Request
Consider Ordinance No. 96- ., amending the dimensional regulations set
forth in the zoning ordinance for urban residential zoning districts (Rlc, Rld
and Rle), and add the previously adopted standards for the BP and C4
zoning districts.
Overview
This ordinance amendment basically addresses the minimum lot size
requirements for single family zoning districts which are intended to be
served with city water and sewer. The ordinance amendment can basically
be broken down into three parts. These three areas are as follows:
Amending the dimensional regulations for the Rlc and Rld zoning
districts, clarifying the minimum lot size requirement prior to city water
and sewer, and in addition, the minimum lot size when water and sewer
is ultimately available.
The Rle zoning district currently requires a 20,000 square foot minimum
lot size. The Planning Commission discussed establishing a new
residential zoning district with a minimum lot size larger than the Rlc
district for all of that residential area recently included within the urban
service expansion area. Rather than creating a new district, it was
recommended by the Planning Commission that the Rle district be
adjusted accordingly, since the only Rle zoning that exists in the City is
the Hillside Estates area, which will eventually be changed to a PUD, and
create the appropriate dimensional regulations as recommended by the
Planning Commission. Once again, these dimensional regulations would

require a 10 acre minimum prior to city water and sewer, and when water
and sewer is then available, subdivision of property into 12,000 square
foot lots could be requested.
Lastly, this schedule of dimensional regulations was never updated to
include the new business park and neighborhood commercial zoning
districts. Therefore, these two districts are being included as part of this
section of the zoning ordinance with the standards as previously adopted
by the City Council.
Please refer to the attached report to the Planning Commission for additional
information.
Recommendation
It is recommended the City Council approve Ordinance No. 96-__,
amending the dimensional regulations for urban residential zoning districts,
as well as the previously adopted standards for the business park and
neighborhood commercial zoning districts.

The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 900.18 of the Elk River Code of Ordinances is
hereby amended to read as follows:
See Attached Exhibit A
Section 2. That this Ordinance shall take effect and be in full force
from and after the date of its publication.

Request
The City of Elk River is requesting an ordinance amendment to change the
dimensional regulations for urban residential (Rlc, Rld and Rle) zoning
districts and add the previously adopted standards for the BP and C4 zoning
districts.
Overview
With the recent expansion of the urban service boundary and upcoming
rezoning requests to change properties currently zoned for 2-1/2 acres,
certain amendments to the dimensional requirements need to take place.
The first adjustment is to modify the dimensional regulations to clearly state
the minimum lot size in the Rlc, Rld and Rle residential zoning districts for
both sewered and non-sewered conditions. In urban residential zoning
districts, the minimum lot size in a non-sewered condition (without water
and sewer), the minimum lot size will be 10 acres with 300 feet of frontage.
When water and sewer is made available to the properties, the subdivision to
urban size lots may occur in accordance with the dimensional requirements
outlined in each zoning district.
The second modification pertains directly to the Rle dimensional regulations
which is taking place as a result of the Planning Commission's discussion to
rezone the residential properties within the urban service boundary to a
residential district which requires a 12,000 square foot minimum lot size
with water and sewer. Rather than creating a new zoning district, staff is
recommending that the Rle zoning be utilized since the only location that it
exists in the City is the Hillside Estates area, which will ultimately be
converted to a planned unit development. Using this zoning designation

allows modifications to an existing ordinance rather than creating a new
district.

The last change being made to the dimensional regulations relates to the
Business Park and Neighborhood Commercial zoning districts. These zoning
districts need to be included as part of the dimensional regulations as they
were previously adapted.
Attached are copies of the schedule of dimensional regulations as they
currently exist in the zoning ordinance, as well as a copy reflecting the
proposed changes.
Recommendation
Staff recommends the Planning Commission recommend approval of the
ordinance amendment adjusting the dimensional regulations in the Rlc, Rld
and Rle zoning district designations, and BP and C4 changes as outlined in
the attached exhibit.
