Raivala Variance Findings
The fo]lowing are findings in support of the granting of a front yard setback
variance request by Jim and Kathleen Raivala for property located at 18648
Simonet Drive, Lot 3, Best Point of Lake Orono:
1. Literal enforcement of the Ordinance will cause undue hardship for the
apphcant. The granting of the variance will allow the apphcant to preserve
existing flower beds, a memorial flag pole and maintain a useable front yard. It
will also allow the neighbor continued enjoyment of their garden in that if the
variance is not granted, the garage will block off the hght for the garden.
2. There are special conditions which are pecuhar to this property. The adjacent
house is situated in such a way that their front windows look out over the
applicant's front yard. The granting of this variance will allow the construction
of the garage in a location that will minimize the impact on the neighbor's
house.
3. Literal application of the Ordinance will deprive the applicant of property
rights enjoyed by other properties in the neighborhood. There are three other
properties in the neighborhood that have constructed structures at a similar
setback from the street.
4. There are special conditions or circumstances that are not a consequence of
the apphcant's actions. The neighborhood was originally developed in the 1950's
and 1960's in a compact fashion with narrow setbacks.
5. The granting of this variance will be in keeping with the character of the
neighborhood. The character of the neighborhood is compact with buildings in
close proximity to one another and there are other properties with structures at
similar setbacks from the street.
