The retail space currently is allowed signage which is visible from Zane Street, Highway 169, and various locations in the development. The Planning Commission recommends approval. Summary The PUD Agreement was created and entered on December 21, 1999. The development standards regulate the typical items such as building materials, lighting, and signage. This PUD agreement specifically identifies the subject site, the retail building attached to the north .ride of the proposed home improvement store, for signage. The applicant is looking to amend the PUD agreement to allow signage on the side of the retail building that is attached to Home Depot. Planning Commission Discussion The Commission members that voted for the amendment believed that precedent had been established with other signage changes and this building/project is one of the last in the development. The Commission members that voted against the amendment believed it is the responsibility of the Planning Commission to adhere to the rules where clearly defined. The Planning Commission voted 4-2 to recommend approval of the amendment to the PUD Agreement. Public Comment The applicant stated that the additional signage was not intended for off-site visibility. As the store is not a destination, the signage is intended to catch people leaving Wal-Mart. It was also mentioned that most of the other businesses in the area have at least two signs and this request would not be an extreme change and would not be out of character of the development. Capital letters shall not exceed 36" high, loaner case letters shall not exceed 24" high. Signs shall be for store identity only and shall not be alloaved on the rear or side of building. Signs shall not extend closer than 3 or 4 feet from the projected lease line. If the space is leased by a single tenant, sign area shall not exceed >O percent of the area of the building avail, including doors and avindoavs, to avhich the sign is to be affzxed. The standards specifically call out the subject property as well as specifically identify the rear and side of the building. There was no indication in the past staff reports or minutes indicating why this specific area was regulated like this. One reason may have been because of the proximity to the residential neighborhood nearby. The applicant believes the City of Elk River should approve the proposed amendment to allow channel letters on the side elevation based on the visibility of this elevation from the Wal-Mart and the traffic in and around this area. The development standards are straight forward and are specific to the subject property. The retail space is allowed signage (on the west elevation) which is visible from Zane Street, Highway 169 and various locations in the development. Given the fact that the retail space has existing signage that is S:\PLANNING MAIN\Case Files\CUP\CU 08-18 Anchor Sign-Dollaz Tree\CU 08-18_PC.doc Case File: CUP 08-18 Page 3 Dollar Tree Anchor Sign visible, staff does not support the proposed amendment and therefore is recommending denial of the request.
