A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING SENATE FILE 1752; LEGISLATION
ALLOWING THE CITY OF ELK RIVER TO ISSUE SIX ADDITIONAL ON-
SALE LIQUOR LICENSES
WHEREAS,
the City Council adopted Resolution 00-lll in support of special
legislation to increase the number of on-sale intoxicating liquor licenses
to 18; and
WHEREAS,
special legislation has been adopted under Senate File #1752 allowing the
City of Elk River to increase its on-sale liquor licenses by six; and
WHEREAS,
without the special legislation the City would have to wait until the 2010
Federal Census to increase its number of liquor licenses allowed by state
law from 12 to 18; and
WHEREAS,
the City requested the special legislation because it believed that limiting
the number of liquor licenses would restrict Elk River's future quality
growth in service areas such as restaurants, hotels, and conference
centers that are necessary to serve the residents and citizens of the City.
NOW, THEREFORE, BE IT RESOLVED that Senate File #1752 reads as follows:
"The city of Elk River may issue six on-sale liquor licenses in addition to
the number authorized by law. All provisions of Minnesota Statutes,
Chapter 340A, non inconsistent with this section apply to the licenses
authorized by this section."
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council
approves the special legislation of Senate File #1752 which has been adopted into law.
Passed and adopted by the City Council of the City of Elk River this 10th day of September,
2001.
