Adopt resolution approving summary publication of Ordinance 08-10 regarding administrative citations.
Background/Discussion
Council approved Ordinance 08-10 regarding administrative citations at the September 15, 2008 Council
meeting. The ordinance is lengthy and would be expensive to publish; therefore staff would like Council
approval for summary publication. A 4/5 vote of the Council is required.
Financial Impact
Publishing of Ordinance 08-10 would cost over $1,000. Summary publication costs would be
approximately $150-$200.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING NOTICE OF SUMMARY PUBLICATION
OF ORDINANCE NO. 08-10 AN ORDINANCE OF THE CITY OF ELK
RIVER AMENDING CHAPTER 50 OF THE ELK RIVER CITY CODE OF
ORDINANCES TO ADD ARTICLE V OF CHAPTER 50, INCLUDING
SECTIONS 50-200 THROUGH 50-217, PROVIDING FOR
ADMINISTRATIVE CITATIONS AND CIVIL PENALTIES FOR
VIOLATIONS OF THE PROVISIONS OF THE ELK RIVER CITY CODE OF
ORDINANCES
WHEREAS, on September 15, 2008 the Elk River City Council adopted Ordinance No.
08-10, an ordinance amending the City Code of Ordinances by adding Article
V of Chapter 50, entitled "ADMINISTRATIVE CITATIONS AND CIVIL
PENALTIES FOR VIOLATIONS OF THE CITY CODE; and
WHEREAS, Ordinance No. 08-10 provides for the issuance of administrative citations
and the imposition of civil penalties, in addition to any other legal remedy
which may be pursued, fox violations of the city code of ordinances; and
WHEREAS, Ordinance No. 08-10 further provides for the establishment of an appeal
board and an appeal process for administrative citations; and
WHEREAS, a copy of the full text of ordinance No. 08-10 is available by standard or
electronic mail or for inspection at the office of the Elk River City Clerk,
13065 Orono Parkway, during regular business hours, 8:00 a.m. to 4:30 p.m.,
Monday through Friday; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council, by at least four-fifths
vote, authorizes the publication of the title and summary of Ordinance 08-10
and that Ordinance 08-10 shall become effective upon publication of this
resolution.
