Action Requested
Staff recommends that the Planning Commission recommend denial of the Planned Unit Development
(I'UD) Agreement Amendment request, as illustrated on drawings dated 7-24-08, for the following
reasons:
1. The retail space currently is allowed signage which is visible from Zane Street, Highway
169 and various locations in the development.
Background/Discussion
The PUD Agreement was created and entered on December 21, 1999. The development standards
regulate the typical items such as building materials, lighting and signage. This PUD agreement
specifically identifies the subject site, the retail building attached to the north side of the proposed home improvement
store, for signage.
The applicant is looking to amend the PUD agreement to allow signage on the side of the retail building
that is attached to Home Depot.

Overview
The Elk River Crossing PUD Agreement Development Standards state:
lYlall signs for the retail building attached to the north side of the proposed home improvement store shall
consist of individual letters. Capital letters shall not exceed 36 high, loaner case letters shall not exceed 24"
high. Signs shall be for store identity only and shall not be alloaved on the rear or side of building. Signs shall
not extend closer than 3 or 4 feet from the projected lease line. If the space is leased by a single tenant, sign
area shall not exceed 70 percent of the area of the building avail, including doors and avindoavs, to avhich the
sign is to be axed.
The standards specifically call out the subject property as well as specifically identify the rear and
side of the building. There was no indication in the past staff reports or minutes indicating why this
specific area was regulated like this. One reason may have been because of the proximity to the
residential neighborhood nearby.
The applicant believes the City of Elk River should approve the proposed amendment to allow
channel letters on the side elevation based on the visibility of this elevation from the Wal-Mart and
the traffic in and around this area.
The development standards are straight forward and are specific to the subject property. The retail
space is allowed signage (on the west elevation) which is visible from Zane Street, Highway 169 and
various locations in the development. Given the fact that the retail space has existing signage that is

visible, staff does not support the proposed amendment and therefore is recommending denial of
the request.

Description of Project Narrative:
We are requesting the approval of (1) set of 36 DOLLAR TREE internally illuminated channel
letters mounted on the side (North) elevation. The letters will match the front elevation signage in
both size and layout. The front elevation was permitted and installed in March of 2008.
