Consider a request by Christian Builders for final plat approval of Elk Meadows.
Location
The final plat of Elk Meadows is located south of County Road 12 and west of Kliever Lake
Fields.

Overview
Elk Meadows is a 2.93 acre plat located on the east side of Kliever Lake Fields, on the south
side of County Road 12. As part of this plat 180th Avenue will be extended west into the plat
from Kliever Lake Fields. The proposed subdivision will include five lots; one for an existing
home fronting on County Road 12; and four with access on the newly extended 180th
Avenue NW.
The existing home is setback about 125 feet off of County Road 12 on the north side of the
property. There is also a shed located behind the house. The property is fairly flat with some
mature trees located around the existing house. On August 19, 2002 the City Council
approved the preliminary plat.
Layout
Streets
The applicant is proposing to extend 180th Avenue west from Kliever Lake Fields, through
this property to the western boundary of the plat. Since it is likely that 180th Avenue will be
extended further to the west in the future, the applicant is proposing a temporary cul de sac.
A sidewalk is proposed along 180th Avenue to connect with the sidewalk installed as part of
Kliever Lake Fields. The street layout is consistent with what was approved on the
preliminary plat.
Lots
A total of five single family lots are proposed. Four single family lots are proposed along
180th Avenue and one lot with access from County Road 12. The existing house will be
located on Lot 1 with frontage on County Road 12. The existing shed located on Lot 3 will
have to be removed. All of the lots meet the dimensional requirements of the Rle zoning
district. The layout of the lots is consistent with what was approved on the preliminary plat.
Grading. Draina_~e and Utilities
Grading, drainage and utility issues are addressed in the City Engineer's memo. The City
Engineer will be in attendance to address any outstanding issues.
Landscaping
Landscaping will have to be provided per the subdivision and landscape ordinances. One
boulevard tree and one front yard tree are required for each lot.
Park and Recreation
The Park and Recreation Commission recommended cash to meet the park dedication
requirements.
Recommendation
Staff recommends that the City Council approve the attached resolution granting final plat
approval for Elk Meadows with the following conditions:
1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED.
2. STREET LIGHTS SHALL BE INSTALLED AS REQUIRED BY ELK
RIVER MUNICIPAL UTILITIES.
3. A SEALCOAT FEE SHALL BE PAID PRIOR TO RELEASING THE
PLAT FOR RECORDING.
A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF
THE IMPROVEMENTS SHALL BE SUBMITTED PRIOR TO
RELEASING THE PLAT FOR RECORDING.
5. THE APPLICANT SHALL EXECUTE A DEVELOPER'S AGREEMENT
OUTLINING THE TERMS AND CONDITIONS OF APPROVAL.
6. THE APPLICANT SHALL PAY $300 PER UNIT TO ELK RIVER
MUNICIPAL UTILITIES FOR WATER AVAILABILITY CHARGES.
UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING
THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE
AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE
SUBMITTED TO THE CITY FOR THE PERIOD OF ONE YEAR.

A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT
REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT BE PAID
FOR FOUR LOTS PRIOR TO RELEASING THE PLAT FOR
RECORDING.

THE CITY ENGINEER PRIOR TO THE ISSUANCE OF BUILDING
PERMITS.
10. A DEVELOPMENT PLAN BE APPROVED BY THE CITY ENGINEER
PRIOR TO THE ISSUANCE OF BUILDING PERMITS.
11. A TREE PRESERVATION PLAN BE APPROVED PRIOR TO
RELEASING THE PLAT FOR RECORDING.
12. ANY TREES OFF SITE OR ON SITE, NEAR THE LIMIT OF GRADING
THAT ARE TO BE PRESERVED, SHALL BE FENCED WITH A SNOW
FENCE AT THE DRIP LINE TO PREVENT GRADING,
COMPACTION, OR STORAGE OF EQUIPMENT, DEBRIS OR
MATERIALS. STAFF SHALL INSPECT FENCING PRIOR TO
GRADING COMMENCING.
13. THE PARK AND RECREATION COMMISSION WILL REQUIRE FOR
PARK DEDICATION PURPOSES, CASH DEDICATION FOR FOUR
LOTS TO BE PAID AT THE RATE REQUIRED BY THE CITY PRIOR
TO RELEASING THE PLAT FOR RECORDING.
14. ALL MAILBOXES SHALL BE CLUSTERED.
15. THE EXISTING SHED ON LOT 3 SHALL BE REMOVED WITHIN 6
MONTHS OF THE RECORDING OF THIS PLAT.

RE: ELK MEADOWS ADDITION
Dear Mr. Harlicker:
As requested we have reviewed the submittal package for the Elk Meadows Addition. The submittal
package consisted of construction plans dated December 27, 2002, specifications, and grading plans.
Based on our review, we would offer the following comments:
Construction Plan
· Sidewalk shall be 6 inches thick rather than 4 inches so that driveways can be installed
anywhere along the road.
· The HDPE watermain along the west side of the project should be 8 inches (inside diameter)
instead of 6 inches.
· The valve on the south end of the HDPE watermain line should be moved to the north side of
the hydrant in order to shut off the line completely if necessary.
· Water looping outside of the Right of Way shall be HDPE, valved at each end with no
connections/services between. Therefore the house on Lot 1, Block 1, cannot be serviced by
the watermain on the west end of the project.
· The temporary easement along the west end of the project should be shown on these plan
sheets.
· The house on Block 1, Lot 1 is not fire protected and should be discussed with the City's fire
chief. A hydrant could be installed near CSAH 12 if the fire chief says one is required.
· The weadng course mixture should be 2350 Type MV4 Wearing Course Mixture instead of
2350 Type MV3 Weadng Course Mixture.
Grading Plan
· Show any easements that currently exist.
· An easement is needed on the south end of Block 2, Lot 2 in order for Lot 1 to drain across to
the existing pond in Kliever Lake Fields.
· Provide a standard house legend.
· There should be an easement provided along the north end of Block 2, Lots 1 and 2 in order to
install the temporary cul-de-sac.

· An easement is needed on the north end of Block 1, Lot 3 in order to accommodate for the
drainage across Lot 3 from Lot 2.
· The new ground elevations do not show that a swale was graded along lot lines.
· The drainage pattern in the northeast corner of Lot 3, Block I needs to be reviewed and
revised to follow the correct elevations.

· The specifications have been reviewed and are acceptable.

RESOLUTION NO. 03 -
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Elk Meadows
Case No. P 02-17
WHEREAS, application has been made for final plat approval, pursuant to Article
V. Section 30-374. of the Elk River City Code of Ordinances, of the property legally
described on attached Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the application for preliminary plat approval has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
WHEREAS, a preliminary plat of the Property was approved by the City Council on
August 19, 2002; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as
approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth
by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including, but not limited to, the City's
Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to
flooding, and drainage are suitable for the type and density of development and uses
contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.

The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.

Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.

The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member
and duly seconded by Council Member . The following voted in
