SUBJECT: Administration Items
The activity level around City Hall has been very high and, to be truthful,
there hasn't been a great deal of time available to do detailed memos on the
administration items for the 3/25/96 meeting. Accordingly, this memo on the
administration agenda items will be brief and most of the background on the
items will be presented verbally at the meeting.
5.4. Ice Arena/Mighty Ducks Grant (Round Two)
Per action of the City Council on 3/11/96, the city is on schedule to
receive ice arena bids in mid-to-late April (see attachment).
Information has been received from the Sports Commission regarding
the second round of the Mighty Ducks Grant program (see
attachments). Funds at this time have not officially been approved for
the second round of the grant program, but this is expected to take
place in the very near future. Accordingly, grant applications are due
April 5, 1996. The Elk River Grant application will be the same as
before with a cover letter explaining the changes in the project to
reduce the overall cost of the arena.
It is appropriate for the City Council to approve a motion authorizing
the resubmission of the Mighty Ducks Grant application for the arena
project as amended.
5.5. Cass Property Update
The Cass property purchase has been completed. The city now owns
115 acres in the southwest corner of 165th Avenue and Jarvis Street.
As previously reviewed by the Council, this property will be used for
recreation fields, sludge land (which will later be used for recreation

fields in fifteen years), and the balance of the property (eastern
portion) will be subdivided and marketed for about six (6) home sites.
The development of the recreation fields is slowly moving through the
Park and Recreation Commission and the funding of these fields is a
major issue that will need to be discussed by the Commission and
Council at an upcoming joint meeting. The Commission has been
trying to obtain commitments from the youth organizations to help
finance the development of these fields, but progress has been slow in
this regard.
Regarding the residential properties for future lots, staff is requesting
Council approval to have the city engineer do the survey work and plat
under the direction of the city planner. In this manner, the City
Council will see a subdivision proposal some time this summer for
some city property to be developed as six (6) single family sites. This
area is in the 21/2 acre zone of the city which is not scheduled to have
sewer and water.
5.6. Administration Personnel- Clerical Staff Adiustments
The work load is getting heavier in all the administration departments
and more assignments and work are being passed on to the clerical
staff for processing. The request which follows is not a "knee jerk"
reaction to not having the economic development coordinator on staff
and having more work fall on my desk. The work load has been
increasing for some time and some clerical adjustments have been
discussed for over a year.
It is recommended that Administrative Secretary Alice Heinecke have
her title adjusted to more accurately reflect the work that she has been
doing. The new title recommended is Executive Secretary and the pay
range will go from Grade 8 to Grade 10. Additionally, it is
recommended that her pay step of G plus $.35 be adjusted from Grade
8 to Grade 10. This Executive Secretary position, pay range, and
ranking was identified in the comparable worth plan that the Council
approved last year.
Another clerical adjustment that is needed is to change the status of
Joni Pearson as a part time office service worker to a full time office
service worker. Joni is an outstanding worker and her services are
needed in the administration area to help with the clerical work load
for the finance, economic development, administration, street/park,
fire, WWTS, and the "anything else that gets left on our desk"

departments. There is no change being requested in the pay grade or
hourly pay for Joni.
Both of these changes would be effective Tuesday, March 26, 1996.
5. 7. City/County 3/19 Joint Meeting
It is appropriate to review our discussions with the County Board that
took place on 3/19/96. A number of topics should receive some
discussion by the City Council including: County Road 1
improvements, County Road 12 improvements, a review of the
Steering Committee's recommendation on the transportation plan, the
city street next to the County Administration building, and the city's
position on the Fair relocation (or not).
5.8. MSA System
The city has less than a mile to add to its MSA system. Mileage being
added to the map ensures that the city will receive its maximum
annual MSA funds. The street designations can change provided funds
have not been spent on improvements to that section of the street.
Attached for your review is some material from the city engineer on
adding mileage to our MSA system. It is being recommended that we
add a future road connection between County Road 12 and 173rd/175th
(the Snake Trail) east of Highway 169. A complete map of the city
MSA system will be available on Monday.
5.9. Riverview Heights Sewer and Water Information
The City Council received an update on the general opinions of the
residents that attended the Riverview Heights sewer and water
informational meeting. However, during that Council update, a
request was made for more specific information on the actual cost of
the improvements for this neighborhood. The city engineer has
included this information in the packet.
5.10. Rip Rap Grant Application
Attached for your consideration is the rip rap grant application that
the city annually submits. We actually receive funds about every third
year, but sometimes you can get lucky and can receive the funds more
frequently. It is recommended that we submit the grant application
again in 1996 for the third phase of the rip rap project which would go
from the Dare funeral home area further to the southwest.

