Summary An Elk River Citizens Sign Committee is leading an effort to construct a "Welcome to Elk River" sign along Highway 10 near the eastern city limits. The sign will be similar to the west entrance sign by Lake Orono. In order for this to be allowed, an ordinance amendment is needed. The City Attorney has drafted the attached text. Planning Commission Discussion It was questioned is the signs would be allowed in road right-of--ways and if there was a size limit. Staff clarified that they would have to be located on city or private property and that there was no size limitations. Signs will not be allowed in any road right-of--ways. The Planning Commission unanimously recommended approval of the language. Public Comment There was no public comment. Action Requested Staff recommends that the Planning Commission recommend approval of the proposed language Background/Discussion An Elk River Citizens Sign Committee is leading an effort to construct a "Welcome to Elk River" sign along Highway 10 near the eastern city limits. The sign will be similar to the west entrance sign by Lake Orono. The issue is that corporate/municipality signs are not addressed in the city ordinance. The closest thing to defining this type of sign is an advertising signs (bill boards) which as defined does not really pertain to city entrance signs. The ordinance defines Advertising Signs as: A sign structure advertising an establishment, merchandise, service, or entertainment avhich is not sold, produced, manufactured, or furnished at the proper y on which the sign is located. Although the closest definition might be an advertising sign, the proposed property, in which the sign would be located, is zoned Commercial Reserve Transition (CRT) and does not allow advertising signs. The CRT zoning district does not address signage of any type. Staff has been working with the City attorney on the proposed language and does recommend the Planning Commission recommend approval of the language. The Ordinance Amendment would allow the sign in all districts, provided it was approved and/or sponsored by the city. Case File: CUP 08-18 City of Ell: River Page 2 Ordinance Amendment -City Entrance Signs Proposed Language Section 30-1 of the City of Elk River Code of Ordinances shall be amended to add a new definition of "City Monument Sign," as follows: City Monument Sign means afree-standing sign sponsored or approved by the City of Elk Biver for the sole purpose of ident~ing the City of Elk River. That Section 30-1 of the City of Elk River Code of Ordinances shall be amended to add a new definition of "City Monument Sign," as follows: City Monument Sign means afree-standing sign sponsored or approved by the City of Elk River for the sole purpose of identifying the City of Elk River. Section 2. That Section 30-886 of the City of Elk River Code of Ordinances, which identifies signs that are allowed in all zoning districts, shall be amended to add new Section 30- 886(13), as follows: (13) City Monument Signs Section 3.
