Background
The City entered into a development agreement with MetroPlains Development at the end of last
year. Since that time staff has been working closely with MetroPlains to make progress on a number
of activities leading up to the anticipated summer project construction.
Current Activities
US Bank PropertX
MetroPlains closed on the purchase of the US Bank property on July 18`''. MetroPlains now owns
the three properties necessary to complete The Bluffs of Elk River project.
Downtown Parkin
King Avenue Parking Lot Improvement
The construction of the King Avenue parking lot improvement commenced in early June and is
nearing completion. The east side of the lot will be seal coated and the entire lot will be striped
within the next two weeks.
The Street Department is currently working on signage for the lot, which will include the following
designations:
• Employee Parking Only-Permit Required
• Resident Parking Only-Permit Required
• Time limit signs

• General sign identifying the lot as a City lot (this sign will mirror the below image per the
King Avenue Parking Lot Task Force recommendation)
Dazvntosvn Parking Ordinance Amendment
The HRA and City Council provided input in July to a downtown parking ordinance amendment
prompted by King Avenue Parking Lot Task Force recommendations. The attached memo to the
City Council from the Director of Planning includes a revised version of the amendment and
indicates a timeline for parking enforcement.
Construction Traffic Flow Plan/Public Safety
As the liaison between the contractors and the City during construction, Fire Chief Bruce West
coordinated City staff's review and recommendations of the traffic flow plan during construction.
Chief West presented the plan to the City Council on July 18`" The attached plan was accepted by
the City Council that evening.
Construction Plans/Designs
The following sequence of discussion took place regarding the approval of the construction
plans/designs:
• May 16`" Council approved construction plans/designs
• June 6`" HRA provided comments on plans/designs
• June 27`"Council met with MetroPlains to discuss a refined design for The Bluffs of Elk
River project, the Council requested additional refinements to the turret and visual
breakup of the mid-section
• July 5`" HRA provided comments to the refined design
• July 11`" Council/HRA work session, the Council and HRA accepted the second version
of the refined design
Jackson Square Flag Pole
There is a separate memo regarding this issue in which HRA action is requested.
Jackson Square Gazebo
Guardian Angels and Meadowvale School indicated interest in the gazebo, however both groups
have decided the cost to relocate the gazebo is too expensive. Most recently, the gazebo was
purchased by a private party on July 16`" at the City auction. A condition of the sale was that the
gazebo be moved no later than August 31 s`. The gazebo will be demolished if it is not moved by this
date.

Consider Ordinance Amendment -Chapter 74 of the Elk River
City Code of Ordinances Related to Parking

Per the City Council's direction on July 18`'', staff has amended the ordinance to reflect the
discussion relating to overnight parking.
Recommendation
Staff recommends that the City Council adopt the amended ordinance related to parking.
Per the City Council's direction, enforcement of the parking limitations will begin as soon as
the ordinance is published and becomes effective (August 10, 2005 at the earliest). Staff is
working on ensuring that signs are correct and in place and preparing a letter to downtown
businesses and residents regarding parking enforcement and availability of permits, which
have arrived.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTIONS 74-97 AND 74-99
OF THE CITY CODE OF ORDINANCES
Case No. OA 05 - 10
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 74-97 titled Nighttime parking in Business District of the
City of Elk River Code of Ordinances shall be amended read as follows:
Sec. 74-97. Nighttime parking.
(a) No vehicle shall be parked between 2:00 a.m. and 6:00 a.m. on Lowell and Jackson
Avenues between Highway 10 and Main Street, on Main Street between Lowell Avenue and
Highway 10, on Jackson Avenue between Highway 10 and 5`'' Street, and on Railroad Drive.
In addition, no vehicle shall be parked between 2:00 a.m. and 6:00 a.m. in the municipal
parking lots along the Burlington Northern Railroad.
(b) No vehicle shall be parked between 2:00 a.m. and 6:00 a.m. in the King Avenue
parking lot unless it is displaying a resident parking pernut as issued by the Police Chief or
his designee.
(c) Violations of this section are punishable as provided in section 74-91.
Section 2. Section 74-99 titled Reserved Parking in Municipal Parking Lots of
the City of Elk River Code of Ordinances shall be amended read as follows:
Sec. 74-99. Parking in municipal parking lots.
(a) The municipal parking lots along the Burlington Northern Railroad are designated
for either commuter or public parking.
(b) The posted employee parking area within the King Avenue parking lot requires
employee vehicles to display parking permits as issued by the Police Chief or his designee.
(c) Violations of this section are punishable as provided in section 74-91.
Section 3. That this ordinance shall take effect upon publication as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 18th day of
July, 2004.
