liability company (the -`Developer ") have entered z an :mended and Restated Development
AQreement.. d ated as of F 2006 (tjae "Deveiopment Aareement''} iz� connection vvitl�
the construction of a multifamily multifamily housincr and commercial development loc ed in the City- and
defined as the Bluff Block. Development and the Jackson Block Development in the
""Develapnent Aareement ('the e Project ); and

N THEREFORE-, BE IT RESOLVED bv the City- Council of the Cites of Ells F iver,
Minnesota,, as follows:

rate leases of units in the Bluff Block Hous a Project to individuals and families who were

2. The approval hereby given 6 to leases of units irz the Bluff Block Housu'ag Project is
temporary and for the ITnuted purpose of accommodating individuals and familles displaced by a
fire in the Li*ons Park Apartment build in the City. Such approval does not consiRptute an
amendment to the Development Agreement and alb terms and provisions of th