Last year the HRA provided the matching funds for this project. If the
Council is going to ask the HRA to provide the match for this
application, then this request should formally be made and processed
to the HRA. The Council should always be aware that this request
may not be approved and that it may have to identify city funds for the
local match (or half the match if the HRA splits this expense with the
city).
Meeting Schedule
A number of meetings should be set up for the near future. These
meetings include: City Council/Planning Commission; City
Council/Park and Recreation Commission; City Council/Utilities
Commission; City Council- Consideration of the Master Park and
Recreation Plan; City Council - CIP Worksession (finance and plan
overview).

This RFP was publish.ed in the March 4 issue of the "State Register". The RFP is contingent
upon positive action by the 1996 Legislature. At the time of this mailing, it remains uncertain.. ·
what the legislature will determine.
Assuming there is a program and in order to assist communities who are ready to' construct in
1996, we have established an April 5, 1996 deadline. The Minnesota Amateur ~ports
· Commission (MA. SC) may act as early as April 22, 1996 on some applicants. Correspondingly,
we have an October 5, 1996 deadline for those communities interested in constructing in 1997.
The MASC would act as early as December 16, 1996 on those respective applicants..
Please note that the new RFP significantly simplifies the format'required for renovation grants.
· Also, to the extent possible and practical, the MASC will again use congressional districts as a
general guideline to award grants to achieve geographic equity.

Chair Minton closed the public hearing (9:55 p.m.).
Mary Eberley suggested that some discussion be given to how growth can be
slowed. Steve Ach explained that when the urban service boundary is
established, growth management practices may be implemented such as
restricted minimum lot sizes, to control growth. He noted that there are residents
in the northern area currently in the 10 acre minimum lot size zoning who want it
reduced to 2-1/2 acres. He explained with the current zoning, the population
saturation coul~ be 40,000. *
Dave Anderson expressed his concern regarding the high traffic counts projected
for the proposed roadway. He stated that he has spoken with Mn/DOT officials,
the Sherburne County Highway Engineer, the District A.P.O. He explained that
the Mn/DOT supports the practice that external-external traffic use their system
and not minor arterials within a city or rural area. Dave indicated that the Distdct
A.P.O. appeared to be shocked by the proposed traffic projections for Highway
169 and Highway 10. He sated that he cannot support the need for the corridor
for the reason that it does not serve the citizens of Elk River.

RE: DESIGNATION OF MUNICIPAL STATE AID ROUTES
Dear Mr. Klaers:
We have finished the update of the Municipal State Aid system and find that the City has
approximately six-tenths of a mile of undesignated MSA route. Last year, there was
approximately half of this amount; therefore, no designation of new MSA routes was made
in 1995. Previous to that, in 1994, we deleted some routes and added 201st Avenue,
193rd Avenue, and a south frontage road in the Western Area. These roads reflected
components of the draft transportation plan.
Six-tenths of a mile does not allow a major addition to the City's MSA system. However,
with the revoking of a current MSA route, perhaps one of the small segments located in
the downtown area such as Lowell or Evans Avenue south of Main Street, we could
designate the proposed route from County Road 12 (181st Avenue) south to 175th Avenue.
In the future, as more mileage becomes available, we could complete the route from 175th
Avenue down to 171st, and out to TH 10. As you are aware, we have previously sent a
letter to Mike Tardy, District 3 State Aid Engineer, indicating that the City would be
considering this addition to the system. He has made a review of this preliminary request
and has indicated that he finds it acceptable.
I have enclosed a copy of the 1995 Municipal State Aid Street System map on which I
have indicated where this addition would be. I will be in attendance at Monday evening's
meeting should you or any of the Council members have questions regarding this issue.

