Schedule Special Meeting for April 11
Phoenix Enterprises and Menards, Inc. are requesting that the City Council
schedule a special meeting on April 11, 1996, at 6 p.m. to consider a
conditional use permit for site plan review for the Menards facility in Hillside
Crossing II Planned Unit Development.
Action Requested
The City Council is asked to call a special City Council meeting on April 11,
1996, at 6 p.m. to consider the request for conditional use permit for
Menards, Inc.

As the Hillside Crossing II Addition moves forward, it is reasonable to assume that its
development will bring with it the need for a traffic signal at the intersection of 197th and
T.H. 169. I have had conversations with Gary Durlum, the District 3 Traffic Engineer,
regarding this very issue. He has indicated to me that he felt MnDOT would use State
rather than Federal funds for any signal installation at this intersection, in that the funding
would be 50% MnDOT and 50% local based on the four legs at the intersection. He felt
that this project could be'accomplished through a cooperative agreement much like the
Joplin/T.H. 10 intersection.
The most likely scenario for funding would be fiscal year 1998 which begins July 1997.
The first step in applying for a cooperative agreement project would be to do a Signal
Justification Report and try to prove that a signal will be needed when the expected traffic
is generated by the Hillside Crossing II Development.
As you are aware from previous cooperative agreement projects, this is a rather time
consuming process; therefore, I would recommend that the City initiate the process as
soon as possible by authorizing the preparation of a Signal Justification Report and
application to MnDOT for a cooperative agreement project to signalize the intersection of
T.H. 169 and 197th Avenue.

The Developer of Hillside Crossing II has indicated his desire to proceed with plans and
specifications as quickly as possible. Anticipating a favorable response from the City
Council on March 11, 1996, to the Comprehensive Land Use Plan Amendment, Rezoning,
Preliminary Plat, and Conditional Use Permit, I have prepared a draft resolution for the
City Council's consideration, which would authorize the preparation of plans and
specifications. Action on this resolution by the City Council should not only be contingent
upon a favorable outcome on the above-listed items, but also on the Developer submitting
a signed petition requesting the public improvements and waiving all rights to appeal any
assessments. It should also be conditioned upon the Developer placing an escrow account
with Lori Johnson to cover the engineering work prior to us proceeding on the plans and
specifications.
As you are aware, I will be out of the office the week of March 4th; however, I will be
back in town and in attendance at the March 11 th City Council meeting. At that time, I
will be prepared to answer any questions either you or the City Council may have.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE
PREPARATION OF PLANS AND SPECIFICATIONS IN
THE MATTER OF THE HILLSIDE CROSSING II IMPROVEMENT
OF 1996
WHEREAS
WHEREAS
the Owner of the property has submitted a petition requesting public improvements
and waiving his rights to appeal the assessments; and
the City Council has duly considered those matters presented at the public hearing
on the preliminary plat by those persons desiring to be heard on the matter;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
MSA, Consulting Engineers is hereby designated as Project Engineer for this
improvement. The Project Engineer is directed to prepare plans and specifications for the
making of the improvement and the solicitation of competitive bids.
Passed and adopted this 1 lth day of March, 1996.
