SUBJECT: Agenda Memo for Joint Meeting
Joplin Street/Orono Road Intersection and the Fairgrounds Property
The attorneys and staffs from the county and city have met to follow
up on the proposed terms and conditions for the county to sell property
to the city. On Tuesday evening, we hope to get approval of a
memorandum of agreement that will allow this street and fairgrounds
work to take place before the County Fair in 1995. Some of the terms
and issues that County Administrator Dave Loch outlined for the City
Council on 3/20/95 are still being discussed and worked on, but
everyone is optimistic that an agreement can be reached. The city has
• most of the responsibility for both parts of this project as our city road
work is requiring changes in the County Fair layout.
Regarding the actual price for the approximately 1.75 acres, a modified
appraisal has been ordered. The city and the county will split the cost
of this appraisal (under $500 each), and this appraisal report is
expected next week (maybe before our joint meeting).
It is hopeful that the memorandum agreement can be approved by
both the City Council and the County Board on 4/18/95. If this cannot
happen, the city may request permission from the county to proceed
with some of the components of the project with the understanding
that the final terms and conditions will be worked out. This may be
necessary so that the project can be completed before the County Fair
in 1995.
The City Council should note that most of the city expenses related to
the fairground parking lot are anticipated to be contracted out and not
done by our city street crew. This is due to the scheduled work load of
the city street crew in 1995. However, some work will be required
from Phil Hals and his employees due to the timing issues.

The council should also note that it is committing the use of city
property for fair parking for the next five years during the County
Fair. This may prohibit any other use of this property in the short
term.
2. Transportation
The city engineer, county engineer, mayor, and County Commissioner,
Arne Engstrom, should be able to present the transportation topics.
Mr. Duitsman and Mr. Engstrom are both on the city Comprehensive
Plan Committee that has been talking about long range transportation
plans. The city engineer and county engineer have also been talking
about these long range plans as well as some of the details related to
the proposed County Road 1 project.
3. County Ditches
Attached for your review is the proposed legislation that would allow
the city and county to work together to convey county ditches to the
city. Also attached is an update on the status of this legislation from
the city attorney.
One ditch that has been discussed recently is Ditch 10 and the city's
petition to release water into this ditch along Main Street and along
County Road 12. The county has recently approved the release of
water into this ditch provided that the city maintain the system from
the release point to the river. Both projects are moving forward.
I believe that there will be some comments on the status of the county
ditch the underneath Troy Street. This is part of Ditch 28. At this
time, it is desirable from the city's point of view, to have the county
install a permanent long-term improvement to this ditch in 1995. If
the state legislation has not been approved or signed into law at the
time of this work, then the city would request that the expenses that
would be assessed against Elk River properties be charged to the city.
The benefit that goes to property owners outside of the city's corporate
limits should appropriately be assessed out to these benefited
properties. The city needs a permanent long-term solution to the Troy
Street situation as soon as possible in 1995. Please note that the city
would need to review the work plan and cost estimates before agreeing
to pay the assessment for all of the Elk River properties.

• 4. Sewer and Water to the Government Center
The city engineer will provide an update on the status of this project
and will hopefully be able to answer any questions.
5. Miscellaneous Updates
As time allows, it is anticipated that county representatives will
provide updates on the status of the miscellaneous agenda topics.
