDINANCE
AN ORDINANCE REPEALING ALL OF CHAPTER 26, ARTICLE TT,
"TOBACCO." AND ADOPTING NEW CHAPTER 26, A IC LE lip
"TOBACCO," OF THE CITY CODE OF ORDINANCES
WHEREAS, o July 21, 2008 the Elk River City Council adopted Ordinance 08-08 an
Ordinance repealing Chapter 26, article II, titled "Tobacco," and adopting a
new Chapter 26, Article 11 tided, "'Tobacco," of d -ie City Code of
ordinances and
WHEREAS, the adoption to the ordinance sets forth defiitions, licensee respo sibIties,
compliance checks, app.catio rerrnets for applying for a Ecense,
grounds for granting or denying a license, transfer of ownership and hoer it
applies to licensing, penalties, applicants rights for a hearing process,
vetatio reu.rements for tobacco products shops, and distance
requirements to schools /parts for tobacco products shops; and
WHEREAS, a copy of the f .0 text of this ordnance is available by standard or electronic
mail or for inspection at the office of the Elk River City Clerk, 13065 Orono
earl ay, during regular business hours, 8:00 a. m. to 430 p.m., Monday

NOW, THEREFORE, IT RESOLVED, that the City Council, by at least four -- fifths