As directed by the City Council, we have made a more detailed estimate of the costs for
providing City utilities and new streets in the Riverview Heights development. We have
estimated the total cost of the project to be slightly more than $1.5 million. This would
include sewer extended down from the County Administration Building where it is
currently located, water looped through the development, storm drainage as required, and
new streets including concrete curb and gutter. To the total construction costs we have
added a 5 % contingency and the normal 28 % City overhead. To get to a total assessment
per lot of between $12,000 and $12,500, we have assumed the City would fund the cost
of sanitary sewer from where it is located to County Road 30. We have also assumed that
the City would pay for trunk oversizing of the watermain and approximately half of the
street construction costs. Based on these assumptions and the contingency and normal
overhead discussed earlier, the City's cost would be approximately $450,000. The
following table gives a breakdown of these costs:

As you know, we have received grants totaling nearly $45,000 from the Sherburne County
Soil and Water Conservation District (SWCD) for placement of rip-rap along the
Mississippi River in the downtown area. This work has significantly eliminated erosion
problems in the area and is a cost-effective measure that should last many years.
It is time again to apply for 1996 funds. Discussions with Mr. Bill Bronder at the SWCD
indicate they have $150,000 available in 1996, which will be used to provide 50% funding
for approved projects. The attached application requests $25,000 from the SWCD. As
in 1991 and 1994, the City must be willing to match the grant with $25,000. It would be
appropriate for this grant application to be discussed and approved at an upcoming City
Council meeting. Should the application be approved, please sign and date two copies of
the application in the places we have marked, and return them to me. As with past grant
applications, there are no guarantees that ours will be selected, but we believe we have a
good chance. Please contact me if you have any questions.

Rip rap is currently located approximately 600 feet west of the Elk River Bridge
over the Mississippi River. Erosion continues to occur where the existing rip rap ends.
We are requesting funding assistance to further mitigate these erosion problems.

This project would be a continuation of previous'ly funded SLR Project:
in May 1991 and May 1994. These projects allowed placement of rip rap
from the Elk River Bridge to the west. This application would allow
extension of this rip rap further to the west. Rip rap is the most cost
effective solution to the problem.

Upon approval of the SLR application, the City would seek bids from
private contractors. We would plan to construct the improvement as soon
as possible following bids, at a time when the water level is low. The

the riverbank. Floating debris covers the area of erosion during
peak flows of the River. We would estimate a tremendous amount of
soil is carried into the River, but it is difficult to put a quanti-
fiable estimate on the problem.
(c) The land adjacent to the River is owned by the City of Elk River.
(d) We would see at least two public benefits from completion of this
project. The first benefit would be to save~the riverbank and
minimize erosion polluting the Mississippi River. The~second, long
term benefit of saving the riverbank is to allow the City to plan
construction of a boardwalk and park along the Mississippi River.

(we), the undersigned, do hereby request cost-share assistance to help defray the cost of installing the
practices as listed below. It is understood that:
SLR Practices Installed with Cost-Share Assistance Shall Be Properly Maintained. If the proj-
ec! is removed, or modified, during their minimum effective life (10years) without consent of the Soil and
Water Conservation District, the land occupier shall be liable for monetary damages, not to exceed the
amount of financial assistance received from the district. If title to this land is transferred to another party
before expiration of the aforementioned effective life, it shall be the responsibility of the land occupier who
signed this contract to advise the new owner that this contract is in force.
2. Practices must be planned and installed in accordance with technical standards and specifications of
Mn/DOT
3. . City Engineer technician must make prior determination that the practices are
needed on the site where they are to be inst,.lied, and that they are properly planned and installed.
4. Items of cost for which reimbursement is claimed on form SWCB-6 are to be supported by .....
for payments and are to be verified by the district board as practical and reasonable.
5. An increase in the practice units and/or cost must be approved by the district as a condition to increases in
cost-share payments.
6. This contract, when approved by the Soil and Water Conservation District, will remain in effect unless
cancelled by mutual agreement, except that if installations of practices covered by this contract have not
been started b'y (date), this contract will be automatically terminated on that date.-
7. Practices will be installed by (date) unless this contract is amended by mutual con-
sent to reschedule the work and funding·
