RESOLUTION NO. 01-45
IN THE MATTER OF THE JOINT
RESOLUTION OF THE TOWN OF
BIG LAKE AND THE CITY OF
ELK RIVER DESIGNATING AN
UNINCORPORATED AREA AS IN
NEED OF ORDERLY ANNEXATION
AND CONFERRING JURISDICTION
OVER SAID AREA TO THE
MINNESOTA OFFICE OF STRATEGIC AND LONG RANGE PLANNING
PURSUANT TO M.S. 414.0325
JOINT RESOLUTION
FOR ORDERLY ANNEXATION
The Township of Big Lake and City of Elk River hereby jointly agree to the following:
1. That the following described area in Big Lake Township is subject to orderly
annexation pursuant to Minnesota Statutes 414.0325, and the parties hereto designate this
area for orderly annexation, to wit:
That part of the Northeast Quarter of the Southeast Quarter of Section 13,
Township 33, Range 27, Sherburne County, Minnesota described as follows:
Commencing at the northeast corner of said Northeast Quarter of the
Southeast Quarter, thence on an assumed bearing of South 2 degrees 3
minutes 54 seconds east along the east line of said Northeast Quarter of the
Southeast Quarter, a distance of 426.81 feet to the point of beginning; thence
continue south 2 degrees 3 minutes 54 seconds east along said east line a
distance of 410.82 feet; thence north 85 degrees 27 minutes 37 seconds west
a distance of 256.95 feet; thence north 2 degrees 3 minutes 54 seconds west a
distance of 20.27 feet; thence north 12 degrees 40 minutes 47 seconds east a
distance of 379.65 feet to a line that bears north 89 degrees 50 minutes 55
seconds west from the point of beginning; thence south 89 degrees 50
minutes 55 seconds east a distance of 158.77 feet to the point of beginning.
2. That the Town Board of the Township of Big Lake, and the City Council of
the City of Elk River, upon passage and adoption of this resolution and upon acceptance by
the Office of Strategic and Long Range Planning, confer jurisdiction upon the Office of
Strategic and Long Range Planning over the various provisions contained in this Agreement.
3. That the 1.94 acre property to be annexed abuts the City of Elk River and
Big Lake Township.
4. That annexation of the property identified in Paragraph No. 1 above is
therefore in the best interest of the area proposed for annexation and the aforementioned
property will be immediately annexed to the City of Elk River.
5. That upon annexation, the property annexed shall be zoned Rla, Single
Family Residential.
6. Both the Town of Big Lake and the City of Elk River agree that no alteration
of the stated boundaries of this agreement is appropriate. Furthermore, each party agrees
that no consideration by the Office of Strategic and Long Range Planning is necessary.
Upon receipt of this resolution, passed and adopted by each party, the Office of Strategic
and Long Range Planning may review and comment, but shall, within thirty (30) days, order
the annexation in accordance with the terms of this joint resolution.
