All comments of the Public Works Director memo dated September 11, 2008 shall be addressed. 2. The development shall meet all applicable fire codes. The Fire Chief shall verify the location of all fire hydrants, and may require additional hydrants necessary to preserve the health and safety of the residents. 3. A wetland buffer of 25 feet apply to all wetlands and a structure setback of 20 feet from the buffer applies. An exhibit shall be prepared illustrating this buffer. 4. In addition to the easements shown on the preliminary plat, the following easements shall be provided: a. 20 foot wide drainage and utility easements over any watermain extensions b. A 25 foot easement adjacent to the outside edge of delineated wetlands, to note, preserve and protect the required no-touch buffer in lot 1. 5. A NPDES permit is required prior to final approval of construction drawings. 6. The following fees shall apply: a. Water and sanitary sewer trunk fees shall be paid at the time the final plat is released for recording. This fee shall be at the rate applicable at the time the final plat is released. b. A surface water management fee shall be paid at the time the final plat is released for recording. 7. Park dedication shall be provided in the following manner: a. In the form of cash for 3.93 commercial acres at the rate applicable at the time of final plat approval (currently $27,313.50 or $6,950/acre). 8. All required subdivision/park information shall be provided in an electronic format (.dwg file) as required by the City ordinance and Land Use Application prior to recording of the plat. 9. This approval of the preliminary plat shall expire after one year, unless the property owner or owners agent has submitted a final plat or letter of request for extension. The City must take action by October 20, 2008 Requested Action Approval of an Administrative Subdivision by Simple Plat Location and Size Approximately 6.94 acres south of 193rd, east of the SuperAmerica gas station. Overview The applicant wishes to split the lot into two parcels, one an outlot and not buildable, and the other a buildable lot (3.93 acres) Applicable Regulations Subdivision These findings are necessary for the City Council approval of the preluivnary plat and the final plat: (9) The proposed subdivision is consistent avith the honing regulations (article VI of this chapter) and conforms in all respects aa~ith all requirements of this Code, including the honing regulations and this article. (2) The proposed subdivision is consistent with all applicable general and specialised city, county, and regional plans, including but not limited to, the city's comprehensive development plan. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to jlooding, and drainage are suitable for the type and density of development and uses contemplated. (4) The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required in this article. (5) The proposed subdivision will not cause substantial environmental damage. (8) Theproposed subdivision is notpremature. A subdivision ispremature if any of the following exists: a. Lack of adequate stormwater drainage. b. Lack of adequate roads. c. Lack of adequate sanitary sewer systems. d. Lack of adequate off-site public improvements or support ystems. In the review of the standards for final plat as outlined, it appears that the request is consistent with all of these standards. Analysis The lot split is consistent with the Comprehensive Plan and zoning ordinances. Natural Resources Natural Resources Inventory (NRI) -The NRI does identify significant natural forested areas on the subject parcel, although the majority of these features is located on the outlot portion of the site. Trees -Generally, the eastern 4/5 of the site is heavily wooded. Many of these trees will be removed as part of the development of the site. Wetlands -There is a small wetland on the property that will likely be mitigated as part of the site development. Parks Park Plan -The Comprehensive Park Plan does not indicate any park target area nor trail corridor in the wider area. Transportation Streets - No new streets are proposed. The city engineer has suggested that access onto 19314 be restricted to one point for the two lots. It is hereby determined by the City Council for the City of Elk River as follows: A. The proposed plat is consistent with the Land Use Regulations and conforms with all of its requirements. B. The officers of the City axe hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat fox the Property and to issue a certified copy of this Resolution giving final approval of the plat. 4. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. 5. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time. The proposed plat creates approximately a 4-acre lot for the Minnesota School of Business building and a 3-acre outlot lying to the east. Based on our review, we would offer the following comments: 1. The two lots should only be allowed one access point onto 193' Avenue. The site should be laid out so that they can share this access along with the access onto Evans Street. If the access onto 193` Avenue is along the lot line between Lot 1 and C+utlot A, it will be a right-in, right-out only as there is a proposed concrete median with the 193` Avenue project to define the turn lane at the intersection. To gain full access onto 193` Avenue, the drivewaywill need to be moved further to the east and would therefore require additional easement or a cross-access agreement over C+utlot A. The rema;r,;r,g frontage along 193` Avenue (outside of the driveway] should be designated as restricted access. 2. Sewer and water is available from Evans Street, or the water could also be extended from 193` Avenue. There will be a requirement for internal hydrants, therefore the watermain will be considered a public facility. Twenty-foot wide drainage and utility easement will be required across Lot 1 and C-utlot A for any waterniain extensions. 3. There is existing diagonal parking along Evans Street at the south end of Lot 1. It appears from the topographythat this falls within the lot itself. It appears that additional easements should be provided to cover this existing parking area. This easement would be in favor of whoever would owns the parking, not the City.
